The Will of Henry Trendall

 

This is the last Will and Testament of me Henry Trendall of Reading in the County of Berks Perfumer I give devise and bequeath unto my nephew James Ball of Reading aforesaid Builder and my wife Hannah Trendall All these my two freehold messuages or tenements garden warehouse hereditaments and premises situate lying and being 18 and 19 Minster Street Reading aforesaid now in the several tenures or occupations of myself and Charlotte Pearton together with the fixtures in and about the same usually denominated landlords fixtures I give and bequeath unto the said James Ball and my said Wife All those my nine Gas Shares in the Old Reading Gas Company To hold the said messuages or tenements Gas shares and premises with their respective rights members and appurtenances unto the said James Ball and my said Wife their heirs administrators and assigns Upon Trust that they the said James Ball and my said wife or the survivor of them do and shall as soon as conveniently may be after my decease make sale and absolutely dispose of my said messuages or tenements and hereditaments and Gas shares in such manner and either by public sale or private contract as they the said James Ball and my said Wife shall think proper (subject as to the said messuages or tenements and hereditaments to the proviso hereinafter contained) and do and shall convey assure assign and make over the same unto the purchaser or purchasers thereof his her or their heirs executors administrators and assigns or as he she or they shall direct or appoint do and shall stand and be possessed of the money therefrom arising upon trust in the first place to pay and discharge all my just debts funeral and testamentary expences and the costs attendant upon or incident to the trusts of this my Will or in anywise relating thereto Then to pay the several legacies or sums of money following (that is to say) To the children of my son James Trendall viz Eliza, Louisa and Charlotte, the wife of Martin Hope Sutton the sum of ten pounds each To the children of my son Harry Trendall viz. Hannah Edwards, Elizabeth and Henry the like sum of Ten pounds each To Ann Elliott wife of Charles Elliott of Newbury Berks Builder the sum of Ten pounds to be paid into her own hands and her receipt alone notwithstanding her coverture to be discharged for the same and to him the said James Ball for the trouble he may have in the execution of this my will the sum of five pounds all which legacies or sums of money I hereby give and bequeath to the said several legatees accordingly And upon Trust to pay and divide the residue of such purchase monies unto and equally between my said sons James Trendell and Henry Trendell and my said Wife share and share alike Provided nevertheless and it is my will that if I shall depart this life having a child or children by my present wife or born in due time afterwards then and in such case I hereby revoke the bequest of the residue of the last mentioned purchase monies and....of the shares so given to my said two sons I give and bequeath to them the sum of Ten pounds each And I direct that the surplus of such residue shall be laid out in the names of the said James Ball and my said Wife in or upon Government real or other good and sufficient security (with power to them to vary or alter the securities at their discretion) Upon trust to pay or otherwise authorise and empower my said wife to receive and take the interest dividends and annual produce thereof for her own use for her life and after her decease I give and bequeath such residuary property unto such child or children of me the said Henry Trendall by my said present wife who may be living at my decease or born in due time afterwards if more than one share and share alike to be paid applied and disposed of by the said James Ball or the trustee or trustees for the time being of this my Will for the benefit of such children notwithstanding his her or their minority respectively so nevertheless that the sum to be applied for the benefit of each Child shall not exceed his her or their presumptive share and if all and every such child or children shall depart this life under the age of twenty one years then I give and bequeath what may remain undisposed of and unapplied of the said trust monies unto my said two sons James and Henry equally share and share alike I give and bequeath unto my said son James Trendall a large silver Gravy spoon marked G.E. of Sep 4 1809 one pair of silver Tablespoons a silver punch ladle and my Family Bible by Timothy Priestley I give and bequeath unto my said son Henry Trendell the other large silver gravy spoon one pair of silver table spoons and the other silver Punch Ladle And as to my two freehold messuages or tenements and premises situate in Lavender Street in the Parish of St Mary Reading aforesaid and all and singular my household goods and furniture plate linen china books stock in trade book and other debts money and securities for money All the rest residue and remainder of my property estate and effects whatsoever and wheresoever of which I may die seized possessed or in any way or manner entitled I give devise and bequeath the same and every part and every part and parcel thereof unto my said Wife Hannah Trendall To hold the same unto her my said Wife her heirs executors administrators and assigns according to the nature or quality of the same estates and property to and for her and their own use and benefit absolutely for ever Provided always and it is my will that if my said son James Trendall shall be desirous of purchasing my said messuages or tenements and premises before given In trust to be sold I hereby give him the option of so doing at such price or sum of money as shall be thereon fixed by the said James Ball and my said Wife Or by two competent persons one to be named by the said James Ball and my said Wife, and the other by my said son James or the umpire of such referees provided my said son James shall declare his desire within one month next after my decease and in that case I direct that upon payment of the purchase money by my said son James the said messuages or tenements and premises shall be conveyed assured and made over to him his heirs and assigns or as he or they may direct But if my said son James shall decline such purchase or not declare his desire within the time aforesaid then I give the same option of purchase in respect as before contained to my said other son Henry provided he shall declare this desire within two calendar months next after my decease And it is my will that all and every receipt or receipts which shall be made or given by my said trustees for the money to arise from the sale of my said messuages or tenements and premises or for any other monies payable to them by virtue of this my will shall be a good and sufficient release acqittance and discharge good and sufficient releases acqittances and discharges for all and every sum and sums of money which in such receipt or receipts shall be expressed or acknowledged to be or to have been received and that all and every person and persons paying them any monies and taking their or either of their receipts for the same shall not afterwards be obliged or required to see to the further application of the same monies nor be answerable or accountable for misappropriation or nonapplication of the same or any part thereof And it is my wish that if the said James Ball shall die or decline to act in the trusts of this my will I hereby authorise and empower my said wife if living or her executors or administrators if dead to appoint some other person or persons to be a trustee or trustees in his room or stead and thereupon the trust property and premises shall be conveyed assigned and legally made over unto such new trustee or trustees in such and the same manner and to all intents and purposes as if such new trustee or trustees had been originally in and by this my will appointed a trustee or trustees And I declare that my said trustees and those for the time being shall not be answerable for more money than he she or they shall actually receive or shall come to their respective hands by virtue hereof Nor shall one of them be answerable for the acts or defaults of the other of them save for joining in any receipt for conformity Nor for involuntary losses And that they shall and may deduct and retain to themselves and allow to each other all costs and expences they may respectively be put to by virtue of the trusts hereby reposed in themor in relation thereto And lastly I hereby nominate constitute and appoint the said James Ball and my said Wife Hannah Trendell Executor and Executrix of this my will hereby revoking all former and other Wills be me at any time heretofore by me made do declare this and this only to be my true last Will and Testament In witness whereof I have set my hand and seal this twenty sixth day of May in the year of our Lord one thousand eight hundred and forty five Henry
