This is the last Will
and Testament of me William Sparrowhawk of Aston in the parish
of Bampton in the County of Oxford Yeoman made this twenty
second day of June in the year of our Lord One thousand eight
hundred and thirty nine as follows I give and bequeath unto my
wife Mary Sparrowhawk All and singular my household furniture
plate linen china money securities for money book and other
debts Farming stock of every description both live and dead and
all other my personal property of what nature or kind soever and
wheresoever being at the time of my decease To hold to her
absolutely for her own sole use and benefit she paying thereout
all my just debts funeral and testamentary expences and also
paying thereout to my Trustees hereinafter named the sum of Five
Guineas apiece as a small token of my esteem for them I give and
devise unto my friends James Rose of Bampton aforesaid Gentleman
and Richard Townsend of Coate House in the parish of Bampton
aforesaid Yeoman All that my messuage or tenement situate at
Aston aforesaid in the occupation of Richard Clark with the Barn
Stable Garden and appurtenances appertaining Together with the
Close adjoining thereto called Spring Close and the Commons and
appurtenances whatsoever thereto belonging To hold to the said
James Rose and Richard Townsend their heirs and assigns upon
trust to permit and suffer my said wife and her assigns to hold
and enjoy the same or to receive the rents and profits thereof
during the term of her natural life she keeping the same
premises in good and tenantable repair And from and after her
decease Upon trust to permit and suffer my wife's mother Mrs
Sarah Iles and her assigns to hold and enjoy the same or to
receive the rents and profits thereof during the term of her
natural life she keeping the same in good and tenantable repair
And from and immediately after the several deceases of my said
wife and her mother Upon trust to stand seized of the said
messuage or tenement Barn Stable Garden Close Commons and
appurtenances for the use of my nephew William Pinnock of
Chimney near Aston aforesaid Yeoman his heirs and assigns for
ever Provided always and I do hereby declare it to be my Will
that in case the said William Pinnock shall depart this life
before my said wife or her said mother then the aforesaid
hereditaments and premises with their respective appurtenances
shall upon the several deceases of my said wife and her mother
descend and go to my own right heirs for ever. I also give and
devise unto the said James Rose and Richard Townsend All those
my cottages or tenements in Aston aforesaid now or late in the
occupation of William Bartlett with the garden and appurtenances
belonging To hold to them their heirs and assigns Upon trust to
permit my said wife and her assigns to hold and enjoy the same
or to receive the rents and profits thereof during the term of
her natural life she keeping the same in repair And from and
after her decease Upon trust to permit and suffer the said Sarah
Iles and her assigns to hold and enjoy the same or to receive
the rents and profits thereof during the term of her natural
life she keeping the same in repair And from and after the
several deceases of my said wife and her mother Upon trust to
pay the rents and profits of the said cottages or tenements
garden and appurtenances unto William Walker son of my niece
Mary the wife of Mr John Walker of Minster until he shall attain
the age of Twenty one years And upon his attaining that age Upon
trust to stand seized of the said cottages or tenements garden
and appurtenances for the use of the said William Walker his
heirs and assigns for ever Provided also and it is my Will that
in the event of the said William Walker departing this life
under the said age of Twenty one years or at any time before the
several deceases of my said wife and her said mother then upon
the several deceases of my wife and her mother the said cottages
or tenements garden and appurtenances shall also descend and go
to my own right heirs for ever. I also give and devise unto the
said James Rose and Richard Townsend All that my Close or
Inclosed Ground called Ivens's close lying in the Parish of
Bampton aforesaid with all appurtenances thereto belonging To
hold to them their heirs and assigns for ever Upon trust to
permit my said wife and her assigns to hold and enjoy the same
or to receive the rents and profits thereof during her natural
life and from and immediately after her decease Upon trust to
permit and suffer my brother Robert Sparrowhawk and his assigns
to hold and enjoy the same or to receive the rents and profits
thereof for and during the term of his natural life and
immediately after the decease of the survivor of them my said
wife and brother Upon trust to receive and pay the rents and
profits thereof to or for the benefit of my nephew Robert
Sparrowhawk the son of my said brother Robert until he shall
attain the age of Twenty five years And upon his attaining that
age Upon trust to stand seized of the said last mentioned Close
and premises for the use of my said nephew Robert Sparrowhawk
his heirs and assigns forever And in order to prevent any
dispute after my death in case my said nephew should happen to
die in the life time of my said wife or her mother I will and
direct that the interest of my said nephew in the said close and
appurtenances shall be considered vested in him immediately upon
my decease subject only to the life interest as aforesaid of my
said wife and my brother and to the restraint of his waiving the
rents thereof till he arrives at the said age of twenty five
years
And as to all those
small pieces or parcels of land containing about half an acre
which I lately bought (with other lands) of Miss Horde lying and
adjoining the house and premises now in the occupation of the
said Sarah Iles at Aston aforesaid And also all those lands and
commons I lately bought of the Trustees of the late Mr Macey
lying in the open and common fields of Aston and Coate aforesaid
containing by estimation eight acres and a quarter more or less
And also the low commons I bought of Robert Andrews and his son
Charles and Mr John Braine in the common meads of Aston and
Coate aforesaid And all my other real estate whatsoever and
wheresoever not before disposed of and which I am now or may at
the time of my decease die possessed of I give and devise the
same respectively and all my interest therein unto my said wife
Mary Sparrowhawk her heirs and assigns for ever And lastly I
appoint my said wife sole executrix of this my said Will In
witness whereof I the said William Sparrowhawk the Testator have
to this my last Will and Testament contained in three sheets of
paper set my hand and seal (to wit) my hand to the two preceding
sheets and my hand and seal to this last sheet the day and year
first above written
