In the Name of God Amen I THOMAS SMALES of
Middleham in the county of York Esq being of sound and disposing
mind and understanding do make and publish this my Last Will and
Testament in manner following First I commend my soul unto the hands
of Almighty God hoping for the pardon of my sins through the merits
of Christ my Saviour and my body I desire may be decently Interred
in such manner as my Executrix hereinafter mentioned in her
discretion shall think fit. And as to all the Real and Personal
Estate where with it hath pleased God to bless me I dispose of the
same as follows that is to say I will that all such debts as I shall
owe at the time of death be thereout in the first place ?....? paid
and satisfyed And whereas the 19th day this Instant June before
RICHARD WALLER gentleman Deputy Steward of the Manor of Healaugh Old
Land, Healaugh New Land and Mucar [Muker] in Swaledale in the said
county of York did surrender into the hands of the Lord of the Manor
of Healaugh Old Land, Healaugh New Land and Mucar the said messuages
and parcels of land and tenements with the appurtenances situate at
Fremington in the said manor one other tenements with appurtenances
situate at Reeth in the said manor one other messuage and tenement
with appurtenances situate at Park Hall in the said manor one other
messuage with appurtenances situate at Feetham in the said manor and
one other messuage and tenement with appurtenances situate at
Sattron in the said manor As also in the Manor of Healaugh New Lands
the several messuages and parcels of land and tenements hereafter
mentioned that is to say one close called ?....? with the
appurtenances situate at Reeth in the said Manor Also one parcel of
ground called ?....? with appurtenances at Fremington in the said
manor and one close called West Land Bed and one close called
Brockenbank with the appurtenances situate at Feetham in the said
manor and also in the Manor of Muker the several messuages parcels
of land and tenements hereafter mentioned that is to say all that my
moiety or one half part of a messuage and tenement and several
parcels of land with appurtenances situate at Oxnop in the said
manor and one messuage and tenement and several parcels of land with
appurtenances formerly the estate of Mr MATTHEW SMALES and all that
my moiety or one half part of one messuage and tenements and several
parcels of land with appurtenances formerly the estate of Mrs JANE
ALDERSON all of which said premises are situate at Oxnop ... I do
hereby declare all the said messuages parcels of land and tenements
to be surrendered into the hands of the said Lord of the said Manor
to the use and behoof of ESTHER my beloved wife her heirs and
assigns forever. Upon this condition Nevertheless and to the intent
and purpose that out of the rents and profits thereof my said wife
shall pay to my Honoured Father JOHN SMALES of Spennithorne in the
said County of York gentleman and to Mrs ANNE EVERETT of
Spennithorne aforesaid the sum of £20 yearly to be divided betwixt
them share and share alike during their joint lives and after the
decease of either of them to the survivor the sum of £20 during
their natural life.
Item I give and bequeath to my kinswomen ANN
HAMMOND and JANE HAMMOND each of Richmond in the said county of York
the sum of £5 apiece to Buy Mourning.
Item I give and bequeath to THOMAS GYLL of
Durham Esq, the said JOHN SMALES of Spennithorne, LAWRENCE BROCKETT
of Headlam in the County of Durham, JOSEPH COATES and JOHN THONPSON
each of Richmond aforesaid, gentlemen, a Ring apiece.
Item I give and bequeath to the said JOHN
THOMPSON the sum of £3 12s. And as to all the rest and residue of my
estate whether real or personal moneys and securityes for moneys
.... I give and bequeath the same to ESTHER my beloved wife whom I
do hereby appoint sole executrix of this my Last Will and Testament
hereby revoking all former and other wills by me heretofore made.
