This is the Last Will
and testament of me
William Symes of Coxden
within the Parish of
Chardstock in the County
of Dorset Gentleman
ffirst I desire and
direct all my just debts
ffuneral expenses and
testamentary charges to
be fully paid Satisfied
and discharged And I do
hereby ratify and
confirm the Settlement
made by me in the year
one thousand eight
hundred and thirteen on
my late Daughter Martha
[written Hannah]
Stark Symes’s marriage
with Mr. Joshua Harcombe
Cuff of my Estate called
Coxden in Chardstock
aforesaid And I do
hereby ratify and
confirm the settlement
made by me on my
marriage with my present
wife except as to the
small copyhold Close
herein mentioned which I
have sold to John
fforsey and in lieu
thereof I give and
bequeath to my said Wife
and her Assigns during
her life one Annuity or
Annual Sum of ffive
pounds such Annuity to
be paid to her or them
by my trustees
hereinafter named By two
half Yearly Payments the
first payment thereof to
be made at the
expiration of Six
Calendar months next
after my decease Also I
give and bequeath unto
my said wife during her
life the following part
of my household goods
and ffurniture viz the
four post bedstead Bed
and ffurniture Large
Mahogany drawers
Mahogany Writing Desk
and Stand Washhand stand
Dressing table Chair
Looking Glass stool
ffender ffire irons
Small Bed Carpet
Mahogany tea table two
Square Japan Waiters
large Mahogany Waiter
Half a dozen painted
chairs two brass and cut
tin Candlestick Snuffers
and stand Small tin oven
set of small China Cups
and Saucers China Bason
and Bowl four Silver
table spoons and half a
dozen Silver tea spoons
Also I give and bequeath
all that my Copyhold
Estate Situate at
Millbrook within the
Parish of Axminster in
the County of Devon and
Manor of Presstoller
unto my daughter Mary
Symes Also I give and
bequeath to my daughter
Elizabeth Symes all that
my Copyhold Estate
called Crabbs Situate at
Titherbridge within the
Manor and Parish of
Chardstock aforesaid to
hold to her her
Executors Administrators
and Assigns (?)ing all
my Estate and interest
therein Also I give and
bequeath to my said
daughter Elizabeth the
sum of One hundred
Pounds to be paid her
with interest at five
per cent at the end of
one Year next after my
decease And all the rest
residue and remainder of
my real and Personal
Estate and Effects
whatsoever and
wheresoever and of evry
sort and kind Subject to
and charged and
chargeable with the
payment of my just debts
and ffinancial Expenses
I give devise and
bequeath unto Jonathan
Symes of Axminster
aforesaid Tobacconist
and Willmott Cuff of
Linkenholt in the county
of Hants Gentleman their
heirs Executors
Administrators and
Assigns upon this
special trust and
confidence nevertheless
that is to say that they
my said trustees or the
Surivor of them or the
heirs Executors or
Administrators of such
Survivor do and shall as
soon as conveniently
after my decease call in
and receive all such
monies as shall be due
and owing to me and sell
and dispose either by
Public Auction or
Private Contract of all
other my residuary
Estate and the monies
arising by such Sale and
Sales and so to be
called in do and shall
account for and pay over
unto my said daughters
Mary and Elizabeth in
equal parts and shares
and as tenants in common
and not as joint tenants
and my mind and will is
that the receipt and
receipts of my said
trustees or the Survivor
of them his heirs
executors or
Administrators to any
Purchaser or purchasers
of my said residuary
Estate and Effects for
his or their Purchase or
Consideration money or
monies shall be an
absolute acqittance
release and discharge to
such Purchaser or
Purchasers for the same
or so much and such part
and parts

parts thereof for which
such receipt or receipts
shall be given And that
such Purchaser or
Purchasers thereof or of
any part or parts
thereof shall not in any
wise be obliged to set
to this application of
his her or their
purchase or
consideration money or
monies or any part
thereof nor be in any
manner answerable
chargeable or
accountable for the
misapplication or
nonapplication thereof
or any part thereof by
my said trustees or
either of them Provided
alway nevertheless my
Will further is that
neither of them my said
trustees shall be
answerable or
accountable for any loss
or losses which shall or
may happen to my said
trust Estate or any part
thereof unless the same
be through their own
wilful neglect or
default nor shall either
of them my said trustees
be answerable or
accountable for the acts
goods receipts and
disbursements of the
other of them but such
of them shall be
answerable only for his
own separate acts deeds
receipts and
disbursements And I do
direct that my said
trustees shall and may
reimburse themselves and
himself out of the
aforesaid residue of my
Estate and Effects all
reasonable and necessary
Costs charges and
expenses whatsoever that
they or either of them
shall or may bear pay be
put unto or sustain in
or about the execution
of this my Will or the
trusts hereby in them
reposed And lastly I do
hereby nominate
constitute and appoint
the said Jonathan Symes
and Willmott Cuff
Executors In trust of
this my last Will and
testament contained in
two sheets of paper set
my hand and seal to wit
to the first sheet my
hand and to this sheet
