This is the last will and testament of one
Joseph Swindells of Tythe Barn, Bugsworth in the parish of Glossop,
and in the county of Derby. First I direct the payment of all my
just debts, funeral and testamentary expenses to be paid by my
executors and trustees herein after named, out of my real and
personal estate. Then I give devise and bequeath unto my trustees
and executors herein after named the whole of my real and personal
estate upon trust and for the uses, intents and purposes herein
after named that is first for the use and benefit of my dear wife
during her natural life and should the interests and rents devised
from my estate not be sufficient for a comfortable maintenance for
my wife then my trustees shall have power to sell and dispose of any
of my real estate in order that my said wife may have a sufficiency.
Also at the death of my wife, the whole of my real estate consisting
of near six acres of land together with outbuildings and three
cottages adjoining, situate at Tythe Barn, Bugsworth in the parish
of Glossop and county of Derby shall be sold by public auction and
their receipt or receipts shall be a sufficient discharge to the
purchaser or purchasers thereof after which the proceeds of the said
sale together with the whole of my personal estate shall be divided
equally amongst any lawful children or should any of my children be
dead leaving lawful issue then the said child or children shall take
their parents share and with regard to my furniture which is
included in my aforenamed personal estate my wish is that my son
Joseph Swindells shall have the clock also that he shall have the
bed and bedstead upon which he now sleeps together with all its
furniture and clothing after which I direct that the remainder of my
furniture shall be divided equally amongst any said children my son
Joseph taking his share, but if this cannot be alone agreeable and
comfortable then it shall be sold by public auction and divided as
above with the remainder of my estate. Lastly I nominate and appoint
my dear wife and Thomas Swindells of Whitehough together with my son
Joseph Swindells as executors and trustees of this my will and
testament and I exonerate my said trustees from any loss they may
incur in the carrying out of this my will and testament in witness
hereof I have hereunto set my hand on this the thirteenth day Febly
in the year of our Lord one thousand eight hundred and seventy

The testator Joseph Swindells was late of
Tythe Barn Bugsworth, the parish of Glossop, the county of Derby
farmer
and died on the sixth day of December 1874 at
Tythe Barn, Bugsworth.
