The Will of Robert Toop - Born 5th Jan 1825

 

THIS IS THE LAST WILL AND TESTAMENT of me ROBERT TOOP of No 12 Westover Road in the county borough of Bournemouth Gentleman I appoint my cousin Robert Scutt of No 5 Alington Road in the said county borough of Bournemouth Solicitors Managing Clerk my nephew Robert Toop of No 381 Romford Road Forest Gate in the county of London Engineer and Alfred Taylor (the husband of my niece Mami Taylor) of Nithsdale 114 Station Road Whealdstone in the county of Middlesex Photographer (who and the survivors or survivor of them are hereinafter referred to as my trustees) to be the EXECUTORS and trustees of this my will I bequeath the following pecuniary legacies free of duty videlicit To my late wife’s niece Florence Squelch fifty pounds to my late wife’s sister Maria Squelch ten pounds to my late wife’s nieces Elizabeth Godfrey and Mary Ann Cortnage ten pounds each to Augusta Mundy my housekeeper if she shall be in my employment at the time of my decease ten pounds to my great niece Amelia (Millie) Dawes forty pounds to each of them the said Robert Scutt and my nephew Robert Toop and the said Alfred Taylor who shall prove this my will the sum of twenty pounds for his trouble in executing the trusts of this my will and I devise and bequeath all my real and personal estate unto my trustees upon trust to sell such parts thereof as shall be of a saleable nature and to convert and get in the residue thereof and out of the proceeds to arise therefrom to pay my just debts funeral and testamentary expenses and the estate duty and the legacies hereinbefore bequeathed and the legacy duty thereon the cost of erecting a tombstone in the Wimborne Road Cemetery Bournemouth to the memory of my late wife my late sister Ann Coates and myself at the cost of about ten pounds or more if my trustees think necessary and also to cause an inscription to be placed on the tablet in the Trent Church Somerset erected to the memory of my late parents and others that such tablet was erected by me And I direct my trustee to divide the residue of the proceeds to arise as aforesaid into sixteen parts And to pay one sixteenth part to each of my nephews and nieces following videlicit Frank Toop Henry Robert Toop William John Toop William Coates Toop Maria Goode Louisa Barrett and Charlotte_ (the children of my late brother Francis Hart Toop) and the said Robert Toop Mami Taylor and Clara Toop (children of my late brother Charles Toop) and Elizabeth French (daughter of my late brother George Hart Toop) and also my sister in law Ellen Toop the widow of my said brother Charles Toop and to pay one half part of one other sixteenth part unto my nephew Charles Toop (son of the said Francis Hart Toop) and to divide the remaining half part of such sixteenth part unto and equally between the children of the said Charles Toop as shall be living at my decease And to pay one half part of one other sixteenth part unto my niece Rachel Miller (daughter of the said Francis Hart Toop) and to divide the remaining half part of such sixteenth part unto and equally between the children of the said Rachel Miller as shall be living at my decease and to pay one half part of another sixteenth part unto my niece Annie Turner (daughter of the said Francis Hart Toop) and to divide the remaining half part of such sixteenth part unto and equally between the children of the said Annie Turner as shall be living at my decease And I direct my trustees to stand possessed of the remaining sixteenth part of my said estate Upon trust to invest the same and to apply the income arising therefrom and so much of the capital as they in their absolute discretion shall think desirable in or towards the education support benefit of advancement in life of the children of my late nephew George Toop son of my late brother George Hart Toop and as each of such children shall attain the age of twenty one years to pay to each such child his share of such sixteenth share and interest after deducting the sums so advanced to him her or them respectively as aforesaid And I declare that in the event of the death in my lifetime of either one or more of the said children of my said brother Francis Hart Toop then that the share or benefit to which such child or children of the said Francis Hart Toop would have taken in or from my estate under this my will if such child or children had survived me shall be divided between such of her or their respective children as shall survive me and I also declare that in the event of the said Elizabeth French predeceasing me that the share or benefit in my said estate which she would have taken under this my will if she had survived me shall be divided equally between the before named legatees viz Charles Toop Frank Toop Henry Robert Toop William John Toop William Coates Toop Maria Goode Rachel Miller Louisa Barrett Anne Turner and Charlotte_ (children of my late brother Francis Hart Toop) and Robert Toop Mami Taylor and Clara Toop Elizabeth French and Ellen Toop or such of them as shall be living at my decease And I also declare that in the event of the death in my lifetime of the said Ellen Toop that the share or benefit in my said Estate that she would have taken under this my will if she had survived me shall be divided between her children the said Robert Toop Mami Taylor and Clara Toop or such of them as shall survive me And I declare that in the event of the death in my lifetime of the said last named Robert Toop Mami Taylor and Clara Toop or any one or more of them leaving a child or children that the share or benefit in my said estate which he she or they would have taken under this my will if he she or they had survived me shall be divided equally between his her or their respective children but in the event of either one or more of them dying in my lifetime without leaving a child or children then that the share or benefit of such one or more of them dying childless shall be divided between such of them the said Robert Toop Mami Taylor and Clara Toop as shall survive me And I also direct and declare that my trustees may invest money which they may have to invest under this my will upon mortgage or freehold securities in addition to the other securities upon which trustees are authorised to invest money upon And I direct that Messrs Preston & Francis  of Bank Chambers Yelverton Road in the county Borough of Bournemouth shall be the Solicitors to my estate IN WITNESS whereof I have hereunder set my hand this nineteenth day of February one thousand nine hundred and twelve  -  ROBERT TOOP presences of each other have hereunto subscribed our names as witnesses  -

            ON the 26th day of November 1914 Probate of this will was granted to Robert Toop and Alfred Irvine Taylor the surviving executors
