The Will of Robert Tinker

 

WILL OF ROBERT TINKER of New Windsor, Berkshire

Dated 23 Jan 1622/23, Codicil 26 May 1624, Died ca 31 May 1624

 

In the name of god, amen.  I Robert Tyncker of New Windsor in the County of Berk Mercer, beinge at this psent [present] tyme in resonable health of body, but thanks thanks [sic] be given to to [sic] Almighty god of sound and pfect [perfect] minde & remembrance, Doe devise, ordayne & make this my last will & testament in manner & forme followinge (that is to say) And first and principally I commend & committ my soule into the hands of Almightie god, my Maker, hopinge & assuredly beleevinge, that by & beinge the onely meritte death, and passion of Jesus Christ his sonne my onely Redeemer & Saviour to have pdon [pardon] and forgiveness of all my sinnes, and to be saved.  My body I remitt to the earth from whence it came to be buried in Xian [Christian] buriall, where it shall please god to appoint for mee, at the discretion of my executrix hereafter in this my Will named.  And as touchinge such lands tenemts [tenements], hereditaments goods chattells & substances as it hath pleased god to endue mee wthall I doe give will devise & bequeath the same in manner & forme followinge (that is to saye) And first for the more better assureinge of all that my ffree hould new-built messuage, or tenemt sett & beinge in Burneham in the county of Burk, wth the grounds, orchards, and apptenances [appurtenances] thereto belonginge as the same is ymployed & in the tenure of one Sara Phipp unto my sonne Thomas Tinker & Anne his now wife according to the true, meaning of a deede, heretofore by me made to that purpose I doe hereby give will devise & bequeath the same new built messuage or tenemt with the appurtenances unto the said Thomas & Anne To have and to houlde the same unto the said Thomas and Anne, for & duringe their naturall lives & the longer lives of either of them And after their decease, then unto the heires of the said Thomas, on the body of the said Anne begotten  And for defaulte of suche yssue, then to the right heires of me the said Robert, for ever.  Item I doe give & bequeath unto my welbeloved wiffe Mary Tincker, all the rents yssues and profite hereby arisinge & growinge out of my ffreehould messuage, or tenemt and out of the Closes Tanyards, grounds, edifices, buildings or appurtenances scituate lyinge & beinge in Sipnam? in the pish [parish] of Burneham aforesaid nowe beinge in the tenure use or occupation of one Richard Stratforde Tanner, or his assignes To have and to houlde the said rents yssues, and profitts unto the said Mary my nowe wife for & duringe her naturall life yf shee shall soe longe continue a widowe.  The inheritannce of all wch said messuage or tenemt, closes Tanne yards, grounds edifices & buildings with the appurtenances after my said wives decease or widdowes estate I doe give will, devise & bequeath the same unto my welbeloved sonne Robte Tincker his heires & assignes for ever.  Item I doe give will, devise & bequeath unto my said lovinge wife, all the rents yssues, & profitts yearely arisinge yssueingne & growinge forth & out out [sic] of all yt [that] messuage or tenemt wch adioyneth [adjoineth] unto the newe built tenemt, before in this my Will mentioned to be bequeathed unto my said sonne Thomas Tyncker, and forth & out of all & singular the grounds & appurtenance thereunto belonginge & appteyninge [appertaining], being nowe in the tenure or occupation of one Mathewe Bartlet-Baker, or his assignes lyinge & beinge in Burnham aforesaid To have & to holde the said rents yssues, & profits of all & singular the said last recited pmisses [premises] unto the said Mary my Wife for & duringe her naturall life yf she shall continue a widdowe the inheritance of all & singular the said last recited tenemt wth th’appurtenance ymediatly after my said wives decease, or widdowes estate I doe give will devise & bequeath the same unto my welbeloved sonne John Tyncker his heires and assignes for ever.  