The Will of John Rowe (1791 - 1866)

 

 

 This is the Last Will and Testament of me John Rowe of South Normanton in the Parish of South Normanton in the County of Derby. Termed made published and declared this Twentyfifth day of June in the Year of Our Lord one thousand eight hundred and sixty four.

 

In the first place I will and direct that all my just debts funeral expenses and the charge and expenses of proving this my Last Will and Testament be fully paid and satisfied by my Executors hereinafter named out of my personal Estate.

 

Then I Give Devise and bequethe to my daughter Catherine Rowe all those six messuages Tenements  or dwellinghouses and Gardens situate on the West Side of the Yould Yard of Normanton in the Parish of South Normanton in the County of Derby which is now or late in the occupation of Samuel West and Griffin Batisson and William Brookes and John Brookes and William Bardemore and William Flint for and enduring of her natural life after the determination of her natural life then to her several and respectif heirs for ever.

 

Also I Give and bequethe to my daughter Keziah Rowe all those five messuages tenements or dwellinghouses and gardens which is situate lying and being on the north and east part of the Yould Yard and in Normanton in the Parish of South Normanton in the County of Derby which is now or late in the several occupations of Eli Rowe and John Clark and Benjamin Brooks and William Simpson and William Purdy for and enduring the term of her natural life, after the forfiture and determination of her natural life then to her several and respectif heirs for ever.

 

Also I Give devise and bequeathe to my daughter Mary Sims the wife of Thomas Sims of Alfreton All those four messuages Tenements or dwellinghouses and Gardens which is situate lying and being in Normanton in the Parish of South Normanton in the County of Derby and is now or late in the several occupations of Elizabeth Rowe and Daniel Page and William Barocliff and Henry Stocks for and enduring the term of her natural life after the forfiture and determination of her natural life then to her two daughters Ellen and Catherine Sims and to their heirs for ever.

 

Also I Give devise and bequeathe to my son John William Rowe all those four messuages tenements or dwellinghouses and gardens which is situate lying and being in a part of the town called the Lane in Normanton in the Parish of South Normanton in the County of Derby and is now or late in the several occupations of Mary Brown Widdow and Emanual Ball and Catherine ………  Widdow and the other House is at the north part of the Yould Yard and is in the occupation of John Welch for and enduring the term of his natural life, after the forfiture and determination of his natural life there to his heirs for ever.

 

Also I give, devise and bequeath to my three Granddaughters Catherine Wheeler and Ellen Wheeler[2] and Keziah Riley all those three messuages, tenements or dwellinghouses and gardens which is situate lying and being in a part of the town called Ball Hill in Normanton in the Parish of South Normanton in the County of Derby. The House at the east end I bequeathe to Catherine Wheeler. The house at the west end I bequeathe to Ellen Wheeler and the middle house I bequeathe to Keziah Riley for and enduring there natural lives and to there several and respective heirs for ever, these houses to be delivered when they arrive at twentyone years of age.

 

Also I bequeathe to my daughter Catherine Rowe one set of Bedsteds one Fether bed one Fether bolster and five Fether pillows one pare of shees one pare blankets and one coverlet.

 

Also I bequeathe to my daughter Keziah Rowe one set of Bedsteds one Fether bed one Fether bolster and two Fether pillows one pare of sheets one pare of Blankets and one Coverlet.

 

Also I Give devise and bequeathe to my Son Adrian Rowe all those two messuages Tenements or dwellinghouse and garden one is occupide by Samuel Bamford and the other is occupide by myself and the frontage of my house and all the outbuildings Barn Cowhouse and all other outoffices and all the Yould yard and all the remander of the househould furniture which is in my possession together with all the Cattle Cows Stirks[3] Calfs and Pigs and also all the Hay and Corn and Straw I may have in my possession and also all those three Closes or fields or pieces or parcels of Land against my house and is called or known by the name of the First Croft and Narrow Croft and Bottam Croft and also all that other Close at the West end of Normanton and is called and known by the name of Brook Field which is all situate in Normanton in the Parish of South Normanton in the County of Derby for and enduring the term of is natural life and after the forfiture and determination of his natural life then to his heirs for ever.

 

Also I Give devise and bequeathe a Legacy the sum of Eighteen pounds to be paid to my Granddaughter Catherine Wheeler when she shall arrive at the age of twentyone years.

 

Also I bequeathe a Legacy the sum of Eighteen pounds to be paid to my Granddaughter Ellen Wheeler when she shall arrive at the age of twentyone years.

 

Also I devise and bequeathe what ready money I may have in the house and over notes or in the Bankers hands at the time of my deceace to be equalley devided amongst all my sons and daughters share and share allike. Also I Bequeathe half a Crown apiece to be paid to four of my tenents to carre me to the church to be paid at my Funeral. Also I nominate constitute and appoint, my son Adrian Rowe and John Stocks Bookkeeper sole executors of this my Last Will and Testament, whereby revoking all former Will or Wills heretofore made by me In Witness whereof I have set my hand and seal on the day and year is first above written –

Signed sealed published and declared by the said Testator John Rowe as and for his Last Will and Testament in the presence of us and in the presence of each other whom is present, and at is[5] request have subscribed our names as Witness –

In Her Majesty’s Court of Probate – The District Registry at Derby

In the Goods of John Rowe deceased

 

I Thomas Alvey of South Normanton in the County of Derby Farmer and Blacksmith make oath that I am one of the subscribed Witnesses to the Last Will and Testament of John Rowe late of South Normanton in the County of Derby Farmer deceased the said Will being now hereunto annexed bearing date the twenty fifth day of June one thousand eight hundred and sixty four and that, the said Testator executed the said Will on the  - day of the date Testator – Thomas Alvey  [6] - thereof by signing his name at the foot or the end thereof as the same now appears thereon in the presence of me and of John Lomax Farmer and of William Barrowcliff the other subscribed Witnesses thereto all of us being present at the same time and we thereupon attested and subscribed the said Will in the presence of the said Testators  -  Thomas Alvey  - 

Sworn by the said Thomas Alvey at Alfreton in the County of Derby this sixteenth day of June 1866. Before me John Charles Hall Deacon A Surrogate at the commencement of the Court of Probate Act 1857 –

Proved at Derby the 22nd day of June 1866 by the oaths of Adrian Rowe the Son and John Stocks the Testators to whom Administration was granted.

The Testator John Rowe was late of South Normanton in the County of Derby Farmer and died on the 12th day of May 1866 at South Normanton aforesaid.

N.B. : There is no mention of goods going to Ann (who married Michael Holmes Wheeler of Alfreton in 1844). Hiram and Samuel Herbert were already deceased.
