In the name of God Amen I William Sayer of
Morton Flatt (?) in the County of York Yeoman being sick and weak in
body but of sound mind memory and understanding do make publish and
declare this my last will and testament in manner and form
following. That is to say I give and bequeath unto my dear wife
Elizabeth all my right and tithe.. I may have or claim to the farm
which I now hold by … from Mr William Milorington (?) situate at
Morton Flatt aforesaid or elsewhere to hold to her for all such time
and form and in the said .. mentioned . Also I give and bequeath
unto my said dear wife Elizabeth and tyo my son Thomas Sayer all my
..Gods of whatever kind and also all my carter and husbandry goods
of what sort.. and also all my ……. To be immediately after my
decease equally divided between them share and share alike. Also I
give and bequeath to my said son Thomas Sayer the further sum of
five shillings to be paid him within twelve months of my decease by
my executor hereafter named. Also I give and bequeath to my
daughter Mary Weighill and Margaret Sherwood the sum of five
shillings apiece to be in like manner paid after my decease.
Further I give and bequeath unto my son William Sayer the sum of
forty pounds to be paid him by my executor in manner following, that
is to say the sum of twenty pounds at the end of twelve months after
my decease and the remaining sum of twenty pounds at the end and
expiration of the third (?) year after by dec4ease. And further I
give and bequeath unto my son Bartholomew Sayer the sum of forty
pounds to be maid him by my executor as is hereafter mentioned.
That is to say the sum of twenty pounds ….. at the age of twenty one
years and the remaining sum of twenty pounds when you shall attain
the age of twenty three years …… that the two last sums of forty
pounds each so bequeathed to my sons William and Bartholomew shall
exclude them from having or claiming any sum or sums of money … the
will of Elizabeth….. or otherwise my mind is that the said sums to
them by me hereby bequeathed shall not be paid to them …. Of them so
refusing to give and discharge to my executor for such sum as they
may … and in the aforesaid will lastly. All the rest residue and
remaining of my worldly goods household .. and effects whatsoever I
give and bequeath unto my dear wife Elizabeth and I do hereby
nominate and appoint my said dear wife Elizabeth executor of this my
last will and testament hereby revoking all former will.. heretofore
made in the witness whereof I have hereunto set my hand and seal
this fifteenth day of October in the year one thousand seven hundred
and fifty three.

Obligation
…. Elizabeth Sayer of Morton of Flatt in the
parish of Scruton and County of York widow and Wm Hodgson of
Northallerton in the County aforesaid attorney at law……are bonded
and firmly obliged to the rigfht reverend father in God Edmund by
divine … Lord bishop of Chester. In the sum of two hundred pounds
of good and lawful money of great Britain………..
The condition of this obligation is such that
if the above bounden Elizabeth Sayer widow relict and sole executor
named in the last will and testament of William sayer late of Morton
Flatt in the parish of Scruton in the County of York within the
archdeanery of Richmond Yeoman deceased do truly and faithfully
execute and perform the said will and do pay all his debts and
legacies so far as his goods will extend…………………
