The Will of Elijah Sarratt

 

This is the last Will and Testament of me Elijah Sarratt of Oxton in the County of Chester Joiner made and published this twenty seventh day of January in the Year of our Lord One Thousand seven hundred and ninety six in the manner following that is to say I do hereby subject and make liable all and every my Estate and Effects whatsoever to the payment of my just Debts Funeral Expences and the Charges of the Probate of this my will And so subject I give and bequeath unto my loving Wife Elizabeth Sarratt all and every my Goods and Chattells Real and Personal estate for and during her natural Life Provided she be not married nor make no Waste or destruction of my said Personalty nor have nor suffer any of her relations to live or be with her or dwell upon any Premises which she shall happen to hold Neither Father, Mother, Sister or Brother to dwell with her And from and after her Death and Decease , or her day of Marriage, or if she make any waste or destruction of my said Personalty, or if she suffer any of her relations, Father, Mother, Sister or Brother to live or dwell upon any Premises wheresoever she shall happen to hold, Then and after any of the said Cases Happening after my death and Decease I do hereby Order my Executors herein after mentioned To Sell and Despose of all and Every my Personal Estate Goods and Chattells whatsoever in the best Manner they Can in Order towards the payment of Boardwages of my Two Sons John Sarratt and Thomas Sarratt until my said son Thomas Sarratt arrive and attain the Age of Sixteen Years of Age Provided he shall happen not to arrive at the said Age of Sixteen Years before my said Wife’s Death, Day of Marriage, or my said Wife doing contrary to this my Will as aforesaid Then I give and bequeath the Rest Residue and Remainder of the said Cash Money and Personal Estate (Arising from the Sale and Disposal of my said Goods and Chattels, Real and Personal Estate, after the Boardwages and Maintenance is paid for my said two Sons John Sarratt and Thomas Sarratt) unto my said two Sons John Sarratt and Thomas Sarratt share and share alike or to the Survivor or longest liver of either of them To be paid to them when my said son Thomas Sarratt arrive at the Age of Sixteen Years of Age Or Provided my said son Thomas Sarratt Die before he arrives at the Age of Sixteen Years of Age then the Whole to be paid to my son John Sarratt at the said Time my said son Thomas Sarratt whould have been Sixteen Years of Age if he had then been living Provided also if my son John Sarratt die before my son Thomas Sarratt Arrive at the Age of Sixteen Years then the Whole to be paid to my son Thomas Sarratt when he arrives at the Age of Sixteen Years Provided nevertheless he my said son Thomas Sarratt should happen to arrive at the Age of Sixteen Years or upwards before my said Wife’s Death, Day of Marriage, or my said Wife doing contrary to this my Will as aforesaid Then I give and bequeath all my Cash Money and Personal Estate Arising from the Sale and Disposal of my said Goods and Chattels and Personal Estate whatsoever unto my said two Sons John Sarratt and Thomas Sarratt Share and Share alike or to the Survivor or longest liver of either of them Then in this Case to be paid and due on the day the said Personalty Is Sold Also I give all that my Real and Freehold Estate Situate and being in Tranmere and Holthill in the County of Chester unto my loving wife Elizabeth Sarratt To hold to her during her natural Life Provided she keepeth herself unmarried nor make no Waste or destruction thereupon and from and after her Death and decease or day of Marriage which first happens I give and devise the same unto my said two Sons John Sarratt and Thomas Sarratt Share and Share alike and to their own use of them their Heirs and Assigns for ever And I hereby make my said two Sons John Sarratt and Thomas Sarratt my Two residuary Legatees Share and Share alike And I do hereby nominate appoint and make John Banks my Brother in Law And my Brother Sharp Sarratt Executors of this my last Will In Witness whereof I have hereunto set and put my Hand and Seal the day and year aforesaid Elijah Sarratt
