I James Willing of St Georges Street Devonport
do hereby make this my last Will and Testament in manner following
that is to say after Payment of all my just debts and funeral
expences I give and bequeath unto my youngest daughter Ethelina
ffrances Willing the sum of fforty pounds per annum as long as she
remains unmarried to be paid out of the rent of my house No 38
Catherine Street in Devonport aforesaid now in the occupation of my
son Edwin Willing and for which after my decease he is to pay sixty
five pounds per annum rental from which rental must also be deducted
the......the premiums on three lives insured respectively in the
Metropolitan and Sovereign Life Offices ...........now in my
possession to cover the expences fine and Lease for the perpetual
right of renewal granted by Sir John St Aubyn Bart And whereas the
said premises are at present mortgaged to Michael Oliver Navy Agent
in the sum of six hundred pounds and in order to discharge and pay
of the said sum with all convenient speed the whole of my household
furniture plate book etc. Must be sold together with twenty four
share in the Gas and Coke Company and the sum of one hundred and
seventy pounds now due and owing unto me from my Son Herbert Wm
Willing on a note of hand bearing date the first day of July 1853
and all interest that may be due thereon at the time of my decease
and should the whole of these proceeds be found insufficient to pay
off the said mortgage there is a surplus rental of forty pounds per
annum arising from the house No 55 ffore Street held by me under a
lease from the trustees of the Manor of Stoke Damerel for seven
years from the 25th day of December 1854 at thirty five pounds per
annum which said house and premises are now in the occupation of Mr
John Richards as my tenant held under a written agreement from me
for the term of seven years from the above date at the yearly
rent of seventy five pounds the said surplus of forty pounds per
annum shall be left to accumulate till there is sufficient to make
good the full amount of the mortgage and interest due which shall
then be immediately discharged Then whatever amount of income
arising from every after deducting my youngest daughter’s
annuity and premiums as before set forth The residue (if any) shall
be equally divided between my two other daughters Eliza Row and
Henrietta Bilton but in the event of Ethelina marrying then in that
case the whole of my income shall be equally divided between my
three daughters and in case either should die the same shall revert
to the survivors or survivor of them and at the death of the last of
them it shall be equally divided between my four sons John George
Herbert and Edwin or their heirs.......however the pianoforte two
Portraits of myself and Wife and of my Ancestor Chapple be given to
my daughter Ethelina The two Portraits of my ffather and Mother to
my Son John and the portrait of Mrs Britton to my daughter Henrietta
And I do hereby appoint my Sons in Law Mr Charles Row and Mr Edwin
Britton together with my friend Mr Thomas Bond Junr Executors of
this my Will bearing date the twenty eighth day of December 1854 as
witness my hand the day and year above written James Willing
