In the Name of God Amen I PHILLIS SMITH
of the parish of St Ann's within the Liberty of the City of
Westminster widow being sound of body and mind at this present time
praised be God for the same do make this my Last Will and Testament
in manner and form following. First I give my soul to God hopeing
through the merits and mediation of my Blessed Saviour Jesus Christ
to have full and free pardon and remission of all my sins and
ofences and my body to be buried at the discretion of my executors
hereafter named in the same grave with my dear husband and my desire
is that the Bricks shall be raised and a stone laid over us with an
inscription of our names and the several times of our deaths. And as
to my personal estate with which it hath pleased Almighty God to
bless me I do give and devise and bequeath the same as follows.
Impimis I give and devise and bequeath unto my
dear Sister ELIZABETH ADAMS wife of JOHN ADAMS of the parish of St
Buttolphs Aldersgate, Coachman, and unto my neice SARAH SHAW wife of
EDWARD SHAW of the same parish gentlemen all my land tenements and
hereditaments... being within the parish of Bowes in the County of
Yorke or elsewhere ... for and during their joint lives and the life
of the longer liver of them and the near Rents and Profitts thereof
equally to be divided between them after Parliamentary Taxes ....
but my intent and meaning is that the money ariseing out of the
rents ... be for the proper use of my Sister ADAMS and neice SHAW
and that their husbands shall have nothing at all to do with the
same. But I will that the Rents be paid severally to their own
hands. ....
..... and after the decease of my sister ADAMS
and neice SHAW I give devise and bequeath the said lands tenements
and herediatments in Yorkshire aforesaid unto the heirs of the body
of my neice SHAW lawfully begotten .... and for want of such I give
devise and bequeath the same lands tenements and hereditaments ...
at Bowes in Yorkshire aforesaid unto my Cozen CHARLES WHYTELL of
Furnivells Inn London .. and I will that the said CHARLES WHYTELL
pay unto my cozen CATHARINE NUTT wife of SAMUEL NUTT of London
merchant the full and just summe of £20 .... for her own proper use
and benefit ....
Item I give and bequeath unto my loving Cozen
SAMUEL NEWTON £10
Item I give unto my Cozen SARAH NEWTON wife of
SAMUEL NEWTON £10
Item I give unto my Cozen CHARLES and SARAH
NEWTON son and daughter of the said SAMUEL NEWTON £10 apiece
Item I give unto Cozen MARY MYLES and to Cozen
MARY NEWBY £10 apiece
Item I give to my Brother JOHN ADAMS and
ELIZABETH his wife £5 apiece
Item I give to JEFFRY SMITH one of the
brothers of my late husband £5
Item I give unto DANIEL SMITH another of my
said husband's brothers 1 shilling.
All of which legacies I will shall be paid
within six months after my decease.
I give and bequeath my two houses in West
Smithfield which I hold by lease which lease is out in four or five
years time unto my said Sister ADAMS ... during the said term
unexpired.
Item I give all my woollen wearing apparell to
be equally divided between my Sister ADAMS, Cozen NEWTON and her
daughter SARAH, Cozen MYLES and Cozen NEWBY to be divided into five
shares and Sister ADAMS to have the choice ...
Item I give unto Dr HARRIOTT and his wife,
Madam WATTS, Madam NICHOLLS, Madam SMITH, Madam CALLIOTT, Mr TANNER
BAKER my executor hereafter named, Mr JOHN BAKER brother , JOSEPH
COLE, Cozen CHARLES WHYTELL and Cozen SAMUEL NUTT and Cozen
CATHARINE his wife all and every of them a ring of 20s price
Item I give unto my JOHN NICHOLLS and Mr JAMES
NICHOLLS each of them a ring 20s price and as for the two silver
cupps I promised them they may remember they have £12 in their hands
for the interest over and above what they paid , which was due by
promise from them both for interest when the money was paid which
was due to my husband from their father and I give and acquitt them
both of that £12 in lieu and satisfaction of the said two cupps.
Item I give my little Diamond Ring sett round
with 8 Diamonds and an Amethist in the middle unto Mrs MARY HARRIOTT
daughter of Dr HARRIOTT.
Item I give unto my husband's sister CECILLY
BUNDY my wedding ring I had from her brother.
Item I give my chest of drawers unto my Cozen
ANN NUTT daughter of my Cozen SAMUEL NUTT.
Item I give unto my Cozen MYLES and Cozen
NEWTON all my wearing Linnen to be equally divided between them.
Item I give unto Mrs AVIS HAMLIN my wedding
ring that I had from her late husband SMITH.
Item I give to Mrs ELIZABETH HARRIOTT daughter
of Dr HARRIOTT my mourning ring I had at the death of Madam BAKER.
All the rest residue and remainder of my
Personal Estate unto my neice SARAH SHAW .... and I do hereby make
ordain constitute and appoint Mr TANNER BAKER sole executor ... I
give him £10 to be paid immediately upon my death and I do hereby
disannull and make void all former wills ... In Witness whereof I
have hereunto set my hand and seal the 28 June 1721
