The Will of John Soden

 

The last Will and Testament of me John Soden I John Soden of Sibford Gower in the Parish of Swalcliffe Oxon Yeoman being in health and of sound mind and memory do make this my last Will and Testament in manner following Item I give and bequeath unto my dear Sister Mary Soden all and every my Personal Estates and Effects whatsoever I Also give and bequeath unto my said Sister Mary Soden all and every the rents issues dividends Interest and profits or income of all my real Estates lands house or tenement heredits premises and appurts thereunto belonging situate lying and being at Sibford Gower in the County of Oxford and now in my own occupation for and during the term of her natural life and so as that the income shall not nor shall any part thereof by subject or liable to the debts engagements management or controul of any husband nor in their or either of their power to sell anticipate assign transfer or any way dispose of or incumber the same upon and with the following conditions and provisos that out of the said rents issues or income above mentioned she do well and truly pay or cause to be paid an annuity or yearly sum of twenty pounds clear of all taxes and deductions whatsoever into the proper hands of my dear brother Richard Soden during his natural life or to such other persons as he shall from time to time yearly and not otherwise by any note or writing signed with his own hand direct or appoint to receive the same the said annuity to be paid yearly upon the feat day of Saint Michael the Archangel in each year the first payment thereof to begin and to be made in that proportion upon the first of the said feast days that shall happen after my decease should my said Brother Richard survive my said Sister Mary Soden I do give devise and bequeath all and every the said Estates lands house or tenement heredits premises and appurtenances thereunto belonging situate at Sibford Gower in the County of Oxford and now in my own occupation in the said County of Oxford unto my Nephew John Soden son of my Brother Joseph Soden deceased and his assigns for ever upon his her or their paying the above mentioned annuity yearly to my said Brother Richard Soden if he shall survive my said Sister Mary Soden during his natural life and also upon condition that he she or they do pay the following legacies that is to say I give one legacy of one hundred pounds to my Sister in law ffrances Soden Widow of Stockport in Cheshire I also give one other legacy of one hundred pounds to Sarah Smith wife of William Smith labourer of ffinmer or ffinmore or some such name near Buckingham or to such child or children if more than one share and share alike as she may have died and left. I also give one other legacy of five pounds to each of my Brother Richard’s seven children now living namely Joseph John William Richard Benjamin Rebecca and Hannah Soden making altogether the sum of £35 the respective legacies of one hundred pounds each to be paid within one year next after my decease should one or more of my said Brother Richard’s 7 children above named die in their minority or minorities then his her or their legacy or legacies of five pounds each shall be given to the Survivor or Survivors if more than one share and share alike the said seven legacies of £5 each to be paid as the several and respective legatees or Survivor or Survivors attain the full age of twenty oen years with lawful Interest from my said Sister Mary Soden’s death and I do nominate and appoint my Sister Mary Soden and my said Nephew John Soden Son of my Brother Joseph deceased Executrix and Executor of this my last Will and Testament hereby revoking Annulling and making void all and every other Will or Wills by me at any time heretofore made or given and my will is and I do hereby direct that my said Executors shall be answerable for her and his acts and receipts only and not the one of them for the other of them In witness whereof I do hereunto set my hand and seal that is to say I have set my hand to the first page in writing my name at the bottom and my hand and seal to the second page this fifth day of the fourth month called april in the year of our Lord 1821 John Soden
