The Will of James Sutton
This is the last Will and Testament of me James Sutton of Heswall in the County of Chester Shoemaker First I devise that all my just debts funeral expenses and all other legal charges and expenses of proving this my last Will be fully paid by my Executors hereinafter named and after payment thereof and every part thereof I give devise and bequeath as follows First I give devise and bequeath unto my Wife Mary Sutton for and during the full end and term of her natural life the whole that I am possessed of namely the house I now live in and Garden attached containing by admeasurement eighteen perches together with all my household furniture of any description Secondly I give devise and bequeath unto my Wife Mary Sutton for and during the full end and term of her natural life two Crofts one situate on Heswall Hills containing three roods and eight perches numbered on the plan on Map of Award of the Commissioners 404 and the other croft situate on the Hill side close to my house number 344 on Map of Award containing two roods and eleven perches and at my Wife’s death I give devise and bequeath the whole of the hereinbefore mentioned property namely the house and garden and the said two Crofts unto my daughter Maria Sutton and at her death I devise that the whole of the said property shall be divided equally between the children of my daughter Maria Sutton and their heirs for ever And I do hereby nominate and appoint my Wife Mary Sutton and Joseph Edwards of Heswall aforesaid Executors of this my last Will hereby revoking and making void all other Wills by me at any time heretofore made and declare this only to be my last Will In witness whereof I have hereunto set my hand and seal this seventeenth day of March one thousand eight hundred and sixty four___ The mark X of James Sutton(JS)___ Signed sealed published and declared by the said testator James Sutton in the presence of us who in his presence and in the presence of each other have subscribed our names as witnesses thereto, Witness Joseph Edwards__Alfred Moore__W H Edwards
Proved at Chester on the 26th day of August 1864 by the oaths of Mary Sutton Widow the Relict and Joseph Edwards the Executors, to whom administration was granted. The Testator James Sutton was late of Heswall in the County of Chester Shoemaker and died on the 27th day of May 1864 at Heswall aforesaid.
