The Will of William Welch
This is the last Will and Testament of me William
Welch of Lower Loveday Street Birmingham in the County of Warwick
Earthenware Dealer and Van Proprietor I bequeath to my dear Wife Rose
Ann Welch for her own use and benefit absolutely my household furniture
my stock in Trade as an Earthenware Dealer my horses harness vans and
other effects used in my Business as a Van Proprietor my book debts
ready money and all other personal estate my leasehold properties only
excepted I devise and bequeath unto my friends George Hill of Hatchett
Street in Birmingham aforesaid Plater and George Shelley of Hockley Hill
in Birmingham aforesaid Grocer my two freehold messuages land and
premises in Green Street Birmingham Heath Also my two leasehold
messuages and premises at Bloomsbury in Birmingham aforesaid And my
leasehold messuage Shop and premises in Lower Loveday Street in
Birmingham aforesaid Together with all other (if any) my freehold and
leasehold properties To hold the said freehold properties unto my said
Trustees their heirs and assigns And to hold the said leasehold
properties unto my said Trustees their executors administrators and
assigns Upon the trusts and for the intents and purposes following (that
is to say) Upon trust to pay to or otherwise permit my said wife Rose
Ann Welch to receive the annual rents and income of my said freehold and
leasehold properties for her life for her separate use and so as that
she shall not by anticipation deprive herself of accruing or future
Income And at her decease Upon trust to sell my said freehold and
leasehold properties with power to make any special or other conditions
of sale as to title or evidence of title or otherwise and with power to
buy in the premises at any sale by public auction and to rescind either
on terms or gratuitously any contract for sale and to resell the
premises without being responsible for any loss And do and shall stand
possessed of the produce of such sale together with the interim rents
and profits of the premises In trust for my child if only one or all my
children equally if more than one who being a son or sons shall attain
the age of twenty one years or being a daughter or daughters shall
attain that age or marry But if no Child of mine being a son shall
attain the age of twenty one years or being a daughter shall attain that
age or be married then the produce of such sale together with the
interim rents and profits of the premises shall be held by my said
Trustees In trust for my Brothers Thomas Welch and Henry Welch and my
Sister Sarah Ann the wife of George Rooker as tenants in common I
declare that the trusts hereinbefore vested in my said Trustees shall be
exercisable by the trustees and trustee for the time being of this my
Will I appoint my said Wife sole Executrix of this my Will In witness
whereof I have hereto set my hand this seventh day of August one
thousand eight hundred and sixty seven
