In the Name of God Amen I Thomas Stokoe of Hexham in the County of Northumberland Apothecary do make publish and declare this to be and contain my last Will & Testament as follows first I will that all my just debts funeral Expences and the Expences of proving my will shall be paid in due time after my decease I give and bequeath unto my dear Children as follows that is to say to all my sons the sum of One hundred pounds apiece to my Daughter the Sum of two hundred pounds the said legacies to my sons to be paid to them severally when they shall respectively attain the age of twenty five years without interest and the legacy to my daughter when she shall arrive at the same Age or marry which shall first happen in Case she marries with the Consent of her mother but not otherwise without interest also I give devise & bequeath all my real and personal Estate whatsoever and wheresoever the same may be unto my much esteemed ffriends Ralph Riddell of Cheeseburn Grange in the said County Esquire & James Kirsopp of Hexham Spital in the said County Esq their heirs Exors and admors respectively according to the nature and tenure hereinafter mentioned that is to say upon the rusts nevertheless & to & for the uses intents & purposes hereinafter mentioned that is to say in trust in the first place to permit & suffer my dear Wife Clara Stokoe to have the use of all my household furniture plate & linen during her life & in the next place out of my ready money book debts due to me or money in the public funds tom pay off & discharge my Just debts funeral Expences & the Expences of proving my Will & also the said legacies to my Children in course as they shall become due & in the mean time until such payments shall be made to receive the rents profits & proceeds of all my Estates half yearly as the same shall become due & after any such payment or payments shall be made to receive the rents profits & proceeds of the residue & remainder thereof during the natural life of my said dear Wife and on receipt thereof immediately to pay over the same to her for he own use & benefit & the maintenance & education of my children until they severally attain the age of twenty one years it being my will that my Children shall severally maintain themselves after that age or otherwise to permit & suffer my said dear wife to receive such rents profits & Proceeds as for and during the term of her natural life for the uses aforesaid & from & after the Decease of my said dear wife upon trust to & for the only proper use & benefit of all my Children equally share & share alike & their respective heirs Exors & admors according to the nature of my estates as Tenants in Common and not as joint Tenants and it is my will and I hereby order and direct that in Case any of my Children shall happen to die under the age of 25 years and unmarried and without issue lawfully begotten the share & interest shares & interests of him her or them so dying of and in my estates shall go to & amongst all & every the survivors of them which shall be then living equally to be divided between or amongst them if more than one share & share alike and the Child or Children of such of them as shall be dead if any to take his or their ffathers or mothers share only and also upon trust in case of the death of my said dear Wife during the infancy of any of my Children such infancy to continue to the age of twenty two years that they the said Ralph Riddell and James Kirsopp and the Survivor of them his heirs and admors shall pay lay out & expend such Child or Childrens share or shares of all such rent profits and projects or so much thereof as he or they shall think proper in the maintenance & education & advancement in the world of such child or children till they respectively arrive at the age of twenty two years and I do hereby appoint the said Ralph Riddell and James Kirsopp Exors of this my Will and Testament & moreover I hereby request and authorize & empower my said Exors & the survivor of them his Exors & admors in the mean time from and after my decease during my Wifes life & until my Children shall respectively attain the age of twenty five years to manage & improve my Estate & fortune for then uses intents & purposes aforesaid to lease my real Estate and to lend and place out upon security or securities at Interest or to lay out in the public funds or otherwise improve according to his or their discretion all or any part of the money belonging to or arising from my Estates Except the rents profits and Proceeds thereof during my Wifes life and to pay unto & account with my Children for the same according to the tenor & intent & meaning of this my will and my will is & I do hereby expressly declare that my said Exors or admors shall not be charged or chargeable with or accountable for more of my monies & Estates than he or they shall actually receive or shall come to his or their respective hands by virtue of this my will nor with or for any loss which shall happen without their wilful Default nor the one of them for the other of them or for the acts deeds Receipts defaults or disbursements of the other but each of them for himself after his own acts deeds heirs Exors & admors only and also that it shall & may be lawful for them my said Exors & Trustees & each of them their & each of their Exors & admors in the first place by and out of the Premises respectively to deduct and reimburse him and themselves respectively all such loss Costs charges and expences as they or any of them shall sustain expend or be put unto for and by reason of the performance of this my will or the trusts hereby in them reposed or the management & execution thereof respectively or any other thing in any wise relating thereto & lastly I do hereby revoke all former & other will and wills by me at any time heretofore made & declare this only to be my last will & Testament In witness whereof I have hereunto set my hand & seal
