The Will of Benjamin Sumerton
In the Name of God Amen I Benjamin Sumerton of the Parish of Hooknorton in the County of Oxford Gardner being of Perfect Sound mind memory and understanding Blessed be God Do this Day make Publish ordain and Appoint this my Last Will and Testament in manner following (Which is to say) first I will that all my Just Debts and Burial Expences be Paid and Discharged by Executors herein After Named then I give Bequeath and Devise unto my beloved Wife Elizabeth Sumerton all that my Cottage or tenement Garden and Premises With all and Every the Appurtenances thereunto belonging for and During Her natural Life her keeping the Same in tenantable repair; also all the Rest and residue of my Estate both real and Personal household Goods And Chattals Whatsoever I dye Possessed of I give and Bequeath unto my beloved Wife Elizabeth Sumerton aforesaid for and During her natural Life , and from and after her Decease, I give and Bequeath unto my son Edmond Somerton the Sum of one Shilling; also I give and Bequeath Unto my Daughter Ann Stanley the Sum of ten Pounds of good And lawfull Money of Great Britain; and from and after my Wives Decease, All the rest of my household Goods and Chattels Whatsoever I Dye possessed of and also all that Cottage or tenement garden and premises above mentioned, I give and Devise unto my Son Thomas Sumerton And to his Heirs and Assigns for Ever, Nevertheless Upon Trust for such uses intents and Purposes herein after mentioned (that is to say)that he shall Sell and Dispose of all Goods and Chattals above Mentioned in the Best Way and Manner that he Can; and after the Payment of my Just Debts Legacies and Burial Expences, then all the rest and remainder of the money so arising by such Sale to be Equaly Devided Share and Share Alike between my Son Thomas and my Son James Sumerton and my five Daughters namely Mary Sumerton, Ann Stanley, Hanah Sumerton, Ester Sumerton and Elizabeth Sumerton; And Lastly I Do hereby Constitute Ordain and appoint my said beloved Wife Elizabeth Sumerton Sole Excutorix of this my last Will and Testament in Witness Whereof I have hereunto Set my hand and seal this fourth Day of January one Thousand Eight Hundred and five
