This is the last Will
and Testament of me Joseph Williams of Brighthampton in the
Parish of Bampton in the County of Oxford Yeoman made this
Twenty ninth day of January one thousand eight hundred and forty
seven as follows In the first place I give all my plate and
plated articles unto M... the daughter of my Step daughter Mrs
Mary Ann Walker of Minster Lovell in the said County and all my
household furniture linen china books pictures and other
household stuff within doors I give to the said Mrs Mary Ann
Walker I give the slated freehold Cottage or Tenement at Coate
in the said Parish of Bampton (given me by my late father) with
the garden and appurtenances to the same belonging now in the
occupation of my niece Ann Hudson the eldest daughter of my
brother Thomas Williams unto my said niece Ann Hudson her heirs
and assigns forever subject nevertheless to a right for my said
brother Thomas Williams of being and residing jointly with my
said niece and her family in the said cottage during his life if
he should remain single but not otherwise And as to the thatched
cottage or Tenement with the garden and appurtenances belonging
adjoining the other cottage at Cote aforesaid I give and devise
the same to my nephew ThomasWilliams son of my said brother
Thomas Williams his heirs and assigns forever I give and devise
unto my step son William Pinnock of Chimney in the said Parish
of Bampton Yeoman and his Uncle William Pinnock the Elder of
Standlake in the said County Grocer and Farmer All those Lands
of Arable Meadow and Pasture with all Commons and Common rights
easements and appurtenances belonging thereto lying in the
fields and meadows of Standlake Hardwicke and Ducklington in the
said County or some or one of them or elsewhere and which
contain together about ten field acres and were given me by my
uncle Upon Trust to let and set the same and to pay out of the
rents and profits thereof four shillings a week to my said
brother Thomas Williams for his sole and only use during his
life and the residue of such rents I give to my said Trustees
for their own use and benefit during the life of my said brother
Thomas and which weekly sum shall be paid unto no other person
but into the proper hands of my said brother to the intent that
he may not on any pretence make any sale or assignment thereof
or receive any remuneration whatsoever therefrom by way of sale
or anticipation And immediately upon the decease of my said
brother Upon Trust to sell the same Lands commons and
appurtenances either together or in parcels by public auction or
private contract unto any person or persons whomsoever for the
best price or prices that can be obtained for the same with full
power to enter into and make and execute such Contracts
Agreements Conveyances deeds and acts as they or the survivor of
them shall deem expedient or proper and stand possessed of the
money arising from such sale or sales after deducting the
expences attending the same Upon Trust to pay share and equally
divide the same unto and between the children of my said brother
Thomas And if any or either of such children should happen to
die in my lifetime leaving lawful child or children such child
or children as the case may be shall take their deceased parents
share And I declare that the receipt and receipts in writing of
my said Trustees or Trustee for the time being for such purchase
money shall be a good and effectual discharge and release in law
for the same And that the purchaser or respective purchasers his
her or their heirs executors administrators or assigns shall not
afterwards be answerable or accountable for any loss
misapplication or nonapplication or be in anywise obliged or
concerned to see to the application of the money therein
mentioned or acknowledged to be received or any part thereof All
the rest residue and remainder of my freehold leasehold and
real estate whatsoever and wheresoever not hereinbefore disposed
of and also all the residue of my personal estate farm stock
implements of husbandry corn cattle grain hay money securities
for money book and other debts and all the rest and residue of
my personal effects and estate whatsoever and wheresoever I give
to my said Trustees Upon Trust in the first place to pay out of
such personal estate all my just debts funeral and testamentary
expences and then to pay nineteen guineas to my late wife's
brother Robert Sparrowhawk of Aston in the said Parish of
Bampton nineteen guineas to my nephew the said Thomas Williams
and ten guineas to my said Trustee William Pinnock of Standlake
And then Upon Trust to pay One hundred pounds to Elizabeth Ann
Munton the eldest daughter of John Munton of Hardwicke aforesaid
Farmer but if the said Elizabeth Ann Munton should die in my
lifetime leaving lawful child or children then I give the said
One hundred pounds unto and equally between the said children if
more than one and if but one then the whole to such one child
but if she should die before me having no lawful child or
children her surviving the I give the said One hundred pounds
unto and equally between all the other children of the said John
Munton living at the time of my decease and I declare that in
case my said personal estate should not be sufficient to pay the
said legacy of One hundred pounds then the same or the unpaid
part thereof shall be a charge and I hereby charge the same on
all my real estate and after such several payments or legacies I
give and devise to the said William Pinnock of Chimney All that
Acre of Land more or less called Short Furlong in the Common
fields of Aston and Cote aforesaid in the Kings way Field there
given me by my said late uncle And all that Land in the same
Fields in Briar Furlong in the Gaston field there which last
mentioned Land contains about half an acre and was given me by
my said late father To hold to the said William Pinnock his
heirs and assigns for ever And I also give to the said William
Pinnock of Chimney all the residue if any of my said personal
estate money and securities for money for his own absolute use
and benefit and I give to the said Mary Ann Walker all the
estate and interest I now have or may have at the time of my
death in the house wherein I now live and the farm lands and
appurtenances belonging thereto held under Saint Johns College
Oxford to and for her and their own absolute use and benefit
subject to the yearly rents and other payments due from the same
Provided always and I hereby declare that the whole of the
devises and bequests hereinbefore made in favour of the said
William Pinnock of Chimney and Mary Ann Walker shall be valued
by two competent persons mutually appointed and their umpire in
the usual way (in case the said William Pinnock of Chimney and
Mary Ann Walker should not agree as to the value) and the
difference of value of such devises and bequests shall be paid
and made good by one of the said parties to the other as the
case may be or require and shall be a charge upon his or her
share And I hereby declare that the said devises and bequests
hereinbefore made in favour of the said William Pinnock of
Chimney and Mary Ann Walker shall not lapse in case of the death
of either of them before me but the same shall go and enure to
his or her heirs executors or administrators according to the
nature or tenure thereof as the case may be And I further
declare that the said devises and bequests in favour of the said
Mary Ann Walker shall be taken and enjoyed by her as her
separate property independently and exclusively of her present
or any future husband so that the same shall not be subject to
his debts control or engagements and that he shall not be able
without her consent to sell or in anywise dispose of the same or
the profits thereof and upon her decease the same shall go to
such uses as she shall notwithstanding her present or any future
coverture have directed given or devised the same I appoint my
said Trustees joint Executors of this my Will hereby revoking
all other Wills by me at any time heretofore made In witness
whereof I the said Joseph Williams the Testator have to this my
last Will and Testament contained in four sheets of paper set my
hand the day and year first above written Joseph Williams,
Signed by the said Testator as and for his last Will and
Testament in the joint presence of us present at the same time
who in his presence at his request and in the presence of each
other have hereunto subscribed our names as Witnesses James Rose

This Will was proved at
Oxford on the fifteenth day of November in the year of our Lord
1848 Before The Reverend Dacres Adams Clerk Master of Arts
Surrogate of The Worshipful Robert Joseph Phillimore Doctor of
Laws Official Principal of The Venerable The Archdeacon of the
Archdeaconry of Oxford lawfully constituted By the Oath of
William Pinnock the only surviving Executor therein named to
whom Admon was granted being sworn duly to administer
