The Will of Thomas Warren

 

This is the last Will and Testament of me Thomas Warren of Birmingham in the County of Warwick Appraiser and Auctioneer being weak in Body but of sound and disposing Mind Memory and Understanding Which Will I declare to be as follows First I direct that all my just debts funeral expences and the costs of proving this my will be fully paid and discharged And subject thereto Then I give and devise unto my friend Thomas Freer of Dale End Birmingham aforesaid Druggist and Grocer All that my Freehold Estate consisting of a Messuage or Tenement Shop Outbuildings Garden Croft Land hereditaments and premises to the same belonging called or known by the Name of the Fox and Goose situate and being in little Bromwich in the Parish of Aston Juxta Birmingham aforesaid and now in the possession of Mary Shepherd Widow Also all that piece or parcel of Freehold Land lying and being in a certain Field called Yardley Field in the Parish of Yardley and County of Worcester containing by Estimation one acre and a quarter (more or less) Also All that my Freehold Messuage or Tenement with the outbuildings hereditaments and appurtenances to the same belonging situate standing and being in John Street in Birmingham aforesaid called or known by the Name of the Star and Garter Public House now in the possession of Robert Aston And also all that my Freehold Messuage or Tenement and Premises with the hereditaments and appurtenances to the same belonging situate and being in Ranns Yard in High Street Birmingham aforesaid now in the possession of John Mander or his Undertenant Together also with all that Ground Rent or Rent Charge issuing out of or from two several Messuages or Tenements and Premises situate and being in Park Street Birmingham aforesaid , being the Yearly Sum of One Pound and eighteen shillings equally to be divided and payable half yearly by the respective Tenants thereof (George Brunton and Robert Walker) or the Owner or Owners of the said Premises, To hold all and singular the said several and respective Messuages or Tenements Buildings Lands Hereditaments Rent Charge and Premises with the appurtenances unto the said Thomas Freer his Executors and Administrators Upon Trust and Confidence nevertheless and to and for the several uses intents and purposes hereinafter declared (that is to say)That he my said Trustee his Executors and Administrators do and shall permit and suffer Thomas Smallwood of Birmingham aforesaid Wine and Liquor Merchant and my Son Thomas Warren Appraiser and Auctioneer to receive take and have the rents issues and profits thereof and of every part thereof , from and immediately after my decease, equally between them share and share alike; or otherwise, to permit and suffer them the said Thomas Smallwood and my said Son Thomas Warren . at such time, or at any time afterwards, to have take hold and enjoy all and singular the said Freehold Estates Lands Hereditaments and Premises equally between them share and share alike; to take have and hold the same Freehold Estates and Premises, as Tenants in Common, and not as joint Tenants And I do hereby give and devise the same to them the said Thomas Smallwood and my said Son Thomas Warren accordingly To hold to them respectively and to their heirs and assigns for ever. And as for or concerning the said Yearly Rent or Rent Charge of One Pound and eighteen shillings, issuing and payable as aforesaid, And also all and singular my Household Furniture and Implements of Household Beds Bedding Plate China Linen Bonds Book-debts Books of account Goods chattels and all and every other part of my personal Estate property and Effects whatsoever and wheresoever and of what nature kind quality or description soever, of which I may die possessed, or to which I may be entitled I give and bequeath the same and every part thereof unto the said Thomas Smallwood and my said Son Thomas Warren to be equally divided between them share and share alike And I do hereby give and bequeath such personal Estate property and Effects accordingly to dispose thereof as they shall think proper And I do also direct that my said Trustee his Executors or Administrators and my Executor hereinafter named, shall reimburse himself and themselves respectively and out of my said Freehold and personal Estate and Effects respectively, or such part thereof as may be necessary, all such Costs charges and Expences which he or they shall or may pay lay out or expend in the executing or performing the Trusts hereby in them respectively reposed And I do hereby nominate constitute and appoint the said Thomas Smallwood sole Executor of this my Will And lastly I do hereby revoke and make void All and every wills and will by me at any time heretofore made and declare this only to be my last will and Testament In Testimony whereof I have to this my last will and Testament contained and written upon three Sheets of Paper set my Hand to the two first Sheets thereof , and set and put my Hand and Seal to this third and last Sheet this Fourth day of January One thousand eight hundred and eight    Thos Warren
