I John Yerbury of Shirehampton in the
County of Gloucester do make and declare this to be my last will
and Testament I give and bequeath to my dear wife for her sole
use and benefit during her life all my property both real and
personal (except what is settled on my two daughters by their
respective marriage settlements)on condition that she pay out of
it any bequest which I may make in this will or by any
subsequent deed or codicil I hereby authorize my wife with the
consent of my executors to sell or exchange any part of my
property I give and bequeath all my property both real and
personal (not otherwise bequeathed) after my wife’s decease to
my two daughters in such proportions as my wife by any legal
instrument may direct but if she make no appointment then to be
equally divided between them and in case only one survive their
mother the whole to the survivor unless the deceased daughter
leave any children in which case they shall inherit the portion
intended for their mother It is my will that the fortune of each
of my daughters shall go to her children after her decease in
such proportions as she shall direct but if no appointment then
to be equally divided between them I hereby nominate and appoint
William Wroughton Salmon of Park Square Regents Park London
EsquireGeorge Clutterbuck Twywell of the City of Bath Banker and
Isaac Cooke of the City of Bristol Solicitor to be Executors of
this my last will and Testament and I give to each of my
executors fifty pounds for their trouble In Witness whereof I
John Yerbury the Testator have to this my last will and
Testament set my hand and seal the seventh day of September in
the Year of our Lord One thousand eight hundred and forty one _
