The Will of Jeremiah Smith

 

In the name of God Amen I Jeremiah Smith of Ensham in the County of Oxford (younger) calling to mind the certainty of death and the uncertainty of the time when it may happen do make and ordain this my last Will and Testament for the settling of my Worldly estate wherewith it hath pleased God to bless me in manner and form following (that is to say) I give and bequeath unto my Beloved Wife Lydia All that Messuage Tenement Cottage and Appurtenances in Ensham wherein I now dwell and Occupy And all that my Messuage Tenement Appurtenances I purchased of Joseph Winter Together with the Money principal and Interest due to me from my Father Jeremiah Smith and for which I have a Mortgage Security of his House and Appurtenances And all other my Goods and Chattles Real and personal Estate To hold to the use of my said Wife Lydia during the term of her Natural Life But for the Special use Trust and purpose only That out of the Rents profits Interest and Issues of the above said Messuages Tenements Cottages and Real and personal Estates she my said Wife shall and will Support Maintain Clothe and Breed up all and every of my Children (by her) that I do leave at the time of my Decease But if my said personal Estate Money Goods and Chattells and Rents should be Insufficient to support Maintain and bring up my said Children Then I Will desire impower and authorise my Trustees hereinafter named and appointed to Sell and dispose of all my said Messuages Tenements Cottages and real and premises and Aputenances (or any part thereof Occasionally) for the most money they can get and the money thence Issuing and Arising to apply solely to the support maintenance and bringing up of my said Children (or as many of them as may occasionally want and desire maintenance) Tho my said Wife may then be living And I do hereby ratify amd confirm such Sale or Sales by my Trustees so made to be good and valid in Law And that all conveyances and deeds signd and executed by my Trustees to the purchase of such my Estates Messuages Tenements Cottages and premises shall be deemed Lawfull and good Titles in the Law to such purchasers And if any of my said Messuages Tenements Cottages or real or personal Estate whatsoever remain after my said Children are brought up and Attain to the respective ages of Twenty one years (and after the decease of my said Wife) Then I will that so much of my said Estate whether real or personal then remaining be equally given to and divided amongst all my children that are then living share and share alike And I do hereby constitute and appoint my said Wife Lydia Executrix of this my last Will And I also nominate and Appoint my Brother in Law William Meade and my Friend John Rusher of Ensham Trustees and joint Executors in Trust of this Will Authorising and desiring that they will Interfere Assist and see that this my last Will be duly executed according to true intent and meaning hereof In Witness whereof I have set my hand and seal the twenty fourth of November 1766              Jerey Smith
