This is the last Will
and Testament of me John Townsend of Bampton in the County of
Oxford Yeoman made this Eighteenth day of January One thousand
eight hundred and thirty one In the first place I direct all my
just debts funeral and testamentary expenses to be paid by my
Executors hereinafter named out of my personal Estate I give
and devise unto my wife All that my Messuage or Tenement wherein
I now dwell with its appurtenances situate in Broad Street in
Bampton aforesaid To hold to my said wife and her assigns during
her widowhood And after her decease or future marriage
whichever shall first happen I give and devise the same Messuage
or Tenement and premises with their appurtenances unto my son
Thomas Townsend his heirs and assigns for ever Subject
nevertheless and chargeable with the sum of fifty pounds which I
give to my son John to be paid him within six calendar months
after the decease or future marriage of my said wife provided he
shall then have attained twenty one years of age but if he
should be a minor at the time his said legacy become payable
Then I direct my trustees hereinafter named to receive the same
of my said son Thomas and apply it for the benefit of my said
son John until the age of twenty one I give and bequeath All
and singular my household furniture goods chattels effects and
personal estate not consisting of money or securities for money
unto my brother Thomas Townsend of Bampton aforesaid Farmer and
Stephen Hudson of the same place Gentleman Upon trust to permit
and suffer my said wife to occupy and enjoy the same during her
widowhood And upon her decease or future marriage which shall
first happen I give the same goods and personal Estate unto and
equally between my said sons As to all my money and securities
for money book debts and otherwise of a pecuniary nature I give
the same unto my said Trustees Upon trust to invest the same on
good and sufficient security and pay the interest money to my
wife during her widowhood (Subject nevertheless to the proviso
hereinafter mentioned.) And at her death or future marriage
whichever shall first happen I give and bequeath the same unto
and equally between my said sons to be paid them at twenty one
but if they should be minors at the time their shares may
eventually become payable my said trustees to apply the interest
for their mutual benefit in the meantime Provided always and I
hereby authorise my said trustees if in their discretion they
may think proper but not otherwise to pay to each of my said
sons the sum of fifty pounds at such time or times and in one or
more sums or in such portions as they shall see fit at any time
during the widowhood of my said wife for their advancement or
benefit And provided always that it shall be lawful for my said
Trustees to pay any sum not exceeding thirty pounds for
apprenticing my son John or otherwise for his benefit in life
and such sum shall not be considered in the nature of an
advancement out of his share nor shall he at any time account
for the same as I have already been at the expence of
apprenticing my son Thomas and I naturally wish to do the same
with his Brother And provided also that if my said wife should
at any time marry again Then I give her the sum of fifty pounds
and from thenceforth she shall be no longer entitled to any
right or interest whatsoever in my property real or personal and
which sum I give her in full bar and satisfaction for her dower
or thirds at Common Law which she would be entitled to in the
said house and premises And I authorise my said Trustees their
executors and administrators to pay my son John's Legacy of
Fifty Pounds which I have charged and secured on my said house
and premises out of my son Thomas's share of my Residuary
Estate I appoint the said Thomas Townsend and Stephen Hudson
joint Executors of this my Will and direct that the one of them
shall not be answerable or accountable in any manner for the
acts receipts or defaults of the other of them notwithstanding
he or they may join in signing or giving any receipt or
otherwise for conformity sake but that each shall be answerable
and accountable for his own acts deeds receipts neglects and
defaults And I will and direct that my said Trustees and
Executors shall deduct and retain to themselves and himself all
costs charges and expences to be incurred in and about the
execution of this my Will In Witness whereof I have to this my
last Will and Testament contained in two sheets of paper set my
hand and seal to wit my hand to the preceding sheet and my hand
and seal to this last sheet the day and year first before
written John Townsend
The writing contained
in this and the preceding sheet of paper was signed sealed
published and declared by the above named Testator as and for
his last Will and Testament in the presence of us who at his
request in his presence and in the presence of each other
hereunto subscribe our names as witnesses William Williams
James Rose Solr Bampton James Ward
This Will was proved at
Oxford on the tenth day of August in the year of our Lord 1831
Before the Judge By the Oaths of Thomas Townsend and Stephen
Hudson The Executors therein named to whom Administration was
granted being first sworn (by Commission) duly to administer.
