The Will of Thomas Cornish Vicary

 

I Thomas Cornish Vicary of Great Torrington in the County of Devon Surgeon do make and ordain this my last Will and Testament I give unto my son William Newell Vicary his heirs and assigns all that my close of land lying in School Lane in Great Torrington aforesaid called Culverhay Meadow immediately after my death I likewise give unto the said William Newell Vicary the sum of one thousand pounds sterling to be paid.....at the end of one year next after my decease by my executors herein after named I likewise give unto  my daughter Margaret Grace  Braginton late Cotton the sum of five hundred pounds sterling to be paid to her at the death of her mother by my said executors these bequests to the said William Newell and Margaret Grace being as some sort of equivalent for or balance to the property of my equally beloved son Thomas Merrill who dying and his brother William succeeding to his estates I will the thousand pounds given to be revoked and the said sum of one thousand pounds be carried to the general purpose of the divisions as hereinafter mentioned all my other Property of whatsoever nature or quality I give and bequeath to my two sons Thomas Merrill Vicary and William Newell Vicary and my son in law George Braginton In trust nevertheless for the sole use and benefit of my dear Wife Margaret Vicary independent of and free from the control of any future husband during her life and after her death the said property is to be divided as nearly as possible into three equal parts except as in the case of my eldest son dying or... either of my three children dying without issue then into two equal parts one of which equal three parts I give to the said Thomas Merrill Vicary one other of which equal three parts I give to William Newell Vicary and the other third part of equal vlue I give to the said Thomas Merrill Vicary and the said William Newell Vicary In Trust nevertheless to and for the sole use and benefit of their sister now the wife of the said George Braginton free from all interference and controul of her said husband and I appoint my sons the said Thomas Merrill Vicary and the said William Newell Vicary and my son in Law the said George Braginton Executors of this my last Will and Testament In Witness whereof I have hereunto set my hand and seal the twenty ninth day of  May one thousand eight hundred and thirty six Thos C Vicary
