The Will of Thomas Townsend
The last Will and Testament of me Thomas Townsend of Aston in the parish of Bampton in the County of Oxford Yeoman as follows First I order and direct that all my just debts and funeral expenses shall be paid and discharged by my Executrix hereinafter named within one year next after my decease or sooner if convenient to her And I give devise and bequeath unto my loving wife Elizabeth (late Elizabeth Lindsey spinster) all that one quarter of a Yard of free land and one half yard land of leasehold land situate lying and being in the common fields of Aston aforesaid and Coate in the said parish of Bampton (and which said leasehold land is held by lease thereof granted by Thomas Horde Esquire to Humphrey Lindsey deceased the late father of my said wife) to hold the same unto my said wife her heirs executors administrators and assigns as fully as I have power to dispose of the same And I give devise and bequeath unto my brother John Townsend of Aston aforesaid Yeoman and to Edward Lindsey of Coate aforesaid Yeoman all and every other my freehold leasehold and other my Estates and Estate messuages lands and tenements whatsoever and wheresoever to hold the same and every part thereof unto the said John Townsend and Edward Lindsey their heirs executors administrators and assigns upon the trusts hereinafter mentioned (that is to say) upon trust that they the said John Townsend and Edward Lindsey and the survivor of them and the heirs executors and administrators of such survivor do and shall permit and suffer her my said wife and her assigns to have hold occupy and enjoy or to have receive and take to and for her and their own use and benefit all the rents issues and profits thereof and of every part thereof for and during the term of her natural life and from and immediately after her decease I give devise and bequeath unto my nephew John Townsend of Aston aforesaid Baker (the eldest son of the beforenamed John Townsend) all those ten acres of freehold land called Johnsons lying in Bampton field and in Weald in the parish of Bampton aforesaid with the meadow ground and commons thereunto belonging to hold the same and every part thereof with the appurtenances unto him my said nephew John Townsend his heirs and assigns for ever Also I give and bequeath unto my said nephew John Townsend thirty pounds of lawful money of Great Britain to be paid to him by my Executrix in twelve months next after my decease Also I give devise and bequeath unto my nephew Robert Townsend of Aston aforesaid Yeoman (another son of my said brother John Townsend) all that one half yard (of leasehold) land called Coldreys situate lying and being in the common fields of Aston aforesaid to hold the same unto the said Robert Townsend his executors administrators and assigns (from and immediately after the decease of my said wife) for all the remainder of the term or terms therein then to come and unexpired and as fully as I have power to dispose of the same I also give devise and bequeath unto my nephew William Townsend (another son of my said brother John Townsend) all that one quarter of a yard land called Darts held by leases from the said Thomas Horde Esquire and situate lying and being in the common fields of Aston aforesaid to hold the said quarter of a yard land last mentioned unto my said nephew William Townsend his executors administrators and assigns (from and immediately after the decease of my said wife) as fully as I have power to dispose of the same Also I give devise and bequeath unto my said two nephews Robert Townsend and William Townsend all that half yard land situate in Aston and Coate aforesaid or one of them held also by lease from the said Thomas Horde Esquire for ninety nine years (determinable on the decease of me the said Thomas Townsend and of Richard Townsend (son of John Townsend late of Aston aforesaid Yeoman deceased) and all my estate and interest therein Also I give devise and bequeath unto my nephew Richard Townsend (another son of my said brother John Townsend) and to his heirs and assigns for ever all that one quarter of a yard of free land situate lying and being in the common fields of Aston aforesaid (and which was devised to me by the Will of my late father Thomas Townsend deceased) Also I give and bequeath to the Richard Townsend (last named) thirty pounds of lawful money of Great Britain to be paid to him by my Executrix in twelve months next after my decease Also I give devise and bequeath unto my nephew Thomas Townsend (the youngest son of my said brother John Townsend) all that messuage or tenement and premises wherein I now live with the outhouses an half yard land and all other the lands and premises thereto belonging (which said messuage or tenement half yard lands and premises last mentioned are held by lease from the said Thos Horde Esq) to hold the same unto my said nephew Thomas Townsend his Executors Administrators and Assigns as fully as I power to dispose of the same And I give and bequeath to my cousin the said Richard Townsend of Aston aforesaid son of my late uncle John Townsend deceased one hundred pounds of lawful money of Great Britain to be paid to him by my Executrix hereinafter named within twelve months next after my decease or to be by her remitted and forgiven him out of the money he now owes me on Bond (if it shall then remain unpaid) And I nominate and appoint my said wife sole Executrix of this my Will and give her all the residue of my estate not before disposed of
