I HENRY YARKER of Richmond in
the County of York Gardener do hereby revoke all wills codicils and
other testamentary dispositions made by me at any time or times
heretofore and do publish and declare this to be my last will and
testament. I bequeath all my household goods and furniture unto my
wife for and during the term of her life and after her decease I
direct the same to be equally divided amongst all and every my
Children. I bequeath unto LEONARD COOKE of Richmond aforesaid
Esquire and JAMES HUNTON of the same place gentleman .... all other
my Personal estate whatsoever and of what nature or kind soever Upon
trust with all convenient speed after my decease to sell dispose of
an convert unto money so much therefor as shall be in its nature
saleable ... and the said LEONARD COOKE and JAMES HUNTON ... to pay
all my just funeral and testamentary expences and to lay out and
invest the residue ... to pay the interest and annual produce
thereof to my said Wife for and during her natural life and after
the decease of my said Wife upon Trust to pay and divide the said
trust monies... amongst all and every my Children who being a son or
sons shall live to attain 21 years or being a daughter shall live to
attain that age or marry in equal shares..... And I appoint the said
LEONARD COOKE and JAMES HUNTON joint executors of this my Will in
witness whereof I have hereintofore set my hand and seal this 19

Turner of Richmond in the County of York Gentleman and made oath
that he is one of the subscribed witnesses of the execution of the
last will and testament of Henry Yarker formerly of Richmond
aforesaid and late of Marske in the County of Yorke gardener
deceased bearing date 19 November 1840 hereunto annexed and he
further made oath that on the 19 November 1840 aforesaid the said
Henry Yarker only executed his said will and testament in writing
his name at the foot and thereof in the presence of this deponent
and of Marmaduke Todd the other subscribed witness thereto all of
whom were present at the same time and this deponent and the said
Marmaduke Todd there upon attested and subscribed the said will in
the presence of the said testator and of each other.

The will of Henry Yarker late
of Richmond in the County of York gardener deceased was proved at
York 5 August 1850 by the oaths of Leonard Cooke and James Hunton.
