The Will of James Travis

 

This is the last will and testament of me James Travis of Whittaker in the Parish of Rochdale in the County of Lancaster which I make and publish in perfect sound memory and understanding in manner and form following that is to say that first I will order and direct that all my just debts and funeral expenses and the charges of this my will and conveying the same into effect be in the first place paid by my executors hereinto the Monies by virtue of this my will Then I give devine and bequeath unto my daughter Ann Travis all the messauge Dwelling house in which I now Dwell with the app…….. thereunto belonging during the time of her natural life and after her decease to her lawful issue provided that in case of the decease of my said daughter Ann without leaving lawful issue then I give devise and bequeath the same unto and amongst my children herein after mentioned which may be then living equally share alike - also I give and bequeath unto my said daughter Ann the sum of twenty pounds and also all my household furniture goods looms working, utensils and linen – Also I give and bequeath unto my daughter Mary the wife of Charles Greenwood the sum of thirty five pounds. Also to my daughter Sarah wife of Eli Greenwood the sum of fortyfive pounds. Also to my daughter Dorothy the wife of William Baron the sum of fortyfive pounds. Also to my daughter Betty otherwise Elizabeth wife of Benjamin Travis the sum of thirtyfive pounds. Also to my son James Travis the sum of forty pounds. Also to my son Henry Travis the sum of forty five pounds and to my son John Travis the sum of thirty five pounds – All then respectively paid to them by my Executives hereunder named at the Expiration of six months happening after my decease. As to all the residue and remainder of my Estate and Effects not hence before by me otherwise desposed of. I give and bequeath the same unto and amongst all my said children at the time of my Decease equally share alike to be paid and divided amongst them at the time the other Legacies hence before bequeathed amongst them to be paid.
Lastly I direct that if any of my children shall be dissatisfied and disagree with each other pertaining their legacies to them he, she, thereof being so dissatisfied and arguing shall only have one shilling in lieu though – in such case his her or them shall have unto and be considered as part of my testimony and effects and go as hereby directed equally amongst the other of them. And I nominate and appoint my friend Samuel Lomax of Rochdale, Merchant, my said son Henry and my said daughter Ann as Executors and Execution of this my will hereby revoking any former will herein to fore by me made and so constitute this my last will in writing whereof I have to this my will consisting of two sheets of paper and to the first here subscribed my name and to this last subscribed my name and affixed my seal this first day of September in the year of our Lord one thousand eight hundred and three.
Signed, sealed and delivered by the … testator James Travis for his last will and testament who at his bequeath and in his presence and in the presence of each other have subscribed our names as witnesses here to the intestinnation appearing beforehand the first and second lines and the second and third lines from the top hereof and our intestination being made as to the Date of the will being first done.
