Notes:

  1. Testator was the son of Richard Wilson by Ellen Haworth; he was born in 1709 and died in 1742;

  2. Testator’s wife was Isabel (b 1713), daughter of Robert Hull of Poulton le Fylde, Lancashire; after testator’s death she married James Standen in 1748;

  3. Testator’s son Richard, who would have been a child when his father died, must have died young;

  4. Testator’s daughter Margaret (1742-1817), an infant when he died, is described as her father’s heiress;  she married Edward Pedder of Preston and had four sons and four daughters;

  5. Testator’s mother was born Ellen Haworth; she married Richard Wilson of Poulton le Fylde, Lancashire in 1704.

Will:

In the name of God, Amen.  The twenty sixth day of August in the year of our Lord one thousand seven hundred and forty two, I, Richard Wilson of Newton in the county of Lancaster, yeoman, being somewhat indisposed in health but of sound and perfect mind and memory (praised be God for the same), do make and publish this my last will and testament as followeth, and,

First I order and direct that all my just debts and funeral expenses shall in the first place be paid and discharged out of my personal estate

Also, I give and bequeath unto Isabel my wife such and so many of my household goods as she shall please to choose as may be convenient for her ???ing, to whose care and tuition I commit my children so long as she shall continue in my ??? name

Also I give and devise unto my son Richard Wilson, his heirs and assigns all ??? my messuages, lands, tenements and hereditaments whatsoever situate, lying and being in Hardhorn with Newton in the said county or elsewhere, and also all other my personal estate whatsoever, subject to the dower and right and title of dower by the common law of and to Isabel my said wife during her natural life and also charged and chargeable with the maintenance and education of Margaret my daughter until her age of twenty one years and also with the payment of three hundred pounds of lawful British money unto the said Margaret my daughter as her portion at her said age of twenty one years

And in case of the death of my son Richard without issue, and before he comes to twenty one years of age, then I give and devise all and every my said real and all other my personal estate whatsoever unto my said daughter Margaret Wilson, her heirs and assigns for ever, subject to the dower of my said wife as aforesaid

And in case of the death of my said son and daughter, Richard and Margaret Wilson, without lawful issue, then it is my will and mind that my said real estate shall stand charged and chargeable with and I do hereby accordingly charge the same with the payment on one hundred pounds of lawful British money unto Isabel my said wife to be paid unto her within twelve months next after the death of the survivor of my said son and daughter Richard and Margaret Wilson without issue

And also with the payment of the further sum of two hundred pounds to the children then living of the Reverend Robert Loxham of Poulton in the said county, clerk, equally amongst them, one hundred pounds, one moiety thereof to be paid within three months next after the death of Ellen Wilson, widow, my mother, and the other one hundred pounds more, the other moiety thereof, within three months next after the death of Isabel my said wife

And my further will and mind is that in case of the deaths of my said son and daughter without issue, that my sister Mary, now wife of Jonathan Singleton of Poulton aforesaid, woollen draper, and Elizabeth and Sarah Wilson, spinsters, my three sisters shall have and I hereby give and devise unto them and their ??? ??? and every my said real estate whatsoever with the appurtenances ??? ??? ??? equally amongst them share and share alike anything ??? contained ??? ??? in any wise notwithstanding

And lastly I do hereby constitute, name and ??? ??? kinsman Richard Wilson of Whitham in the said county, yeoman, my brother-in-law John ??? of Marton in the said county, and Isabel my wife executors of this my last will and testament hoping they will see the same duly performed as my full trust is in them reposed

Probate:

The twentieth day of February in the year of our Lord one thousand seven hundred and forty eight, Richard Wilson, John Hull and Isabel Standen were sworn well and faithfully to execute the will before me // Robert Loxham //

Obligation:

Know all men by these presents that we Richard Wilson, John Hull and James Standen, yeomen in the county of Lancaster and parish of Poulton are holden and firmly bound unto the Right Reverend Father in God Samuel, by divine permission, Lord Bishop of Chester, in three hundred pounds of good and lawful money of Great Britain to be paid to the Right Reverend Father or to his certain attorney, his executors, administrators, or assigns; to which payment, well and truly to be made, we bind ourselves, and each of us, our heirs, executors and administrators firmly by these presents, sealed with our seals, dated the twentieth day of February in the year of our Lord one thousand seven hundred and forty eight.

The condition of this obligation is such, that if the above bounden Richard Wilson, John Hull and Isabel Standen, late widow of Richard Wilson of Hardhorn with Newton, yeoman, shall and do well and truly execute and perform the last will and testament of Richard Wilson aforesaid, deceased; and do pay all his debts and legacies, so far as his goods and personal estate will extend, and the law shall bind them if also they do exhibit into the court a true and perfect inventory of the said deceased’s goods and personal estate, and give a true and just accompt of their acting in the premises, when they shall be thereunto lawfully called; that then this obligation to be void, or else in force.