Item I give will devise & bequeath unto the said said [sic] Mary my said lovinge wife, all the rente yssues & profits yearelie arisinge yssueinge and growinge out of that my ffreehold messuage or tenemt with the Orchards, two closes meadowes Lands & appurtenances lyinge & beinge in Wingfeild in the county of Berk aforesaid nowe beinge in the tenure or occupation of one             [sic] Mattheson, or his assignes, To have and to hould the said last mentioned rents, yssues, & profitts unto the said Marye my wife likewise for duringe her naturall life if she shall so continue a widdowe, The inheritance of wch said last mentioned messuage, or tenemt, orchardes, two closes meadowes lands & apptenances after my said wives decease, or widdowes estate I doe give will & devise the same unto my welbeloved daughters Ellen Tincker & Marie Tincker equallie betweene them, & to their heires or assignes forever.  Item I doe give will devise & bequeath more unto the said Mary my nowe wife, all the Rents yssues & profitts arisinge yssueinge & yerely growinge out of all my ffreehold Lands tenements  orchardes edifices, buildings & hereditamts  wth  their & every of their apptenances, set lyinge & beinge in Barkhamstead wth in the county of Herts [Hartfordshire] nowe beinge in the tenure use or occupation of Stephen Stanley or his assignes, To have & to hold the said last recited rents yssues & profitts of the said last recited pmisses [premises] unto the said Mary my wife & her assignes, for & duringe likewise her naturall life, yf she shall continue a widdowe, the inheritance of all wth  said last mentioned land, tenemts , orchards, edifices, buildings & hereditamts  wth  their apptenances, after my said wives decease, or widdowes state, I doe give, will & bequeath unto my Welbeloved daughter Rody [Rhoda] Tincker, her heires or assignes for ever.  Item I doe further will give & bequeath unto the said Mary my nowe welbeloved wife, all the rents yssues and profitts arisinge yssueinge & growinge foorth & out of all that tenemt of myne, beinge freehould, wth  all the Orchards edifices hereditamts  or appurtenances whatsoever nowe at? hand, lyinge & beinge in Heyworth greens, wth in the pishe [parish] of Heyworth wth in the sayde County of Berk nowe beinge the tenure use, or occupation of one                  [sic] Sorings Dollermaker, or his assignes, To have & to houlde the said last mentioned rents yssues & profits unto the said Marie my wife for & duringe her naturall life, if she shall continue & remaine a widdowe.  The inheritance of wch saide last mentioned freehoulde tenement, wth  the orchards edifices, hereditamts  & apptenances whatsoever, I doe give, will & bequeath, after my saide wives decease, or widdowes estate, unto my welbeloved daughter Anne Tyncker her heires & assignes for ever.  Item I doe give will devise & bequeath unto my welbeloved daughter Sara Tyncker the full some [sum] of Twenty pounds of good & lawfull money of England To be paid unto her the said Sara by my said wife at such tyme & wheras she the said Sara shall accomplish her full age of twenty & one yeares, or day of her marriage, wch  of the sd two daies or tymes shall first or nexte happen to come, & be after my decease.  Item I doe further give will & bequeath unto the said Mary my wife, all that my messuage & tenemwth  the apptenances wherein I doe nowe dwell, scituate & beinge in newe Winsor aforesaide To have, and to hold the same unto her, for, and duringe all the terms of yeares wch  I have therein to come by vertue of my Lease wch  I gave of the same, yf she the said Mary my wife shall soelonge live & keepe herself a widdowe.  But if she the said Mary my wife shall happen to dye or departe this mortall life or be married before the end & expiration of the terme of yearse wch I gave in the lease of my said nowe dwellinge house, That then I doe give will & bequeath the said lease, dwellinge howse & terms of yeares wch shalbe to come and [?] unexpired after my said wives decease, or widdowes estate, unto my welbeloved sonne Randall Tyncker his executors administrators & assignes upon condition that he the said Randall Tincker, his executors administrators & assignes shall well and trulie paie or cause to be paide unto the said Sara my daughter the full some of Twenty pounds of good & lawfull money of England (over & above the some of twenty pounds before mentioned to be paide unto her by the said Mary my wife) wthin one yeare next after the decease of the said Mary my Wife yf the said Sara my daughter shall then accomplish her said age of twentie & one yeares, or day of marriage, or els such tyme as she the said Sara shall accomplish the said age of twentie & one yeares, or said marriage otherwise if the said Randall my sonne shall refuse to paye the said Sara my daughter the said some of twenty pounds contrary to the true meaninge of this my will Then the guifte [gift] & legacie to him mentioned to be given of the said lease & house shall be utterly voyde & of none effect, And then my will & mynde is, that my said daughter Sara shall have & enioy [enjoy] the said lease & dwellinge house in leiue [lieu] of the said some of twenty pounds for & duringe all such tyme & terme of yeares as shalbe to come next after my wives decease or widowes estate Any things herein before mentioned to the contrary thereof in anywise not wthstandinge.  Provided alwais, & my will & mynde is, that if it shall fortune or happen, that any of my said children (to whome I gave, by this my will devise the inheritance of my of my [sic] said Lands or other legacies, after my said wives’ decease, or widdowes estate) shall  happen to dye, or depte [depart] this mortal life before they shall have accomplished their full age of twenty & one yeares, That then the Inheritance of such lands & such estates as are mentioned to be given to such children as shall for? happen to dye or depte this mortall life before the accomplishment of the said age of twentye & one yeares shall & after my said wives decease or widdowed estate, divided parted & shared equally betweene & amongst my children wch are before in this my will mentioned that shalbe survivinge & to their heires pte & parte’like? [share & share alike] Any thinge herein before mentioned to the contrary thereof in any wise notwthstandinge  Item I doe give will, devise & bequeath unto my daughter Margaret Murren nowe the wife of walter Murren, and to Thomas Murren sonne of the said walter & Margaret all that my lease, estate, or terme of yeares right title or interest wch I have,  or ought to have of in & to all that messuage or tenemt wth the appurtenances scituate lyinge & beinge in ?? ?? for aforesaid wthin the pishe [parish] of Heyworth aforesaid now beinge in the tenure use or occupation of the said Walter Murron.  Item I doe give will & bequeath unto & amongst the poore people of the pishe of newe Windsor aforesaid, the some of tenne shillings of good & lawfull money of England, to be bestowed in bread? and to be distributed unto them at the tyme of my buriall at the discretion of the said Marye my wife All the rest & residue of all & singular my goods chattells, chattells [sic] estate substance whatsoever (my debts beinge paid and legacies & funerall expences beinge discharged) I doe will give & bequeath unto the said Mary my nowe wife lovinge wife,  whome I doe ordaine make constitute & appoint to bee my full & sole executrix of this my last will & testamt.  And I doe ordaine my said sonne in lawe Walter Murren, & William Whills? overseers, to see this my Will pformed [performed] accordinge to my true meaninge  And I doe give as a token to either of them a paire of gloves, to the value of two shillings sixe pence a paire,  And I doe hereby utterly revoke all former Willes guifts, legacies & escutcheons? be me at any tyme heretofore had, made, named willed, or bequeathed And this my Will to stand & be as my last will & testamt, & nowe other, nor or otherwise.  In witnes whereof I the said Robert Tyncker hand to this my psent [present] Will (contayninge fourteene sheets of pay) set my hande & seale Dated the Three and twentieth daye of January, in the yeare of our Lord god, one thousand sixe hundred twenty & two.  And in the yeares of the raigne of our Sovraigne Lord James, by the grace of god Kinge of England, Scotland ffrance & Ireland, defender of the faithe etc (that is to say) of England, ffrance & Ireland the Twentieth and of Scotland the sixe & fiftieth.

