In the name of God Amen I George Winstanley of
Billing in the County of Lancaster yeoman being in reasonable good
health and of a sound and disposing memory blessed bee Almighty God
for the same yet aged and understanding the uncertainty of my
dissolution, and to prevent trouble when I shall be lesse Capable to
order and settle my affairs doe make this my last will and testament
in manner and fforme following.
First and principally I Comitt my soule into the hands of Almighty
god hopeing and assuredly trusting for Salvation through the
meritorious death passion and resurrection of my Lord and Saviour
Jesus Christ, and my body to be decently interred at the discretion
of my Executrix hereafter named
And as for the transitory goods that god in merry? hath bestowed
upon mee I order and dispose of them as followeth
It is my mind and will that after my debts (if any be) funeral
expenses and probate of this my will bee discharged my dear and
loving wife Mary Winstanley shall have all my goods Cattle Chattles
utensils and household stuff of what kind or qualitie soever they
are paying unto my brothers Thomas John and James Winstanley twelve
pence apiece, and alsoe twelve pence to my sister Mary
And as for my reall estate Messuage and Lands I settle order and
dispose of them in manner following. That is I hereby give and
bequeath the said Messuage & Lands unto Mary Winstanley my now wife
and her assigns during the term of her natural life Chargeable with
the interest of the sume of tenn pounds to bee paid out of the said
Lands yearly to the
overseers of the poore of Windle, for the said sume of tenn pounds I
am intrusted on that account
And after the death and decease of Mary my now wife Then it is my
will and mind that the said Messuage and lands shall be possessed
and enjoyed by Humphrey Winstanley sonne of John Winstanley and the
heires Males of the body of the said Humphrey Winstanley lawfully
begotten neverthelesse Chargeable with the sume of tenn pounds to
the overseers of the poor of Windle afforesaid and shall alsoe pay
unto Every of my Nephews the sume of tenn shillings apiece;
And shall likewise pay unto James Tyrer Sonne of Robert Tyrer the
Sume of Tenn pounds These last recited legacies to bee paid within
one year after the decease of the said George Winstanley and Mary
his wife,
And for the want of Issue Male lawfully begotten by the said
Humphrey Winstanley then the afforesaid Messuage and lands to bee
possessed and enjoyed by James Winstanley Sonne of the afforesaid
John Winstanley and the heirs males of the said James Winstanley
lawfully begotten Chargeable with the Sume of tenn pounds to the
overseers of the poor of Windle, and alsoe Chargeable with the
before mentoned legacies (if the same bee not discharged)
And then for want of such Issue Male as afforesaid then to the Rt
heires of the said Georg Winstanley for ever never the lesse
Chargeable as afforesaid
And I the said George Winstanley do publish and declare this to bee
my last will and testament makeing all former and other wills by mee
made null and void And doe hereby Constitute ordaine and Make my
dear and loving wife Mary Winstanley sole Executrix of this my last
will and testament not doubting but shee will faithfully pforme the
trust by mee in her reposed
