This is the last Will and Testament of me Joseph Trendall late of Whetstone in the County of Middlesex Baker and now of Ashford Street Hoxton in the said County I direct that my Funeral and other expences incidental thereto shall not exceed the sum of fifty pounds I give and bequeath all my Household ffurniture unto and equally between my Daughters Elizabeth Trendall and Ann Trendall I give and bequeath unto my said Daughter Elizabeth Trendall the Legacy or Sum of fifty pounds given to me by the Will of my Brother Thomas Trendall late of Chipping Norton in the County of Oxford deceased and payable on the decease of his widow I give and bequeath unto my Son Robert Trendall of Whetstone aforesaid Baker and Thomas Bartlett of Henry Street Pentonville in the said County of Middlesex Gentleman their executors or administrators my Leasehold House and Premises situate and being Numbered 2 in Hamilton Row Battle Bridge Also my two Leasehold Houses and Premises situate and being respectively numbered 6 and 7 Shepperton Place New North Road Islington And also all the Rest residue and Remainder of my Personal Estate and Effects whatsoever and wheresoever over and in respect of which I have a power of disposition and not herein otherwise disposed of Upon the Trusts and for the ends intents and purposes following (that is to say) As to my said Leasehold House and Premises numbered 2 in Hamilton Row aforesaid Upon Trust to assign and transfer the same unto my said Daughter Ann Trendall when and so soon as she shall attain the age of twenty one years subject to six Guineas per Annum Ground Rent together with the clear rents and profits I direct my said Trustees or the survivor of them or the executors or administrators of such survivor to invest from time to time when and as they shall be received in the purchase of three pounds per centum Consolidated Bank Annuities for the benefit of my said Daughter Ann Trendall And as to my said Leasehold House and Premises numbered 7 in Hamilton Row aforesaid Upon Trust to grant and execute a Lease thereof unto my Daughter Sarah Trendall when and so soon as she shall attain the age of twenty one years for all my term therein then to come and unexpired wanting one day with all the benefit of renewal to which I am entitled therein and thereto subject to the yearly rent of sixteen pounds reserved in and by the Lease under which I hold the same Premises with the said House and Premises Numbered 6 in the New North Road aforesaid and two other Houses and Premises such Lease to contain all such Covenants Clauses Provisos and Agreements as I am subject to so far as the same concern or relate to the said House and Premises Numbered 7 in the New North Road aforesaid and as to the clear rents and Profits thereof in the mean time and until such Lease shall be granted after retaining thereout four pounds per Annum towards payment of the said yearly rent of sixteen pounds I direct my said Trustees or the survivor of them or the executors or administrators of such survivor to invest the same from time to time in the purchase of three pounds per centum Consolidated Bank Annuities for the benefit of my said Daughter Sarah Trendall to be paid or transferred to her when the Lease hereinbefore directed to be granted shall be executed And as to my said Leasehold House and Premises Numbered 6 in the New North Road aforesaid Upon Trust to grant and execute a Lease thereof unto my Daughter Kitty Trendall where and so soon as she shall attain the age of twenty one years for all my term therein yet to come wanting one day with all the benefit of renewal to which I am entitled and thereto subject to the like yearly rent of four pounds per Annum towards payment of the said yearly rent of sixteen pounds I direct my said Trustees or the survivor of them or the executors or administrators of such survivor to invest from time to time in the purchase of three pounds per Centum Consolidated Bank Annuities for the benefit of my said Daughter Kitty Trendall to be paid or transferred to her when the Lease hereinbefore directed to be granted to her shall be executed And I direct the expences attending the granting of the said two Leases so hereinbefore directed to be executed as aforesaid shall be paid out of the general residue of my Estate and Effects and as to all the said general Residue of my Personal Estate and Effects Upon Trust to pay and divide the same share and share alike among my two Children hereinafter named that is to say Elizabeth Trendall and Joseph Trendall in case they shall both be living at the time of my decease but in case only one of them shall be then living upon Trust for such one of them wholly with all annullations thereof respectively to be paid assigned and transferred to them respectively when and as they shall respectively attain his or her age or respective ages of twenty one years and I nominate constitute and appoint the said Robert Trendall of Whetstone aforesaid and Thomas Bartlett Executors of this my Will And it is my Will and I hereby declare it shall be lawful for my said Trustees for the time being of this my Will during the minorities or minority of my said Children taking a beneficial interest under this my Will to apply the whole or such part of the said rents interest dividends and annual proceeds of their respective Legacies and shares in and towards his her or their respective maintenance and education as they my said Trustees shall think most expedient And it is my wish and desire that each of my Executors accept a mourning ring And I do declare that if any Trustee or Trustees acting under this my Will shall depart this life or shall neglect or refuse or become incapable to act in the Trusts thereof Then and in such case it shall be lawful for the acting and continuing Trustees or Trustee or the Executors or Administrators of the last acting Trustee to nominate and appoint a new Trustee or Trustees in place or stead of the Trustee or Trustees so dying neglecting refusing or becoming incapable as aforesaid and that thereupon the said Trust Estates and Premises shall be assigned so as the same shall vest in the new Trustees or Trustee jointly with the...surviving or acting Trustee or solely as the case may require and that every Trustee so appointed shall have all such and the same powers as if he had been named a Trustee in this my Will And that such Trustee acting under this my Will may reimburse himself out of the monies that may come to his hands under the Trusts aforesaid all costs and expences incurred by him in and about the same And I declare that each Trustee shall only be answerable and accountable for his or her own acts and not for the acts or defaults of his or her Co Trustee And I hereby revoke all former Wills by me made In Witness whereof I have to this my last Will contained in three sheets of paper set my hand and to this third and last sheet thereof set my hand and affixed my seal this thirtieth day of October in the year of our Lord one thousand eight hundred and thirty seven Jos Trendall
