The Will of John White

 

This is the last Will and Testament of me John White of Oldbury in the Parish of Halesowen in the County of Salop Coal Dealer First I will and direct that all my just debts Funeral expences and the expences of proving this my Will be fully paid and satisfied by my Executrix hereinafter named I give and bequeath unto my Wife Mary all my Household Goods Linen and effects for and during the term of her natural life and from and after her decease I give and bequeath the same unto my Son David for his sole use and benefit. I give devise and bequeath unto my sons John and David their Heirs Executors Administrators and Assigns All my real and copyhold Estate and all the ….personal Estate whatsoever and wheresoever and of what nature or kind soever according to the several nature of the said Estate and Property respectively upon the several ends intents and purposes hereinafter declared of and concerning the same that is to say Upon trust that they the said Trustees or the Survivor of them and the Heirs Executors or Administrators of such Survivor shall and do permit and suffer my said Wife Mary to hold occupy and enjoy the Dwellinghouse and premises where I now reside and also to receive and take the Rents Issues and Profits of my Freehold and Copyhold Estate for and during the term of her natural life and after the decease of my said Wife Then upon trust that they my said Trustees or the Survivor of them and his Heirs do and shall as soon as may be sell and dispose of Freehold and Copyhold Estate by Auction for the most money that can be obtained for the same and also shall and do pay distribute and divide the money to arise from such sale after first paying and allowing unto my son David the sum of Fifty Pounds which I hereby bequeath unto him (in order to make the share of my property equal to what my other children have had in my life time) equally between themselves the said John and David and my other children Sarah and Samuel share and share alike Provided always and it is my Wish that if any or either of my Children shall depart this life before the share of my property hereinbefore given to him or her shall be payable as aforesaid leaving lawful Issue of his her or their body or Bodies then the share or shares of him her or them so dying shall go and be paid to such Issue and if more than one in shall be equally divided between them share and share alike and be paid and payable as and when they shall respectively attain the age or ages of twenty one Years and in the meantime shall be placed out at Interest by my said Trustees or the Survivor of them his Heirs Executors or Administrators and the Interest paid or applied towards his her or their maintenance …and support Provided also and I do hereby direct and declare that it shall be lawfull for and I do hereby empower my said Trustees and the Survivor of them and the Heirs Executors and Administrators of such Survivor to make execute and perfect all necessary or proper deeds writings conveyances and assurances for the purpose of vesting my said Property hereinbefore directed to be sold as aforesaid or any part thereof in purchase or purchases thereof or in such person or persons and to such uses intents and purposes as they shall direct and I do hereby declare that the receipt or receipts of my said Trustees or the Survivor of them his Heirs Executors and Administrators shall be a full and sufficient discharge ……such Purchaser or Purchasers or any… for the same as so much thereof as in such receipt or receipts shall be acknowledged to be received and that the person or persons respectively who shall become such purchaser or purchasers …shall not be afterwards be answerable or accountable for the misappropriation or non application of the same And lastly I nominate constitute and appoint my said Sons John and David Executors of this my Will and hereby revoking all former and other Wills by me at any time made do declare this to be my last Will and Testament In Witness whereof I the said Testator John White to this my Will contained in two sheets of Paper set my hand and seal the twenty second day of October in the Year of our Lord One Thousand eight hundred and Thirty John White X his mark
