(1773-1853);
3.
Testator’s
younger son Rowland
(1752-1801) married Ann
(c1755-1790) but is not
known to have had
children.

Text:
This is the last will
and testament of me
Rowland Scales the
elder of Thwaitehead in
the parish of Coulton
and county of Lancaster,
yeoman, made, published
and declared this twenty
fourth day of April in
the year of our Lord one
thousand seven hundred
and eighty seven in
manner and form
following, that is to
say,
First, I give and devise
to my beloved wife Ann
all and singular my
customary lands and
tenement situate and
being at or near Outyeat
in the parish of
Hawkshead and County of
Lancaster aforesaid,
adjoining to and now
possessed with a certain
messuage and tenement
situate at said Outyeat
holden by her my said
wife Ann by and under
the custom of the manor
of Hawkshead aforesaid
to hold the said devised
lands and tenements to
her my said wife Ann and
her assigns for and
during the term of her
natural life, she paying
yearly and every year
during the said term
such rents fines dues
and services as is of
right accustomed to be
paid or done for the
same and also paying and
discharging yearly and
every year such interest
for such sum or sums of
money as is or may by
Deed of Mortgage be
charged thereon, during
the said term of her
natural life, and at the
end and determination
thereof I give and
devise all and singular
my aforesaid customary
lands and tenements unto
my oldest son John
Scales, to hold to him
his heirs and assigns
for ever according to
the custom of the manor
aforesaid, subject to
the payment of such
money as is or may by
Deed of Mortgage be
charged thereon or
jointly with the before
mentioned messuage and
tenement holden by my
said wife Ann, which is
intended by her for him
my said son John after
her decease, he having
already by me been
preferred and advanced
considerably above my
other son, herein after
mentioned
Next, I proceed to
dispose of all and
singular my freehold
messuages lands and
tenements whatsoever and
wheresoever situate and
being either at or near
Thwaitehead aforesaid or
within the Liberties of
Satterthwaite in the
parish of Hawkshead
aforesaid or elsewhere,
whereof I have any power
either in Law or Equity
to dispose of by this my
will, and not herein
disposed of before, I
give and devise unto my
younger son Rowland
Scales his heirs and
assigns to have and to
hold the said several
freehold messuages,
lands and tenements unto
him my said son Rowland
Scales, his heirs and
assigns forever, subject
to and charged with the
payment of my just debts
except such as are
charged on the said
customary lands and
premises at Outyeat
aforesaid,
And with regard to my
personal estate and
effects I dispose
thereof in manner
following
First I give and
bequeath to my said wife
Ann all my stock of
sheep, belonging the
said customary messuages
and tenements lands and
premises at Outyeat
aforesaid, provide they
be not otherwise sold or
disposed in my lifetime,
and I also give and
bequeath to my said wife
Ann, one bed, bedsteads
and bedding thereto,
together with a few real
necessary household
goods such as she shall
choose for her own use,
and as to all the rest
residue and remainder of
my personal estate and
effects whatsoever and
wheresoever, whereof I
shall be possessed of I
give and bequeath the
same to my said son
Rowland Scales, and do
hereby nominate
constitute and appoint
him sole executor of
this my last will and
testament,
And lastly I mention and
appoint my trusty
friends Rowland Taylor
of Thwaitemoss and
Thomas Walker, of
Rusland Hall, both in
the said parish of
Coulton and County
aforesaid, Gentlemen,
Supervisors of this my
will desiring them to
see that the same be
fulfilled and performed
according to the true
intent and meaning
thereof

witness whereof, I, the
said Rowland Scales, the
testator, have hereunto
put my name and seal the
day and year first above
written.

Rowland Scales, sole
executor of the within
will named, was sworn
well and truly to
execute and perform the
same and so forth; and
that he believed all the
personal effects which
the testator within
named died possessed of
or entitled to, will not
in their real value
amount to the sum of
£100.