Sealed & delivered by the said Robert Tyncker the testator, [hereby] published & declared to bee for & as his last will & testamt in the pnce [presence] of us whose names are heareunderwritten.

Memorandum that whereas I Robert Tyncker in & by my last will & testamt, have given & bequeathed unto Mary my Wife the messuage or tenemt wherein I nowe dwell in Newe Windsor aforesaid, To have & to hold unto her for & duringe all the terme of yeares wch I have therein to come by vertue of my lease wch I have of the same, yf she the said Mary my wife shall happen to dye, or depte this life or be married before the said expiration of the terme of yeares wch I have in the lease of my now said dwellinge house, That then in & by my said will I have given & bequeathed the said lease dwellinge house & terme of yeres wch shalbe to come or unexpired after my said wives decease, or widdowes estate unto my Welbeloved sonne Randall Tincker his executors adminstrators or assignes, upon condition that he the said Randall Tincker his executors administrators or assignes shoulde? well & trulie paie, or cause to be paid unto Sara my daughter the some of Twenty pounds of lawfull money of England w wthin one yere next after the decease of the said Mary my wife yf the said Sara my daughter shall then accomplish her full age of twentie & one yeares, or day of marriage, or els at such tyme as she the saide Sara shall accomplish her said age of twenty & one yeares, or day of marriage Otherwise if the said Randall my sonne shall refuse to pay to the said Sara my daughter the said some of twenty pounds contrary to the true meaninge of my said will, Then the guifte & legacie to him mentioned to be given of the said lease & house, shalbe utterly voyde, and of none effecte  And then my mynde & Will is that my saide daughter shall have & enioy [enjoy] the said lease & dwellinge house in leiue of the said twenty pounds for & duringe all such tyme & terme of yeares as shalbe to come next after my said wives decease, or widdows estate Any thinge in the said will mentioned to the contrary as in or by the same my last will & testamt in whereunto theis pntes [presents]  are annexed more plainly appeareth Nowe I the said Robert Tyncker, doe hereby revoke renounce & alter the said guift & bequest of the said Lease, lease or terme of yeares therein to come, as it is in my said will given & bequeathed, And doe hereby give devise & bequeath the same in mann [manner] & forme followinge,  (that is to say) I doe give, devise will & bequeathe my said nowe dwellinge house & the Lease, terme of yeares or interest wch I nowe gave of, in, or to the same house wth th’apptenances unto my said wife Mary, yf she the said Mary soe longe shall live and keepe herself a widdowe But if she the said Mary my Wife shall happen to dye or depte this life, or be married before the end & expiration of the terme of yeares of & in the said lease, Then I doe give will & bequeath the same lease or remainder of yeares therein then to come unto the said Randall Tinker my sonne his executors administrators or assignes upon this condition that there shalbe tenne yeares at the lease to come of or in the said lease of my said dwellinge house at the tyme of such decease, or els marriage of the said Mary my Wife as aforesaid That then the said Randall his executors administrators or assignes shall well & truly pay, oor cause to be paid unto my said daughter Sara, the some of twenty pounds of lawfull money of England wthin one yeare next after the decease or marriage of the said Mary my wife yf the said Sara shall then be of the age of twenty & one yeares, or be married or els at such tyme as she the said Sara shall accomplish the age of one & twenty yeares, or day of marriage.  And if there shalbe tenne yeares at the least to come of, or in the said Lease, at the tyme of the decease or marriage of the said Marye my wife And the said Randall his executors administrators or assignes, shall refuse to paie to the said Sara my daughter the said some of twenty pounds in manner & forme aforesaid Then I doe give will & bequeath the said Lease or remainder of yeares therein then to come unto the said Sara my daughter in leiue of the same twenty pounds for & duringe all the terme of yeares wch shalbe therein to come at the tyme of the decease or marriage of the saide Mary my wife as aforesaid Anythinge in my said will before mentioned, or in these pntes [presents] contayned to the contrary thereof in any Wise notwthstandinge In witnes whereof I have published this putes as pte of my last will & testamt & have fixed it to the same, and alsoe thereunto put my hand & seale the sixe & twentieth day of May in the two & twentieth yeare of the raigne of our soveraigne Lorde Kinge James of England etc. 1624.  Robert Tinker. / In the pnce [presence] of us.
