The Will of Sarah Smalley

I Sarah Smalley of Stapleford in the County of Nottingham Spinster do make this my last Will and Testament as follows first I direct all my just debts funeral and testamentary expences be paid and satisfied by my Executors hereinafter named so soon as may conveniently be after my decease next I give and bequeath unto my nephew Charles Beaumont (the illegitimate son of my late sister Charlotte Smalley deceased) the sum of two hundred pounds of lawful British money for his own absolute use and benefit Also I give unto my two friends Thomas Wakefield of the Town of Nottingham Hosier and Captain William Sleigh of Stapleford aforesaid Esquire ( my Executors hereafter named) the sum of fifty pounds apiece of like lawful money for their own use absolutely And I do hereby direct that the three above mentioned legacies shall be paid at the expiration of three Calendar months from the decease of my sister Ffanny Hibbard hereafter named Also I gibe and bequeath unto my sister Fanny Hibbard and her assigns during her life the use and enjoyment of all and singular my Household Goods and ffurniture Jewels Plate Linen and China and all other my Household Effects whatsoever and from and after her decease I give and bequeath the same unto my Sister Elizabeth Watts now residing at Wattsford Lunenburg County Virginia in the United States of America for her sole and separate use and benefit but in the event of the death of my said Sister Elizabeth Watts in my lifetime then I give and bequeath the same Household ffurniture and other Effects from and after the death of my said Sister ffanny Hibbard unto and equally between all and every of the Children of ,y said Sister Elizabeth Watts as shall be living at my decease share and share alike absolutely Next I give and bequeath all and singular my money in the three per cents Consolidated Bank Annuities Long Annuities or other Government ffunds or Public Stock and all my ready money and securities for money and all other my Personal Estate and Effects not hereinbefore bequeathed (subject to the payment thereout of the above legacies and my just debts and funeral and testamentary expences) unto the said Thomas Wakefield and William Sleigh their executors admors and assigns Upon trust that they or the survivor of them his executors admors and assigns shall and do continue the same out at interest on the present securities or change and very the same at their or his discretion for any other or others of a like nature And upon further trust to pay the interest dividends and produce thereof from time to time unto my Sister ffanny Hibbard and her assigns for and during the term of her natural life And from and after her decease Upon trust to pay assign or transfer all and singular the said trust monies or the stocks funds and securities upon which the same may then be invested unto my said Sister Elizabeth Watts and to her executors admors and assigns for her own sole and separate use and benefit absolutely in case she shall be living at the time of my decease but in the event of her death in my lifetime then I give and bequeath all and every the said trust monies and Premises from and after the death of my said Sister ffanny Hibbard unto and equally between and amongst all and every the Children of my said Sister Elizabeth Watts who shall be living at the time of my decease share and share alike absolutely And I hereby appoint the said Thomas Wakefield and William Sleigh joint Executors of this my will In witness whereof I have hereunto subscribed my hand this eighth day of May One thousand eight hundred and thirty nine Sarah Smalley
