THIS IS THE LAST WILL
AND TESTAMENT of me
MARIA SWALES of No 3 Trinity Road Sheerness
in the County of Kent Widow I appoint my
Friends Charles Arrol of Edward Street
Sheerness aforesaid Physician and Edward
James Bass of High Street Sheerness
aforesaid Bank Manager to be the EXECUTORS
and TRUSTEES of this my will and I give them
the sum of Twenty pounds each free of legacy
duty for their trouble in acting as such
executors and trustees I give the following
legacies (all free of legacy duty) namely to
Jane Swales the widow of my brother in law
Thomas Cumming Swales the sum of One hundred
pounds To my nephew Donald Speck the sum of
Fifty pounds To my niece Kate Dutton the sum
of Fifty pounds To my nephew John Dutton the
sum of Fifty pounds To my nephew Edward
Dutton the sum of Fifty pounds To my brother
Edward Charles Richards the sum of Five
hundred pounds To my Servant Eliza Batt for
her long and faithful service to me provided
she remains and is in my service at my death
the sum of One hundred and fifty pounds To
Nellie Florence Briggs the daughter of my
son Thomas Francis Richards Briggs by my
first husband Thomas Briggs the sum of One
hundred pounds I give the following sums to
To Daisy Maria Briggs the daughter of my
said son Thomas Francis Richards Briggs the
sum of One thousand five hundred pounds To
May Victoria Briggs the daughter of my said
son Thomas Francis Richards Briggs the sum
of Five hundred pounds To Edward Charles
Briggs and Frank Briggs the sons of my said
son the sum of Five hundred pounds each if
and when the said Daisy Maria Briggs May
Victoria Briggs Edward Charles Briggs and
Frank Briggs respectively attain the age of
Twenty five years with interest thereon from
my death until payment or investment of the
said sum respectively after the rate of
Three pounds per annum and if they shall not
be of the age of Twenty five years at my
death I empower my Trustees to invest the
sums or any or either of them as the case
may be in any investments in which my
residuary estate is authorized to be
invested with power to vary such investments
And I declare that the said investments and
the income thereof and the statutory
accumulations of such income shall be held
IN TRUST for the said Daisy Maria Briggs May
Victoria Briggs Edward Charles Briggs and
Frank Briggs if and when they attain the age
of twenty five years respectively I Give
Devise and Bequeath all my real and personal
property not hereby otherwise disposed of
Unto my Trustees UPON TRUST that they shall
sell call in and convert into money the same
or such part thereof as shall not consist of
money and shall out of the monies produced
by such sale calling in and conversion and
out of my ready money pay my just debts
funeral and testamentary expenses and the
legacies bequeathed by this my Will or any
Codicil thereto and shall invest the residue
of the said monies with power from time to
time to vary the investments and shall stand
possessed of the residue of the said moneys
and the investments for the time being
representing the same UPON TRUST to pay
Ellen Briggs the wife of my said son Thomas
Francis Richards Briggs the sum of Seventy
eight pounds per annum during her life and
while she shall remain unmarried and in the
event of the said Ellen Ann Briggs
remarrying again then I Direct my Trustees
to pay her the sum of Forty pounds during
her life instead of the sum of Seventy eight
pounds And after her death The residue to be
in trust for the said Daisy Maria Briggs May
Victoria Briggs Edward Charles Briggs Frank
Briggs and Nellie Florence Briggs to be
divided in equal shares between them if and
when they shall attain the age of Twenty
five years respectively and if there shall
be only one such child the whole to be in
trust for that one child I Direct that if
either or any of the said Daisy Maria Briggs
May Victoria Briggs Edward Charles Briggs
Frank Briggs or Nellie Florence Briggs shall
die in my lifetime leaving a child or
children who shall survive me and attain the
age of Twenty five years then in every such
case the last mentioned child or children
shall take and if more than one equally
between them the share which his her or
their parent would have taken under this
Will if such parent had survived me and
attained the age of Twenty five years I
empower my Trustees at their discretion to

raise any part or parts not exceeding one
moiety of the vested or presumptive share of
any of the said Daisy Maria Briggs May
Victoria Briggs Edward Charles Briggs Frank
Briggs or Nellie Florence Briggs under this
Will and apply the same for his or her
advancement or benefit as my Trustees shall
think fit I DECLARE that my Trustees may
postpone the sale and conversion of any part
of my property real and personal for so long
as they shall think fit And I DECLARE that
all monies liable to be invested under this
my Will may be invested in any Stocks funds
or securities for the time being authorized
by Law for trust money or on mortgage of
freehold property I hereby direct that my
said Executors and Trustees shall employ
Messieurs M & D Blome-Jones of Edward Street
Sheerness aforesaid Solicitors to be the
Solicitors to transact any business or do
any act required to be done in connection
with the administration of my estate or the
trusts’ hereby declared IN WITNESS whereof I
have hereunto set my hand to this and the
two preseding pages this thirteenth day of
March One thousand nine hundred and five

THIS IS A CODICIL to
the last Will and Testament of me MARIA
SWALES of No 3 Trinity Road Sheerness in the
County of Kent Widow which will bears date
the Thirteenth day of March One thousand
nine hundred and five WHEREAS by my Will I
appointed Edward James Bass of Sheerness
aforesaid Bank Manager to be one of the
Trustees and Executors thereof AND WHEREAS
the said Edward James Bass has removed from
Sheerness NOW I HEREBY APPOINT John George
Whalebone of No 91 Alma Road Sheerness
aforesaid Agent to be one of the Trustees
and Executors of my said Will in place of
the said Edward James Bass And I give to the
said John George Whalebone a legacy of
Twenty pounds for his trouble in acting as
and Executor and Trustee of my said Will and
I declare that my said Will shall be
construed and take effect as if the name of
the said John George Whalebone were inserted
in my Will throughout instead of the name of
the said Edward James Bass AND WHEREAS by my
said Will I give my servant Eliza Batt the
sum of One hundred and fifty pounds now I
hereby give her a further sum of fifty
pounds in addition to the said sum of One
hundred and fifty A copy of this will (in
its original form) is with me - pounds I
give devise and bequeath to Daisy Maria
Briggs the daughter of my son Thomas Francis
Richards Briggs my two freehold houses
situate and being Numbers 26 and 28 East
Lane Sheerness aforesaid such gife to take
effect immediately on my decease and to be
in addition to any benefit she may be
otherwise entitled to under my said Will And
in all other respects I confirm my said Will
