The Will of William Rook

 

This is the last Will and Testament of me William Rook the Elder of Over in the County of Cambridge ffarmer I give and bequeath unto my Wife Elizabeth Rook the Sum of seventy pounds to and for her own absolute use and benefit and to be paid her within six months next after my decease out of my personal estate and I also give to her all such of the household ffurniture Linen and other effects now in and about my dwelling house as were hers previous to our marriage and also my Mahogany Tea Caddy with its contents Item I give and bequeath all my Clothes unto my Sons William Charles and Ellis to be equally divided between them share and share alike Item I give and devise all my freehold messuages lands tenements and hereditaments whatsoever in Over aforesaid and elsewhere with their and every of their rights members and appurtenances unto my Son in Law Thomas Gifford of Over aforesaid ffarmer my Son William Rook of Over aforesaid and Samuel Carter of the same Place ffarmer their heirs and assigns for ever In trust for sale as hereafter mentioned and I do hereby order Will and direct that the said Thomas Gifford William Rook and Samuel Carter and the survivors or survivor of them or the executors and administrators of such survivor as soon as conveniently may be after my decease to make sale and dispose of all and every my Copyhold messuage Tenements and hereditaments whatsoever in Over aforesaid and Elsewhere in that part of Great Britain called England and also All and every my said ffreehold messuages Lands Tenements and hereditaments and the fee simple and …thereof and out of every part thereof either together or in parcels by public auction or private contract at such place and time and subject to such Stipulations relative to the Title or evidence of title or to the Payment of the purchase money or to any other matter as my said Trustee shall judge expedient or as their counsel shall avowe with full discretion and authority to sell either subject to or discharged from or with an indemnity by impounding part of the purchase money or otherwise against Incumbrances and also to fix a reserved bidding and bay in any lot or lots at any Auction and to rescind or vary any contract for sale without being liable for any consequential loss and also to execute such Instruments and Assurances as shall be requisite for effecting and ….the sales thereof and as to the monies arising from the sale and I declare that the receipt or receipts of my said Trustees or the survivors or survivor of them or the executors and administrators of such survivor shall exonerate Purchasers and others paying monies to such trustees by virtue hereof from all Liability in respect of the application thereof and as to the money arising from the sale of my said freehold and copyhold Estates after Paying thereout all expences attending such Sales and any mortgage that may be existing on any part of my said Estates at the time of my decease I give and bequeath the same as hereafter mentioned and as to and for and concerning all my household furniture plate linen and china Stock Cattle Crops growing and otherwise horses Corn grain Hay ready money and securities for money and All and every other my personal Estate and Effects whatsoever and wheresoever and of what nature or kind soever not hereinbefore disposed of I give and bequeath the same unto my said trustees their executors or administrators in trust that they or the survivors or survivor of them or the executors and administrators of such survivor shall and do as soon as conveniently can be after my decease sell and convert into ready money All such part and parts thereof as shall not consist of money or securities for money and shall and do call receive and get in all such part and parts thereof as shall consist of money or securities for money and as to the money arising from the sale and getting in of my said personal estate after paying thereout all my just debts and funeral and Testamentary expences and the money arising from the Sale of my said freehold and Copyhold Estates aforesaid I give and bequeath the same unto my said Trustees their Executors or Administrators In trust that they or the Survivors or Survivor of them or the Executors and Administrators of Such survivor shall and do in the first place Pay my said Wife the said Sum of seventy Pounds so given and bequeathed to her as aforesaid and ten pounds to my daughter Naomi Brichem as hereafter mentioned and shall then divide the remainder of such monies into five equal portions and pay two of such portions unto my daughter Ruth the Wife of the said Thomas Gifford to and for her own absolute use and benefit and to pay one other fifth part thereof to my said son William Rook for his use and benefit and to pay one other fifth part thereof unto my Son Charles Rook for his use and benefit and to pay the remaining fifth part thereof unto my Son Ellis Rook for his own use and benefit to whom I give and bequeath the same accordingly and such legacies to be vested interests in the respective legatees and transmissible as such to their personal representatives And I give and bequeath unto my said daughter Naomi Brichem the Sum of ten pounds to buy her mourning and I declare that the reason of my not giving my said daughter Naomi any further portion of my said Personal Estate is that I have lately advanced a large Sum of money for her use and to extricate her from some present difficulties in which she has been lately involved and I direct tat any legacy or sum of money given to any legatee who at the time of the actual payment thereof may be a married woman shall be paid into her proper hands in order that the same may be enjoyed and disposed of as her separate property free from marital control and for which legacy her receipt shall be a sufficient discharge and I further declare that my said Trustees shall not be answerable for each others acts or receipts nor for losses happening without their own respective default and shall be at liberty to retain and allow to each other out of the respective trust monies all expences incidental to the execution of the trusts and powers hereby reposed in them and I constitute and appoint the said Thomas Gifford William Rook and Samuel Carter joint Executors of this my Will In Witness whereof I have hereunto set my hand and seal the 18th day of November one thousand eight hundred and forty one the mark and seal X of William Rook the Testator

This is a Codicil to the within Will of me William Rook the Elder I do hereby revoke the appointment of the within named Samuel Carter and appoint the within named Thomas Gifford and William Rook to be the Trustees and Executors only and my said Wife is to have the Chest of Drawers and Boxes and other Articles which were hers before our marriage and I confirm my said Will in all other respects dated this eighteenth day of March one thousand eight hundred and forty six the mark and seal X of William Rook the Elder
