The Will of William Welch

 

This is the last Will and Testament of me William Welch of New John Street West Birmingham Gentleman I wish and desire that all the Property which I may have at my decease should be equally divided between my four Children namely Sarah Ann the wife of William Rooker William Welch Henry Welch and Thomas Welch as Tenants in common and for the purpose of carrying out such my wish and desire I devise my real estate and bequeath my leasehold and personal estate together with any other property over which I may have a disposing power unto the said William Rooker and William Welch To hold such real estate unto them their heirs and assigns and To hold such leasehold and personal estate and other property unto them their executors administrators and assigns Upon trust to sell either by Public Auction or by Private Contract and subject to such stipulations as to Title or otherwise as may be deemed expedient my real and leasehold properties and to convey and assign the same properties respectively when sold unto the purchaser or purchasers thereof and also to convert or otherwise get in my other personal estate and properties And I direct my said Trustees to stand possessed of the produce of such sale and conversion as aforesaid Upon trust for any said four children Sarah Ann Rooker William Welch Henry Welch and Thomas Welch as tenants in common as hereinbefore mentioned I devise unto the said William Rooker and William Welch their heirs and assigns all real estate if any vested in me upon any trust or by way of Mortgage subject nevertheless to the trusts and equities affecting the same I direct and declare that the receipts of my Trustees the said William Rooker and William Welch shall be sufficient discharges to all persons paying any monies to them under the trusts and directions of this my Will Lastly I Appoint the said William Rooker and William Welch Executors of this my Will In witness whereof I have hereto set my hand this seventeenth day of October one thousand eight hundred and sixty three ______William Welch_______

On the 10th day of November 1863 the Will of William Welch of New John Street West Birmingham in the county of Warwick Gentleman deceased was proved by the oaths of William Rooker and William Welch the Son of the deceased the executors
