The Will of George Wallis

 

This is the last Will and Testament of me George Wallis of Stony Stratford in the County of Buckingham Gentleman which I make and declare as follows I nominate and appoint my son William Talbot Wallis of Shifford in the County of Oxford Farmer and my son in law Thomas Knighton of Stony Stratford aforesaid Gentleman Executors of this my Will And I give and bequeath to the said Thomas Knighton the sum of one hundred pounds as an acknowledgement for the trouble he may have in the execution of the trusts of this my Will I give and devise unto my dear wife Leah Anna Wallis the messuage or dwellinghouse and premises with the appurtenances wherein I now dwell situate standing and being in Stony Stratford aforesaid and all other my real estate whatsoever and wheresoever to hold the same with the appurtenances thereto belonging unto my said dear wife Leah Anna Wallis and her assigns for and during the term of her natural life she my said dear wife and her assigns keeping the same dwellinghouse and all other buildings well and sufficiently insured in some good office or Company against injury by fire and from and immediately after her decease I give and devise the same hereditaments and premises unto and to the use of my said son William Talbot Wallis his heirs and assigns for ever I give and bequeath unto my grandson William Godfrey the legacy or sum of ten pounds ten shillings And I give and bequeath unto Joseph Pickering the former husband of my late daughter Temperance Wallis deceased now residing in London the legacy or sum of fifty pounds I declare and direct that my said dear wife Leah Anna Wallis shall have the use of all my household goods and furniture, plate linen and china being in or about my said dwellinghouse and premises at Stony Stratford aforesaid during the term of her natural life and from and immediately after her decease I give and bequeath the same household goods and furniture plate linen and china unto my said son William Talbot Wallis and my daughter Catherine Knighton the wife of the said Thomas Knighton to and for their own absolute use and benefit to be equally divided between them share and share alike as tenants in common I give and bequeath all my moneys and securities for money debts stocks funds and securities and all and singular other my goods chattels Personal estate and effects whatsoever and wheresoever (subject to the payment of my just debts funeral and testamentary expences which I direct in the first place to be thereout fully paid and satisfied) unto the said William Talbot Wallis and Thomas Knighton their executors and administrators upon trust that they the said William Talbot Wallis and Thomas Knighton or the survivor of them or the executors or administrators of such survivor do and shall lay out and invest the same in their or his names or name or continue the same invested in or upon any of the Public stocks or funds of Great Britain or at interest on Government or real securities in England with power to vary and alter the securities in or upon which the same trust moneys shall be invested for others of a like nature as occasion shall require and do and shall pay the interest dividends and annual produce of the said trust moneys stocks funds and securities unto my said dear wife Leah Anna Wallis during her natural life to and for her own absolute use and benefit and from and after the decease of my said dear wife do and shall stand possessed of the said trust moneys stocks funds and securities upon trust as to one moiety or equal half part thereof for all and every my grandchild and grandchildren being the children of my said son William Talbot Wallis (except my grandson William Talbot Wallis for whom I have already made provision) who shall be living at the time of the decease of my said dear wife to be equally divided between such grandchildren if more than one share and share alike as tenants in common and to be paid to them respectively on their respectively attaining the age of twenty one years the interest in the meantime of their respective shares to be paid and applied to and for their respective maintenance and support and if but one such grandchild then upon trust for such grandchild with like power to apply the interest thereof for his or her maintenance and support during his or her minority And as to the remaining moiety or equal half part of the said trust moneys stocks funds and securities upon trust for all and every my grandchild or grandchildren being the children of my said daughter Catherine Knighton (except my grandson George Wallis Knighton for whom also I have already made provision) who shall be living at the decease of my said dear wife to be equally divided between such grandchildren if more than one as tenants in common and to be paid to them respectively on their respectively attaining the age of twenty one years the interest in the meantime of their respective shares to be paid and applied to and for their respective maintenance and support and if but one grandchild then upon trust for such one grandchild with like power to apply the interest thereof for his or her maintenance and support during his or her minority I give and devise all such messuages lands tenements hereditaments and real estate whatsoever which at the time of my decease I shall be seized or possessed of entitled to or interested in by way of mortgage or in trust unto the said William Talbot Wallis and Thomas Knighton their heirs executors administrators and assigns according to the nature and quality of such estates respectively .. upon the trusts and under and subject to the powers provisoes and conditions which shall be then subsisting in or upon such estates respectively provided also and I do hereby declare that it shall and may be lawful for my said trustees by and out of my said personal estate to retain to and reimburse themselves all costs and expences which they may sustain in or about the execution of this my Will and also that they and their respective executors and administrators shall be chargeable only for their own respective receipts payments acts and wilful defaults and shall not be charged or chargeable with or for any sum or sums of money other than such as shall actually and respectively come to their hands nor for involuntary losses And lastly hereby revoking all former wills by me at any time made I declare this only to be my last Will and Testament  In witness whereof I the said George Wallis, the testator have to each sheet of this my Will contained on three sheets of paper set my hand this twenty fifth day of January in the year of our Lord one thousand eight hundred and forty four _____  George Wallis  _________ Signed and declared by the said George Wallis the testator as and for his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other and at the same time have hereunto subscribed our names as witnesses

Proved at London the 19th August 1848 before the Worshipful Robert Joseph Phillimore Doctor of Laws and Surrogate by the oaths of William Talbot Wallis the son and Thomas Knighton the executors to whom admon was granted having been first sworn only to administer.
