The Will of Ellen Wharton

 

Know all men That I Ellen Wharton of the Parish of Bidston in the County of Cheshire do make and ordain this my last Will & Testament That is to say First I give and bequeath my whole Estate and affects of what Kind soever or wheresoever they may be found after my just debts and Funeral Expenses are paid to John Pendleton of Moreton & Stanley Sarrett of Birkenhead to hold in trust for the whole sole & entire benefit of my two Children Thomas & Ellen Wharton until my said Son Thomas Wharton attain the age of twenty five years And it is my Will that my two children shall have all the profits arising from All my Estates & effects during the time between my decease and my Son Thomas' arrival at the age of 25 Years Applied equally to their benefit in what way soever the said John Pendleton & Stanley Sarrett may deem most proper. And I further Will & direct that when my Son Thomas attains the Age of Twenty five and not before that time all my Estate & Effects whether Leasehold or of what kind soever they may be shall be divided in equal parts between my Son Thomas & Daughter Ellen share & share alike as they themselves wish, if they can agree on the division: but if not it shall be divided in the above proportions by the said John Pendleton & Stanley Sarrett or the survivor of them & such division shall be final And I further will & direct that in case the aforesaid John Pendleton & Stanley Sarrett both dying before my Son Thomas attain the age of Twenty five years that then and in that case my Son Thomas & Daughter Ellen shall take full possession of all my Estate & effects what Age ever they may be & they forthwith shall be divided between them in such portions & shares as have been already mentioned And I likewise constitute, make, and ordain the aforesaid John Pendleton & Stanley Sarrett my Executors of this my last Will & Testament, And I do hereby dissallow, revoke, & disannul, all and every other former Testaments, Wills, Legacies, Bequests, and Executors by me in any way before named ratifying this & no other to be my last Will and Testament. In witness whereof I have set my hand and seal this twenty seventh day of July in the year of our Lord one thousand eight hundred and thirty eight Ellen Wharton

On the 21st day of April 1842 John Pendleton, late of Moreton, now of Bidston, one of the Executors in this Will named was sworn in common form (the other Executor therein also named being dead) and he further made oath that the personal Estate and effects of the Testatrix within the Diocese of Chester
were under the value of one hundred and thirty pounds
