To be buried at the discretion of WILLIAM
PRESTON, my son in law and SUSAN his wife because my son RICHARD
ROOKES lives too far away.
Temporal estate bequeathed in manner
following
To my son Richard my estate at Scotton and
also my house and the ground, hereditaments and appurtenances l
belonging to it situate in Kettlewell in Craven, both in
Yorkshire to hold unto the said Richard his heirs and assigns
for ever. in I also give unto him the said Richard Rookes, to
ROBERT LLOYD, gentleman, my son in law and MARGARET his wife,
one of my daughters, the aforesaid William Preston and Susan his
wife all my estate commonly called or known by the name of Scale
Park in Kettlewell to hold to them as tenants in common and not
as joint tenants for the term of their respective natural lives
and the life if the longest living of them, after their
respective deaths to the heirs of the said Richard Rookes, of
the heirs of the said Robert Lloyd on the body of my daughter
Margaret his wife and the heirs of the said William Preston on
the body of my daughter Susan, his wife, lawfully begotten or to
be lawfully begotten, In default of such issue to the heirs of
Richard Rookes for ever.
Whereas it was agreed between William
Preston and me on the intended marriage between him and my
daughter Susan that in consideration of the fortune left her by
her late father and of £60 of his own fortune to be paid should
I turn over my household goods, plate and linen to hiom, and
wheras he has already paid me £30 the remainder to be paid to my
executor hereinafter named, in performance of the said agreement
I give and bequeath to him all my household goods and implements
whatsoever, also my plate, linen, pewter, copper, brass and
other vessels, my bed and beeding. clock, jack iron weight and
everything else whatsoever, Again I give and bequeath to him
William Preston, the benefit and advantage of the lease I .have
on the house in which I dwell to hold to him and his executors,
administrators and assigns for the rest of the term of the
lease, he paying the rents due.
Again I do appoint that the rents due from
my tenants of Scale Park be paid unto William Preston, any ready
money in the house shall be used to pay any dues on Scale Park,
The residue is to be payable to Richard Rookes, Robert Lloyd and
William Preston.
I give to my daughter Susan Preston my
clothes and wearing apparl whatsoever except one ......... which
I give to my daughter ANN MOTHERBY (sic) which shall be
delivered to her by my daughter Susan Preston. I order my
daughter Susan Preston to deliver to my grand daughters ANN
COWLING and ELIZABETH COWLING all the wearing apparrell which
was their mothers. Again and Lastly I order my son Richard
Rookes to pay to his Sister Ann Molton (Sic) 20 shillings yearly
to buy herself clothes with or otherwise to buy ....... to the
value of 20 shillings and that he pay the said Ann Molton one
shilling and to the said Ann Cowling one Shilling and to the
said Elizabeth Cowling one shilling in consideration of which I
give to him the said Richard Rookes all the residue not disposed
of elsewhere and do appoint him sole executor, to which I have
set my hand and seal this 7th day of December 1735

The obligation was signed on the 24th of
March 1735/6 by Richard Rooke of Bristol in Somerset Gentleman
and Robert LLoyd of the same, Clerk with William Preston of
Richmond Inn Keeper present.
