The Will of Isaac Walter

 

In the Name of God Amen I Isaac Walter of Cranbrooke in the County of Kent Gent being aged and infirm but of sound and disposing mind memory and understanding (praised be God for the same) do make publish and declare this to be my last Will and Testament in manner and form following (that is to say) ffirst and most principally I do with all humility resign up my poor and imortall Soul into the hands of Almighty God that gave it hoping through the Merits Death and Passion of my Redeemer Jesus Christ to have and receive full and free parden and forgiveness of all my Sins and to inherit everlasting life in the Kingdom of Glory and my Body I commit to the Earth to be decently buried at the discretion of my Executrix hereafter named and as for the disposition of all such worldly estate as God of his bounteous goodness has been pleased to bestow upon me I give devise dispose of and bequeath the same as follows (that is to say) ffirst I will order and direct that all such just debts which I shall owe at the time of my decease my ffuneral Expences and the charge of proving this my Will be paid and discharged by my Executrix out of my personal estate And Whereas my wife Ann did in Hillary Term last acknowledge and levy one ffine Sur Conizance unto John Browne and his heirs of the messuage wherein I now dwell and of the Barns Stables Orchards and appurtenances thereunto belonging and of all those twelve Closes of
Land meadow pasture and Wood with their appurtenances to the said Messuage also belonging containing by estimation ffifty seven Acres more or less lying and being at Coushorne upon the Den of Coushorne in Cranbrooke aforesaid and of all other my Lands Tenements and Hereditaments in Cranbrooke aforesaid The uses whereof are declared in and by certain Indres bearing date on or about the seventeenth day of March now last past and made or mentioned to be made between me and my said Wife of the one part and the said John Brown by the name of John Brown of the Parish of St Olaves Southwark in the County of Surry Salesman of the other part to be to the use of my self for Life without impeachment of Wast and after my decease To the use of my said Wife for her life Then to such Use and uses Estate and Estates as I the said Isaac Walter should by my last Will and Testament or any other Deed or Writing by me only executed in the presence of and attested by two or more credible Witness give declare limit or appoint and for want of such Gift declaration limitation or appointment Then to the only use or behoof of me the said Isaac Walter and of my Heirs and Assigns for ever Now I do hereby Will give and bequeath All those my two peices or parcels of Woodland with their appurtenances commonly called or known by the several Names of Shiftmans pyd and Heathwood containing by estimation forty Acres more or less now in my own occupation lying and being in Cranbrooke aforesaid and part of the premises contained or intended to be contained in the said ffine unto my said loving Wife Anne and to her heirs and Assigns for ever and I do by this my last Will and Testament declare limit and appoint That the said ffine shall as to the said two peices of Woodland with their appurtenances enure and be to the only proper use and behoof of my said Wife Anne and of her Heirs and Assigns for ever and to and for no other use intent or purpose whatsoever And Whereas in and by Indres of Lease and Release bearing date respectively on or about the thirteenth and fourteenth days of this instant Month of Septembr the Release being Tripartite and made or mentioned to be made between me the said Isaac Walter and the said Anne my wife of the first part Ambrose Parker of East Wickham in the said County of Kent Grazier of the second part and David Petty of Wanstead in the County of Essex Gentleman and John Street of Earith in the said county of Kent Yeoman of the third part I have settled and conveyed the Reversion of one full undivided moiety or half part of the aforesaid Messuage wherein I now dwell and of all Barns Stables Outhouses Buildings Yards Gardens Orchards and appurtenances thereto belonging And all those several peices or parcels of land meadow pasture and Wood to the said Messuage or Tenement also belongoing containing in the whole by estimation fifty two Acres (and other part of the premises in the said ffine contained or intended to be contained) lying and being also in Cranbrooke aforesaid with their appurtenances immediately from and after my decease and the decease of my said Wife unto and upon the said Ambrose Parker his Heirs and Assigns for ever (in case the intended Marriage between him and my Daughter Mary should take effect which is now this day consummated between them) Now I do in consideration of the said Marriage so had as aforesaid hereby ratifie and confirm the said Settlement of the said Moyety unto the said Ambrose Parker and to his heirs and Assigns for ever according to the time intent and meaning of the said recited Indenture tripartite And I do by this my last Will and Testament declare limit and appoint That the aforesd ffine as to the said Moiety of the said Messsuage Lands and Hereditaments so settled and conveyed In thesaid Ambrose Parker his Heirs and Assigns for ever as aforesaid shall after the several deaths and deceases of me and my said Wife enure and be The the only proper use and behoof of the said Ambrose Parker and of his heirsand Assigns for ever and to and for none other use intent or purpose whatsoever And I do hereby Will give and bequeath the Reversion and Inheritance of the other undivided Moyety or half part of the said Messuage or Tenement wherein I now dwell and of all other the Lands Tenements hereditaments and premises aforesaid (whereof the one Moiety or half part so mentioned do be settled on the said Ambrose Parker and his Heirs as aforesaid) unto my loving Daughter Martha Walter her Heirs and Assigns for ever from and immediately after the several Deaths or Deceases of me the said Isaac Walter and of Anne my said Wife And I do by this my last Will and Testament declare limit and appoint that the aforesaid ffine as to the said Moyety so given to my said Daughter Martha as aforesaid shall after the several deaths or deceases of me and my said Wife enure and be To the use and behoof of my said daughter Martha and of her Heires and Assigns for ever But if it shall happen that my said daughter Martha shall dye before she shall be married then and in such case I give will and devise the same Moiety or half part so given to my said daughter Martha as aforesaid unto my said Daughter Mary and to her Heirs and Assigns for ever and to and for none other use intent or purpose whatsoever Item I give will and bequeath unto my loving daughter Ann Salmon widow the sume of one hundred pounds to be paid unto her within six months next after my decease by my Executrix out of my personal Estate and ten pounds for mourning to be paid her imediately after my decease Item I give unto my said son in law Ambrose Parker to my said daughter his wife and to my said daughter Martha the sume of ten pounds apeice to buy them mourning Item I give and bequeath unto Mr Thomas Green the sume of ten pounds to buy him mourning if he shall be living with me at the time of my decease and I do hereby Will give and devise all my household goods plate linnen woollen ready monies securities for moneys rings jewells live and dead stock and all other my personall Estate whatsoever and wheresoever and of what nature kind or quality soever unto my said loving wife Anne and to her Executors Administrators and Assigns for ever and I do hereby nominate and appoint my said loving wife Anne and to her Executors Administrators and Assignes for ever and I do hereby nominate and appoint my said loving wife Anne sole Executrix of this my last Will And lastly I do hereby revoke disannul and make void all former and other Wills by me heretofore made and declare this only to be my last Will and Testament In Witness whereof I have to this my Will contained in two sheets of paper sett my hand to the first of the said sheets and to the last have sett my hand my hand and seal this fifteenth day of September in the seventh year of the reign of King George the second and in the year of our Lord one thousand seven hundred and thirty three       Isaac
