The Will of Nicholas Sirrell

 

I Nicholas Sirrell of Guilford Street in the parish of All Saints in the City of Hereford Gentleman do hereby revoke all former Wills and Codicils by me at any time heretofore made and do declare this to be my last Will and Testament. I give and bequeath all my personal estate and effects whatsoever and wheresoever and of what nature or kind soever of or to which I am or at my death shall be pofsessed or entitled at law or in equity or of which I have or at my death shall have power to dispose by Will unto my son Henry Sirrell of Shrewsbury, servant, his executors and administrators Upon trust that he the said Henry Sirrell his executors or administrators shall as soon as conveniently may be sell call in and convert into money such part of my said personal estate as shall not consist of money. And I declare that the said Henry Sirrell his executors or administrators shall from the sale calling in and conversion into money of such part of my said personal estate as shall not consist of money and the money of which I shall be pofsessed at my death in the first place pay and discharge all my just debts funeral and testamentary charges and expenses. And do and shall pay and divide the surplus or residue of the said monies unto and between my children NICHOLAS SIRRELL, ANN the wife of William HARDAKER, GEORGE SIRRELL, ELIZA the wife of Albert MYERS, SARAH SIRRELL and himself the said HENRY SIRRELL in equal shares and proportions. I give and devise unto the said Henry Sirrell his heirs executors administrators and assigns respectively All the Estates which at the time of my decease shall be vested in me upon any trusts or by way of mortgage of which I have power to dispose by this my Will with their rights members and appurtenances to have and to hold the said Estates unto the said Henry Sirrell his heirs executors administrators and assigns respectively according to the nature and quality of the same premises respectively Upon the trusts and subject to the Equity of redemption which at the time of my decease shall be subsisting or capable of taking effect therein respectively, but the money secured on such mortgages to be considered and taken as part of my personal estate. I appoint the said HENRY SIRRELL EXECUTOR of this my Will. In witnefs whereof I the said Nicholas Sirrell have to this my last Will and Testament set my hand this twenty fourth day of October in the year of our Lord one thousand eight hundred and seventy two. Signed and declared by the said Nicholas Sirrell as and for his last Will and Testament in the presence of us present at the same time who at his request in his presence and in the presence of each other have hereunto subscribed our names as witnefses thereto (signed) John Gwillim, Solicitor Hereford; E. G. S. Corser his Clerk.

Proved at Shrewsbury the twenty eighth day of October 1874 by the Oath of Henry Sirrell the son the sole Executor to whom Administration was granted.

The Testator Nicholas Sirrell was formerly of Guilford Street in the parish of All Saints in the City of Hereford and late of Beech Cottage Oak St Shrewsbury in the County of Salop Gentleman and died on the 22nd day of September 1874 at Beech Cottage aforesaid. Under 100 pounds J. Gwillim Solicitor Hereford
