The Will of Thomas Stretton
This is the last Will and Testament of me Thomas
Stretton of Saddington in the County of Leicester Cordwainer whereby I
dispose of my real and personal estates First I direct that all my just
debts funeral and testamentary expences be fully paid and satisfied I give
and devise all and every my messuages lands tenements hereditaments and real
Estates whatsoever and wheresoever in the Kingdom of Great Britain or
elsewhere unto my Sister Hannah Harrison Widow and Brother in Law William
Ross To hold the same unto them my said Sister Hannah Harrison and Brother
in Law William Ross and their assigns for and during the term of their
natural lives and the life of the survivor of them as joint tenants and from
and after the decease of the said Hannah Harrison and William Ross and the
decease of the survivor of them I give and devise the said messuages lands
tenements hereditaments and real estate unto and to the use of my great
nephew Bartholomew Stretton son of my late Uncle Thomas Stretton his heirs
and assigns for ever I give and bequeath unto the said Hannah Harrison and
William Ross All and singular my household goods and furniture plate linen
china and implements of household to and for their own use absolutely to be
equally divided between them share and share alike And I give and bequeath
unto the said William Ross All my wearing Apparel for his own use absolutely
And I give and bequeath unto my two Brothers in Law Jonathan Horton of
Mowsley and Thomas Horton of Saddington the sum of twenty pounds a piece for
their own use absolutely Unto my Niece Elizabeth the Wife of John Wickes the
sum of five pounds to and for her own use absolutely Unto Thomas Horton and
Samuel Horton Sons of my said Brother in Law Jonathan Horton the sum of five
pounds a piece to and for their own use absolutely Unto Samuel Horton Ann
the Wife of Richard Kirby Sarah the Wife of Charles Carter Hannah the Wife
of Richard Humfrey Thomas Horton William Horton Jonathan Horton Eliza Horton
James Horton Isaac Horton and Mary Horton Children of my said Brother in law
Thomas Horton the legacy or sum of five pounds a piece for their own
respective use absolutely All which legacies I direct shall be paid and
payable to the respective Legatees within six calendar months next after my
decease Provided and my mind and will is that in case of the death of any or
either of the said Legatees before the said Legacies shall become payable
leaving lawful Issue of his her or their body or bodies him her or them
surviving then I direct that the legacy or legacies of him her or them so
dying leaving issue shall go and be paid to such issue if more than one
share and share alike and if but one child then to such only Child such
Issue taking the part or share only of his her or their parent or parents
would have been entitled to if living I give and bequeath unto my said
Brother in law Thomas Horton and his son the said William Horton of
Saddington aforesaid the sum of One hundred and fifty pounds Upon trust that
they the said Thomas Horton and William Horton or the survivor of them or
the executors or administrators of such survivor do and shall place out and
invest the same upon Government or real securities in England with power to
alter vary and transpose such securities for others of the like nature at
their or his discretion and do and shall pay and apply the interest
dividends and proceeds of the said sum of One hundred and fifty pounds as
and when the same shall become due and payable unto and equally between the
said Hannah Harrison and William Ross and their assigns for and during the
term of their natural life and the life of the survivor of them and from and
immediately after the decease of the survivor of them then Upon trust to pay
transfer and divide the same unto and equally amongst my Cousins Elizabeth
Goodman Widow Elizabeth Waring and Sarah Barwell Widow or such of them as
shall be living at after the decease of the survivor of them the said Hannah
Harrison and William Ross to and for their own respective use and benefit
absolutely equally to be divided between them share and share alike And I do
nominate and appoint my said Brother in Law Thomas Horton and the said
William Horton joint Executors of this my Will and do give and devise unto
them All estates vested in me upon trust or by way of mortgage and whether
constructively or otherwise to be held and disposed of accordingly And I
declare that it shall and may be lawful to and for my said Executors to
reimburse himself and themselves all costs charges and expences they or he
may be put unto in the execution of the trusts of this my Will and that they
my said Executors shall not be answerable or accountable for any involuntary
loss or for the acts or defaults of each other but only for his or their own
acts and defaults And I do hereby revoke all other Will and Wills by me at
any time or times heretofore made and declare this to be my last Will In
witness whereof I the said Thomas Stretton the Testator have to this my Will
contained in this and the preceding sheet of paper set my hand to and at the
bottom of each sheet thereof this twenty fifth day of April One thousand
