In the Name of God Amen I JOHN SCARR of
Burtersett in the parish of Aysgarth in the North Riding of the
County of York yeoman being weak in Body publish this my Last Will
and Testament in manner and form following that is to say I bequeath
my soul to God in humble hopes of his mercy through Jesus Christ And
my body to be decently buried in the Chapel Yard at Hawes by my
executors hereinafter named.
I give to ALICE SCARR my beloved wife the
messuage house wherein we now live with stables gardens and all
other tenements ... and a grass garth or croft on the backside and 1
close called Gilldales ..... and 1 close called Crabba ... and 1
close called Brakenfold ... and 1 close called Barkhawslay,,, and 1
close called Bank ... and 2 cattlegates in Burtersett Cow Pasture
and 2 cattlegates in Burtersett High Pasture present stint ... and
also 1 cottage house wherein ELIZABETH BOWES now lives with one half
garth on the backside to be divided by a line drawn from the East
corner of the back room of the house wherein JOHN DINSDALE now lives
to the East corner of a stable on the north side belonging JOHN
SCARR junior and the wall or fence to be made on the west side of
the said line and part of a garth on foreside of the said House as
far as the said house extends with a right to lay timber on the
Gable end of the House wherein JOHN DISNDALE now lives with all
appurtenances and 11s 3 1/2 d Fee Farm Rent to hold to her the said
ALICE SCARR .....
And I also give and devise to my said wife
ALICE SCARR 1 close called Trainmire and 2 cattlegates in Sleddale
.... with 5s 8d Fee Farm Rent ... and also one half of a pew in
Hawes Chapel wherein we now sit .
I give and devise to my cousin THOMAS ROBINSON
1 close called Pry ... 1 close called Higglegigles .. 1 close called
Stripe ... and a messuage house wherein JOHN DINSDALE now lives with
2 stables and one half of the garth on the backside to be divided as
above .... and the wall or fence to be made at joint expence of my
wife and him and he has to make his roadway on the west side of his
share and part of the garth ... and 2 cattlegates in Burtersett Low
Pasture and 2 cattlegates in Burtersett High Pasture ... and 4s 6d
Fee Farm Rent and 1 cattlegate and 6d rent in Durley Pasture at
Gailes with 2s 4d fee Farm Rent .... on condition he pay to his
sister SARAH ROBINSON £60
I give and devise to my cousin EPHRAIM
ROBINSON .... 1 close called Low Shaw ... 1 close called Low Shaw
Brow .... 1 close called High Shaw Brow .... 1 close called Low
Intack ..... 1 close called High Intack .... and 2 cattlegates in
Burtersett Low Pasture and one and two thirds of a cattlegate (for
twinter) in Burtersett High Pasture .... and 4s 6d Fee Farm Rent
..... on condition he pay his sister HANNAH BONSON £50 and my
executors give her a mortgage deed which I have on a close called
Hungrihill Fold and my will is that the said THOMAS and EPHRAIM
ROBINSON enter upon the above devised lands 5th April after my death
on the dwelling house wherein JOHN DINSDALE lives and on 12th May
and not before .... and also the fence on Mountbank Hill betwixt
Trainmire and Pry be divided equally betwixt my wife and THOMAS
ROBINSON and he to make the east part ....

I give and bequeath to my cousin JAMES FAWCIT
£3 a year ...
I give and bequeath to my cousin ALICE BLADES
wife of WILLIAM BLADES £3 a year ....
which last two annuities to be paid by my wife

I give and devise to ALICE SCARR my wife,
STOCKDALE COLTON my father in law and WILLIAM COLTON my kinsman ...
all my estate land and tenements cattlegates .... at Hawes .... and
Appersett To Hold ... for ever In Trust nevertheless for the
following uses .... to sell to the best advantage .... and turn into
ready money... out of which money I order they pay all my debts and
the above legacies ...
I give and bequeath to ALICE SCARR my wife all
the rest and residue ... of my goods and chattels and all my worldly
substance ... and order and make my wife ALICE SCARR my father in
law STOCKDALE COLTON and my kinsman WILLIAM COLTON executors ... and
that WILLIAM COLTON accept of £4 for his troubles .... In witnesse
whereof I have hereby set my hand and seal this 20 December 1778

Footnote - a cattlegate is the right to
graze animals on open pastures
stint is working out how many
animals can be grazed on the pasture in a season, it varies from
year to year
