The Will of Samuel Young

 

In the Name of God Amen I Samuel Young of Hooknorton in the County of Oxford Woolman being of sound and disposing Mind and Memory for which I bless God do this twenty eighth day of January in the year of our Lord one thousand seven hundred and ffifty seven make and ordain this my last Will and Testament in manner following that is to say first of all I will that all such Debts as I shall justly leave at the time of my Decease and my ffuneral Charges and Expences be in the first Place Paid by my Executors hereinafter named and as to my Estate both Real and Personal I dispose thereof in manner following that is to say first I give and devise unto my Son John Young and his heirs all that my Messuage Cottage or Tenement with the Appurtenances Situate in Hooknorton aforesaid now or late in the possession of Michael Phipps and which I bought and Purchased of one John Minchin To have and to hold the said Messuage Cottage or Tenement with the Appurtenances unto and to the use of my said son John Young and of his heirs and assigns forever also I give and devise all that my one Half Yard Land of arable Meadow and Pasture ground lying in the ffeilds of Hooknorton aforesaid which I bought and Purchased of my ffather and all that one quarter of One Yard Land and either of them belonging unto my beloved Wife Mary and my said son John and to their Executors Admors and Assigns for and during so long Time and until my youngest Daughter Mary Young shall arrive to her age of one and twenty years and if my Wife shall be living when my said Daughter Ann Young shall arrive to her age of twenty one Years then and in such Case I give and devise the same Payable out of the said Yard Land with their Appurtenances unto my said Wife and son John for and during the Term of my Wife's natural Life for the better Maintenance of my Wife and the breeding up and maintenance of my two Daughters Sarah Young and Ann Young until they shall attain to their respective ages of one and twenty years and from and after my Wife's Decease of after my said Daughter Ann shall arrive to the age of twenty one years which shall last happen then I give and devise the said half Yard and one Quarter of a Yard Land with all Commons Profits and Appurtenances thereunto belonging unto my Son Samuel Young and to his Heirs and Assigns forever upon Condition nevertheless that my said Son Samuel Young or his Heirs do thereout Pay or cause to be paid unto my four Daughters Mary Elizabeth Sarah and Ann the Sum of Twenty Pounds of Lawful Money a peice within one year after he or his heirs shall be in Possession of the same land Yard and one quarter of a yard Land Provided and the Gift and devise of the said one half Yard Land and one quarter of a yard Land unto my said Son Samuel and his heirs as aforesaid & upon further condition that he my said son Samuel and his Heirs do Pay or cause to be Paid unto Mary Young Widow of my late Brother in Law Thomas Young deceased Yearly and Every Year during her natural Life the Annuity Yearly Sum or Rent of Eighteen Pounds charged or made Payable unto her for her Life in and by the last Will and Testament of which said he said Thomas Young deceased Annuity Yearly Sum or Rent of Eighteen Pounds or some part thereof for the better Securing of the Payment of the same is charged upon or made Payable out of the said one Payable out of the said half Yard and one Quarter of a Yard Land or some Part thereof and in Case my said Son Samuel or his heirs shall neglect or refuse to Pay unto the said Mary Young Widow Yearly and every Year for her Life the said Annuity Yearly Rent or Sum of Eighteen Pounds or any Part thereof then and in such case I give sand devise the said one half Yard Land and one quarter of a yard Land with the Appurtenances unto my said Son John Young his heirs and Assigns To have and hold the same unto my said Son John Young his heirs and assigns forever charged and chargeable nevertheless with the Payment of the said Sum of Twenty Pounds a peice unto my said four Daughters as aforesaid also all my Goods Chattels Cattle Credits Stock and Personal Estate whatsoever and wheresoever I give and bequeath unto my said son John and my said four daughters equally to be divided between them as they shall respectively attain their ages of one and twenty years But my Will and meaning is that my Daughter Mary shall deduct and ...out of her share and part of my said Personal Estate so much Money as what she has already had and received of me at the time of her Marriage or at any time since only my Will is that my Wife shall have the use of my household Goods for her Life and my Will and Meaning is thast my two Youngest Daughters shall be paid Interest from time to time yearly for their respective Shares and Parts of my said personal Estate until they shall have attained their respective Ages of Twenty one Years or otherwise be maintained bred up and educated out of and by the Profits and Interest of my said Personal Estate until they shall have received their Shares and Parts thereof respectively and I do hereby nominate Constitute and appoint my said Wife and my said Son John Executors or Executrix of this my last Will and Testament and I do nominate and appoint my ffriends Thomas Hawton of Southweston in the said County of Oxford and Nathaniel Walford of Hook Norton aforesaid Trustees and Overseers of this my Will desiring them to see the same Performed and executed in all respects according to the true Intent and meaning hereof and I do hereby revoke and make void all former Wills by me made In Witness whereof I have to this last Will and Testament contained in two Sheets of Paper to each of the said sheets set my hand and seal the day and year first above written
