This is the last Will and Testament of me WILLIAM JACKSON
SHAW of 35 Crescent Road Birkdale Southport in the County of
Lancaster Gentleman
·
I
hereby revoke all testamentary instruments at any time
heretofore executed by me
·
I
appoint my brother BENJAMIN SHAW and GEORGE WHEELDON
of Southport aforesaid Solicitor (hereinafter called “my
trustees”) to be Executors and Trustees of this my Will
·
I
declare that in the interpretation of this my will the
expression “my Trustees” shall (where the context permits) mean
and include the Trustees or Trustee for the time being hereof
whether original or substitute
·
I
request my Executors to bury my body in my grave at the Cemetery
Southport aforesaid and direct them to place a suitable
inscription on the memorial stone standing thereon
·
I
direct payment as soon as conveniently may be after my decease
of my funeral and testamentary expenses and debts (including a
debt of One thousand three hundred and fifty pounds now owing by
me to the Trustees of the Will of James Lowe deceased)

I
bequeath free of death duties to my said brother BENJAMIN SHAW
my leasehold dwellinghouse with the outbuildings thereto
belonging situate in and being numbered 35 Crescent Road
Birkdale aforesaid wherein I now reside for the residue which
shall be unexpired at my decease of the term for which the same
premises are held (subject to the rent reserved by and to the
lessees convenants and conditions contained in the Lease under
which the said premises are held) together with all my furniture
fixtures and household effects in about or belonging to the said
dwellinghouse and together also with my wearing apparel and
jewellery

I
bequeath free of death duties my leasehold messuages with the
outbuildings thereto belonging situate and being numbered 6 and
8 Cavendish Road Birkdale aforesaid with the appurtenances
thereto belonging unto my housekeeper JANE TOOTH provided
she shall be in my service at the time of my death for all the
residue which shall be unexpired at my decease of the term for
which the same premises are held subject to the rent reserved by
and to the covenants and conditions contained in the lease under
which the said premises are held

I
devise and bequeath the residue of my estate and effects
whatsoever and wheresoever both real and personal unto my
Trustees upon the trusts following that is to say
a) Upon trust to sell call in collect and convert into money
the same at such time or times and in such manner as they shall
think fit and to stand possessed of the proceeds of such sale
calling in and conversion

Upon trust to pay the following legacies
all free of death duties that is to say the sum of Fifty pounds
to each of them the said BENJAMIN SHAW and GEORGE
WHEELDON in case they shall respectively prove my Will The
sum of Two hundred pounds to ESTHER STOTT
(the sister of James Lowe below)
the wife of JAMES STOTT of 26 Ladies Lane Hindley in the
County of Lancaster The sum of Twenty five pounds to my servant
EMMA DENNETT provided she shall be in my service at my
decease

And upon further trust to pay the
following legacies but I declare that if the moneys to arise
from the sale and conversion hereinbefore directed or otherwise
forming part of my estate shall not be sufficient to pay my
funeral and testamentary expenses and debts and all the legacies
bequeathed by them my Will then the following legacies shall
abate proportionately in exoneration of the legacies
hereinbefore bequeathed that is to say the sum of One thousand
pounds to be equally divided between my nephews and nieces the
children of my brother the said BENJAMIN SHAW living at
my decease (there were
five) and the children of any
then deceased child of his but so that the children of any
deceased nephew or niece shall take equally between them only
the share which their parent would have taken had he or she
survived me The sum of One thousand pounds to be equally
divided between my nephews and nieces the children of my brother
THOMAS JEFFERSON SHAW of Hall Lane Hindley aforesaid
living at my decease
(there were five – one had died)
and the children of any then deceased child of his but so that
the children of any deceased nephew or niece shall take equally
between them only the share which their parent would have taken
had he or she survived me The sum of six hundred pounds to be
equally divided between such of the following children of
JAMES LOWE the younger of Castle Hill Hindley aforesaid
Grocer as shall be living at my death namely ALICE LOWE
EDITH ATKINSON and MARGARET DAVIES The sum of
Fifty pounds to the Trustees of St Paul’s Congregational Church
Hindley aforesaid

And
upon further trust to pay the residue of the said moneys to
arise from the sale and conversion hereby directed or otherwise
forming part of my estate unto and for such charitable
institutions or institution or other charitable or benevolent
objects or object in England as my acting Executor or Extors may
in his or their absolute discretion think fit and to be paid to
or for such institutions or objects if more than one in such
proportions as my said EXECUTOR OR Execturos may think proper
and declare that the receipt of the treasurer or other proper
officer for the time being of the said Congregational Church and
of such charitable institutions as aforesaid shall be a
sufficient discharge for all moneys payable to them under this
my Will
