The Will of Thomas Rothwell

 

In Dei Nomini Amen. This eight and twentieth day of the month called April Anno Domini 1731, I Thomas Rothwell of Bicursteth [Bickerstaffe] in the county of Lancaster Yeoman being under infirmity of Body, bt of good and perfect capacity and memory do make this my Last Will and Testament in Manner and form following, that is to say, first I commend my Soul to God Almighty in hopes of Salvation only through my blessed Redeemer Jesus Christ his son, and I commit my body to decent Burial at the discretion of my Executors hereafter named hoping to receive the same in a happy Resurrection by the Almighty power of God.

And as to what temporal estate I am possesst of in this World I give devise and bequeath the same, as is herein hereafter declared, that is to say, first it is my Will and Mind, that all my just Debts, Funeral Expenses and probate of this my Will be fully paid and discharged, all which being done and performed, then I hereby give and bequeath to my brother Henry Rothwell my two lesed? Estates & tenements where of the one was my father's, and the other bought of Hugh Sumner, son of Thomas deceased, my said brother Henry paying to my now wife Anne Rothwell two pounds sterling yearly & every year until my just debts be fully paid, but no longer.

Item I give and bequeath five pounds of currant British money to Elizabeth Roby daughter of Roger Roby of Westhead in Latham, but if the sd Elizabeth happen to die before the age of one and twenty years, then I give and bequeath the sd five pounds to her brother Henry Roby.

Item I give and bequeath to my nephew Joseph Fogg now living with me ten pounds of like money.

Item out of the money due upon Bond from brother James Rothwell I give and bequeath to Henry Rothwell, son of the sd James Rothwell of Lathom five pounds of like money,

Item I give to the younger son and his two daughters of my said brother James fourty shillings apiece of like money.

Item I give and bequeath to my dear wife Anne Rothwell aforsd ten pounds of like money to be paid to her yearly and every year of and from my Estate lying in the Barrow in Bicursteth [Bickerstaffe] aforesd on the second day of February which shall happen in every year during her natural life.

Item I give and bequeath to my sd wife all my personal estate.

Item I give and bequeath to my said brother James Rothwell fifty shillings of like money.

Item I give and bequeath to my brother Richard Rothwell five shillings.

Item I give and bequeath to John Rothwell son of my said brother Henry fifty shillings of like money.

Item I give and bequeath to my sister Ellin Roby fifty shillings of like money.

Item I give and bequeath to my servant Barnet Sumner one Guinea.

Item it is my Will and Mind that the rest residue and remainder of the clear Rent that arises or may arise from my said estate in the Barrow aforesd above the sd ten pounds to be paid to my wife as afore mentioned shall be bestowed, ordered and disposed as that it may go to pay and discharge the debts & Legacies already mentioned.

Item after my sd wife's death and decease, and after ye performance  of this my last will and Testament according as is already herein declared, I do give devise and bequeath my sd Estate & tenement wth its appurtances in the Barrow aforesd to my Brother in Law Robt Fogg during his Life, and after his death I give devise and bequeath the sd Estate in ye Barrow aforesd to his son William Fogg during the term granted in the original Lease thereof.

Finally I nominate constitute and appoint my beloved wife Ann Rothwell, my sd brother in Law Robert Fogg & my family friend Ralph Fletcher of Ormskirk Executors of this my last Will & Testament hoping they will see the same performed according to my Trust in them reposed
