The Will of William Whitell

 

This is the Last Will and testament of my WILLIAM WHITELL farmer of Reeth in the North Riding of the county of York made this 11 March 1850 that is to say I give and bequeath and devise to JOHN CLOSE of Agglethorpe in the said County and to my son WILLIAM WHITELL Innkeeper of Ravenstonedale Westmoreland their heirs and assigns in Trust nevertheless, and for the Interests and Purposes following, that is to say upon trust that they the said JOHN CLOSE and WILLIAM WHITELL shall execute this my last will and testament in the following manner with all convenient speed.

First I give to my daughter ANN RICHARDSON the wife of RICAHRD RICHARDSON for and during her natural life all those several messuages and dwelling houses situate in Reeth aforesaid now in the occupations of RALPH SMITH and HENRY HODGSON and the messuage of dwelling house which I now occupy together with the parcel of ground behind the same called Line Crofts and all the appurtenances  ... and at her decease to all the children of her body then living share and share alike and my further will is that the said Premises shall be sold and the proceeds of such sale to be divided amongst the said children when the youngest shall have arrived at the age of 18 years.

And I also give and bequeath to my Grand daughter ELIZABETH WHITELL daughter of my late son JOHN WHITELL and his first wife MARGARET .... all that messuage or dwelling house situate in Reeth aforesaid now in the occupation of MARTHA JONES.

In respect of my other property known by the name of Watson House Farm, I have made a Free Gift and assigned unto the hands of the Lord of the Manor for the purposes assigned in the deed dated 30 April 1847 to my son ROBERT WHITELL of London, to my son WILLIAM WHITELL of Ravenstonedale  and to the children of my late son JOHN WHITELL of Manchester for their separate use therein named , and I do further direct that all the residue of my personal Property, after paying my just debts Funeral Expences and testamentary expences , shall be equally divided between my daughter ANN RICHARDSON and my Grandaughter ELIZABETH WHITELL daughter of my late son JOHN WHITELL share and share alike and I do further direct constitute and appoint the said JOHN CLOSE and WILLIAM WHITELL Executors of this my last will and testament hereby revoking all other wills made by me heretofore In Witness whereof I have hereunto set my hand and seal on the day and year first written.

whereas I WILLIAM WHITELL farmer of Reeth in the parish of Grinton and North Riding of the county of York have made and duly executed my last will and Testament in writing bearing date 11 March 1850 Now I hereby declare this present writing to be a codicil to my said last will and I do direct the same to be annexed thereto and to be taken as part thereof. And I do hereby give and bequeath to my Grandaughter ELIZABETH WHITELL named in may last will as follows in addition to my previous bequest. Two Arm Rocking Chairs, One Clock, one Bed Bedstead and bedding, one oak drawers, all the silver Tea and Table spoons, Best Fire irons, night commode, Mahogany Dining Table and one set of China. And I do hereby ratify and confirm my said will in all the other particulars thereon In witness whereof I the said WILLIAM WHITELL have to this codicil set my hand and seal this 9 August 1853

whereas I WILLIAM WHITELL of Reeth in the County of York yeoman have by my last will bearing date 11 March 1850 and my codicil dated 9 August 1853 given and bequeathed Now I the said WILLIAM WHITELL being desirous of altering my said will in respect to the Garden left in my will to ANN RICHARDSON I now leave the same to my grandaughter ELIZABETH WHITELL I also leave to the said ELIZABETH WHITELL my grandaughter in possession of the  dwelling house I now occupy with full power to collect all the rents and arrears of rent of the oproperty now laying in Reeth belonging one WILLIAM WHITELL until Lady Day next after my decease And I do ratify and confirm my said will in every thing except where the same is hereby revoked and altered as aforesaid In witness whereof I have hereunto set my hand and seal I also leave my son WILLIAM WHITELL the desk and Delf Rails standing in my Kitchen and the joiner's Tools and other requisites standing in the Part of the House called New End dated this 25 January 1854

8th July 1854 appeared the executors within named and were sworn  ......

Appeared personally Joseph Deacon of Reeth in the County of York, corn dealer, and made an oath that he is one of the subscribed witnesses

Appeared personally John Thwaites of Reeth in the County of York, draper and made an oath that he is one of the subscribed witnesses .....
