The Will of Thomas Saunders

 

Dated 26 May 1609, Proved 2 Sep 1609

 

In the name of god amen.  The Twentith and sixth Day of May in the seaventh yeare of the reigne of Our Sovereigne Lord James by the grace of God King of England ffrannce and Ireland and the fortith and two of Scotland Defender of the fayth etc in the yeare of our lord god A Thousand Six hundred and nyne.  I Thomas Saunders of Lydiarde-Laurence within the countie of Sommersett and of the Diocesse of Bathe and Welles being sick in bodie but of good and perfect remembrance (for wch God be thanked) Doe make this my last will and Testament in manner and forme following.  ffirst I bequeathe my soule to Allmightie God and my body to Christian buriall.  Item I give to the cathedrall church of Welles fower pence.  Item I give towards the reparation of the church of Lydiard Laurence aforesayd six shillings eight pence for to be buried in the churche.  Item I give to the poore people of Lydiard Laurence aforesayd tenne shillings to be Delivered by the Discretion of my Overseers hereafter to be appoynted vnto those that have most neede.  Item I give to my Godchildren fower pence a peece.  Item I give to my sonne Thomas a parcell of ground commonly called Priston Close within the parish of Woollavington for and out of which he shall pay to my sonne John fower pounds yearely of lawfull english money to be payd Quarterly by even and equall portions of the sayd John or his Assignes Doe lawfully Demannd it so as he kepe it to his owne use, otherwise the sayd Thomas shall not pay it.  The sayd Thomas is to have it to him his heires executors and assynes:  But if it happen that the sayd Thomas Die vnmaried having no children, the same to be and remayne vnto my sonne Christofer his heires executors and Assignes:  but if it happen that the sayd Christofer Die vnmaried having no children That then it shall bee and remayne to my sonne Robert his heyres executors and assignes.  And if it happen that they the sayd Christofer or Robert shall have it for Default of yssue as aforesayd:  That then the sayd Christofer or Robert to whom soever it shall remayne, shall pay to the aforesayd John the annuitie aforesayd.  Item I give to my sonne Christofer his heires executors and Assignes two meadowes which I have in Halse commonly called by the name of Halse wood by estimation seaven Acres:  but if he Die without children, then it shall remayne to Thomas his heires executors and Assignes:  But if it happen that the sayd Thomas Die vnmaried having no vssue, That then it shall remayne to Robert his heires executors and Assignes.  Item I give to my sonne Robert fortie pounds of good and lawfull english monie and of the same he is to have fower pounds yearely at two times in the yeare but if he be maried or come to some lyving Then he is to have the fortie pounds at one payment and then the Annuitie to cease.  Item my Executrix and my sonne Thomas shall allowe my Daughter Agnes an estate in a tenement called Northwalls in the parish of Cheddon fitzpayne according to the estate which she hath alreadie for terms of her lief ?? she pay out of the said tenement fortie shillings yearely of currant english money yerely During her naturall lief to th’use of my sonne John if he keepe it to his owne vse:  And if this be well and trulie performed to th’aforesayd Agnes That then she shall surrender her right interest and estate of a Tenement in Chappleley within the parish of of [sic] Lyddeard Laurence in the tenure of one Gregory Wrentmore alias Bonde into the Lordes handes (according as she is bound to Doe) to th’use of the sayd Robert and Christofer according to the Custome of the Manor there:  And if the sayd Robert Die vnmaried, then it shall remayne and be vnto the sayd Christofer:  the same to be had in possession from the handes of the Lorde vnto Thomas my Sonne fortie poundes and also to my sonne Christofer fortie poundes so as they be ruled by their freindes and Doe well, otherwise they shall not have it.  Item I give to my Daughter Joane tenn shillings: and to her sonnes Thomas John and Nicholas three pounds equallie to be Devided.  Item I give to my Daughter Elizabeth tenn shillings and twentie shillings to her sonne John.  ffurther it is my last will and Testament that all the Residue of my goodes moveable and immoveable not given nor bequeathed I give and bequeathe vnto Anne my wief, whom I make my sole and only executrix of this my last will and Testament:  and that my said Executrix shall have two yeares libertie for the payment of my legacies next after my Deceasse.  Provided also and it is my will that if the sayd Anne my wief happen to be married agayne after my Deceasse:  That then she shall give vnto my sonne Thomas fortie pounds of lawfull english money:  but if she refuse to be myne executrix, that then it is my will that my sonne Thomas be myne executor and that he pay to my wife Anne fortie poundes of good and lawfull english money.  And it is my will and testament that my sonne Thomas have yearly kept in and vpon the Tennement where I now Dwell During the lief of Anne my sayd wief Tenne sheepe.  Provided also and it is my will that whosoever of my sonnes shall enioy the house and living that I now Dwell in, that my Executrix shall leave vnto him after her Deceasse all the ploughstuff and houshoulde stuff vsed and imployed to the same.  Also I Doo ordayne and appoynte Thomas Wrentmore alias bonde of Busshope Lyddiard and Henry Woolcott of Ashpriors to be my Overseers to see this my last will and Testament fully performed and fulfilled as neere as they may:  And I give vnto them Tenn shillings a peece for theire paynes taken in such a charitable busynes.  Memorandum that if my sayd wief Anne or her Assignes Doe selle or put to wast so much woode as corne to the value of Tenne shillings in any one yeare During her naturall lief, more then for the ordinary vse therof that she shall or may have in her house, that then she shall pay vnto my sonne Thomas Twentie poundes more of currant English money.  Signum Thome Sanders witnesse Thomas Saunders th’yger [the younger], Christofer Sanders Robert Sanders.

 

Probatum fuit supra scriptum Testamentum apud London coram venerabile viro Mayro Edmundo Pope legum Doctore Surrogato venerabilis viri Domini Johanns Benet Militis legum Doctoris curie Prerogative Cantuaricusis Magisteri Instedis sixe Commussarij legitime constituti: Secundo Die mensis Septembris Anno Domini Millesimo Sexcentesimo Nove:  Juramento Anne Sanders relicte Dicti Defuncti et Executeris in huinsmodi? testamento nominate Im commissa fuit Administratio bonorum Juriam et creditoram Dicti Defuncti: De bene et fideliter administrand cadem Ad saurta  Dei evangelia alias vigore Commissiomis in hac parte emanat Jurat./
