The Will of Richard Rogers

 

In the name of God Amen I Richard Rogers of Lathom in ye County of Lancaster yeoman being of good & perfect memory & understanding (praise be almighty god for the same) do here make & ordain this my last will and testament in manner & form as followeth.  First it is my will and mind that all my just & Lawful debts if any there be at the time of my death & decease & funeral expenses and probate of this my last will & testament, shall all be deducted & taken made & put out of my whole personal estate.
In primis I give and bequeath all and every ye house & housing (where I now live & dwell) land & premises with there & every of those appurtances that doth thereunto belong or in any wise appertains unto my son Richard and to ye heirs of his body for ever lawfully to be begotten always preferring ye older before ye younger & male before the female.  And for want of such issue I do hereby give & bequeath the aforesaid house and housing lands & premises with those & every of there appurtances unto my son Thomas and to the heirs of his body for ever, male or female always preferring the male before the female & older before the younger.  And for want of such issue I do hereby give and bequeath the aforesaid house & housing lands & premises with there & every of there appurtances unto my daughter Mary now wife of James Molyneaux in Hulme in ye county aforesaid husbandman & to ye heirs of her body for ever lawfully begotten or to be begotten always preferring the male before the female and the older before the younger.
Item it is my will and mind that my son Richard shall give or pay unto my aforesaid son Thomas, or ye heirs of his body the sum of seven pounds by twenty shillings the year the first payment to be made at ye end of one year after my death and decease & so to continue ye payment year after year till ye whole seven pounds be paid but be it remembered that James my son Richard both stand firmly bound with my aforesaid son Thomas in one bond to Robert Stopworth of Dalton in ye county aforesaid yeoman for the true payment of six pounds & fifteen shillings; and if my aforesaid son Richard shall be forced to pay the aforesaid sum of six pounds fifteen shillings or any party or parcel thereof or interest: then it is my will & mind that he shall pay for much losses of ye aforesaid legacy of seven pounds unto my son Thomas as he ye Richard shall pay of ye aforesaid six pounds fifteen shillings.
Item it is my will and mind that my son Richard shall give or pay unto my aforesaid daughter Mary or to the heirs of her body the sum of six pounds by twenty shillings the year the first payment to be made at the end of one year after my death & decease & so to continue the payment year after year till the whole six pounds be truly paid and be it also remembered that I have formerly given to my aforesaid daughter Mary ye sum of four pounds.
Item all the rest residue and remainder of my whole personal estate goods & thatever that shall remain over & above paying of my just and lawful debts & funeral expenses as aforesaid I do hereby give & bequeath unto my aforesaid son Richard my son Thomas and daughter Mary to be equally divided amongst them.
Item what I have hereby charged my son Richard to pay to my daughter Mary or her children if my son Richard shall die before any or all of ye aforesaid legacies be made or put or any part of them then it is my will and mind that my aforesaid son Thomas or his executors shall pay them ye said legacies at ye days and times & in the same way and manner hat my son Richard is to pay them ye said legacies.
Item if it shall fall out that my son Richard shall die and leave no child nor children hen it is my will and mind that my son Thomas or his executors shall give or pay unto my daughter Mary or to her children the sum of six pounds more by two equal payments the first payment to be made at the end of one year after the death & decease of my son Richard.
Item I do hereby constitute & make & ordain my son Thomas & William Horrox of Lathom aforesaid tailor ye lawful executors of this my last will & testament desiring them to see the same executed as my trust is in them reposed. In witness whereof I have hereunto set my hand & seal this seventh day of May Anno Dm 1706
