In the Name of God Amen I RICHARD SMITHYES of
Stockton upon Tees in the County of Durham mercer and grocer do make
publish and declare this my last will and testament in manner
following Imrpimis I give devise and bequeath unto my eldest son
THOMAS SMITHYES all those my lands and tenements and hereditaments
whatsoever scituate standing lying and being in the County Palatine
of Lancaster He my said son THOMAS paying thereout to my son adn
daughter JAMES and MARGARET Smithyes thr summs of £50 apiece without
Interest whent hey shall respectively attains their several ages of
one and twenty years But in case either my said son JAMES or my
daughter happen to dye before he or sheshall attain their resepctive
ages of one and twenty years then the £50 that would have been due
to him or her so dying shall go to be paid tot he survivor And my
Will is that my said son THOMAS shall not enter upon the rents and
profitts of my said estate till he shall attain his full age of one
and twenty years But the same shall be paid to my Executrix
hereinafter named till he shall attain his said Age of One and
Twenty years without giving any account to my said son for the same
Item I give unto my son in law WILLIAM
GOLDSBROUGH £5 to be paid to him at his full age of one and twenty
years by my executrix. I do also by this will comitt the care of my
children to my Executrix during their resepctive minorities As to
all the rest and residue of my Estate whether real or personall
after my debts legacys and funerall expences are thereout paid and
discharged I give devise and bequeath unto my dear wife MARY
SMITHYES and my said son and daughter JAMES and MARGARETT equally
to be divided amongst them But my will is that the said dividend
shall not be made till my said son and daughter shall attain their
ages of one and twenty years And the interest of their said
respective shares shall be employed by my said wife towards tyheir
maintenance and education till they severally attain their said ages
of one and twenty years And Lastly I nominate constitute and appoint
my said dear wife sole Executrix of this my last will and testament
and do appoint my Friends GEORGE TROTTER and JOHN TROTTER assiatants
In witness whereof I the said RICHARD SMITHYES .... have hereunto

The condition of this obligacion is such that
the above bounden JOHN TROTTER brother in law and administrator of
all and singular the goods chattells and credits of RICHARD SMITHIES
late of Stockton ... deceased ... dated 24 September 1728
A true and perfect Inventory of all and
singular the goods chattells rights and credits of RICHARD SMITHIES
deceased not administered by MARY SMITHIES his late widow deceased
and executrix of the last will and testament of the said Richard
Smithies which have since their resepctive deaths come to the hands
or posession of JOHN TROTTER ...

Several securities for monety att interest to
the value of £95
Book debts due and undischarged amounting to
£131 12s
Goods and Merchandise of several sorts being
stock unsold amounting in all to the value of £219 10s
The Exhibitant declares that no other goods
chattells or creditts of the said Richard Smithies have since his
death come to this Exhibitants possession of knowledge
