In the name of God Amen the xxvj the day of
May 1592
I John Sare being sick in body but perfect and
whole in mind, thanks be to God do make this my last will and
testament in manner and form following viz first I give my soul to
God my Maker and to Jesus Christ my Redeemer and my body to be
buried in the church yard of Whitby. Item I give to Merriall by
daughter £5 and one johie. Item I will that Agnes my daughter shall
have her portion and she and it to be delivered to my daughter
Alice, and to William Armstrong her husband whom I do appoint tutor
to her. Item I do give to my said daughter Agnes £3 6s 8d which is
in my brother Hugh Sare’s hand. Also I will that Marie my daughter
shall have her portion and she and it to be delivered to my brother
Hugh Sare who I do appoint tutor to her. Also I do give to my said
daughter Marie £3 6s 8d which is is in my said brother Hugh’s hand.
Provided always that my son William Armstrong and my brother Hugh
Sare shall have the occupation of the aforesaid money till my
children come to lawful years of age. Also I will that my said two
daughters Agnes and Marie shall have in full and satisfaction of
their filial portions all my whole interest and title of one
farmhold which I have in Newholme with all the commodities thereto
belonging for the space of 20 years next after my departure out of
this world. And I do appoint my foresaid friends William Armstrong
and Hugh Sare to be and doers for them in all respects always
provided that my said two daughters do not contract nor marry to any
man without the consent of the said two tutors. Also I do ordain
and appoint Mr John Crathorne my friend to be tutor and governor to
my son Leonard Sare and to order him and all his lands and leases
at his pleasure till my son Leonard Sare comes to lawful years of
age. And I do give to my said son Leonard Sare all my whole interest
and title which I shall have in my farmhold in Newholme after the
foresaid 20 years be expired which I have given to my forsaid two
daughters. Also I give to my said son Leonard ten pounds in full
satisfaction of his childs portion of all my goods. Also I give to
my son leonard Sare my dwelling house in Whitby when he shall be
xxvj years of age then to enter to it with all the commodities
thereto belonging provided always that he shall not let nor sell
the*** but only to the heris lawfully begotten of his body. And in
default of his heirs that then the said house with all the
commodities thereto belonging or appertaining to come to Marie Sare
and Agnes Sare my daughters and to their heirs for ever. Item I
give to John Crathorne my young grey mare. I will that my wife Agnes
Sare shall have her third of all my goods according to the law in
that case provided. I give to the poor folks Of Whitby 15 s to be
divided amongst them. Also I give to Alice my daughter one cow and
One whie. I give to Hugh Sare my brother one cow and one whi. I
give to John Pacock alias Sare 20 s and two ewes. I give to William
Blenkhorne vijd (7d). I give to Gyles Leightfoot vijd, I give to
Sur Robert Toes my curate iijs viijd (3s 8d?) Item I give to Agnes
and Marie my daughters either of them three silver spoons and either
of them two plates of the next best. Item I give to Anna Sare and
marie my daughters iij li xs iiijd (£3 10s 4d). Item I give to
Marie and Agnes my daughters either of them two yards of my best
linen. Item I give to my wife four yards of the same. Also I will
that leonard Sare my son shall neither get let nor sell any part of
the parcel of my farm in Newholme but only to the rest of my
children. And if my said son die without issue or before he has come
to lawful years of age that then my said farmhold in Newholme shall
remain to the rest of my children.
Also I ** William Blenkhorne and Gyles
Leightfoot to be supervisors of this my last will the rest of my
goods my debts paid my legacies fulfilled and I honestly brought to
the ground I do give to Ann Sare, Isabel Sare, and Elizabeth Sare,
my daughters whom I do make full executrixes of this my last will
and testament. And I do ordain and appoint Hugh Sare my brother,
Gyles Leightfoot, and Agnes Sare my wife to be tutors and governor
of this my last said two daughters and executrixes till they come to
lawful years of age. These witnesses Christopher Blenkhorne, Jacob
Alder, William Armstrong, Hugh Sare, Gyles Lightfoot, Robert Toes
cum alias viz John Gailsarth, Francis Harker.
Will proved 3rd April 1595 in the Deaconry of
Cleveland. Administration granted to Ann Sare, Executrixes Isabella
and Elizabeth
